    Victim-offender-mediation started in Belgium as early as 1993 and nowadays the Belgium landscape shows a variety of restorative practices, including conferencing with juveniles and mediation with adult offenders, on the basis of a number of legal arrangements. Progress can still be made in quantitative terms and qualitatively by harmonizing the various legal instruments that are available. The diversionary mediation that is possible at the level of the public prosecutor differs in a number of ways from the mediation that can be offered in subsequent stages of the criminal procedure. A variety of motives and reasons explain the reception and growth of restorative practices, such as the desire to offer victims a better service and to improve the delivery of justice. The willingness to experiment and to collaborate between protagonists of restorative justice and the agencies of criminal justice, and the strong scientific support from the Catholic University of Leuven, are amongst the key factors that promoted the integration and consolidation of restorative practices in the legal system.

    In this article, an ongoing Flemish qualitative research on life histories and criminal careers of women in prison is discussed. We conducted autobiographical interviews with 40 female prisoners aged between 20 and 69 years. Considering our target group, we didn’t always succeed in conducting an autobiographical interview. In practice we often conducted a classic open in-depth interview. By means of file analysis, we reconstituted the criminal career of every interviewed woman. Thanks to the retrospective approach we could reveal a diversity of trajectories. We identified three pathways: (1) youth offenders, (2) early adult-onset offenders and (3) late adult-onset offenders. Remarkably, quite a lot of women are late starters. Three risk factors – to a greater or lesser extent – play a role in these pathways: a problematic educational situation in childhood, drugs and negative love affairs.

    The Netherlands fire safety regulations require certain types of buildings to have a direct connection between the building fire alarm system and the dispatch centre of the fire brigade. These automatic fire alarm systems are mandatory for example in premises where inhabitants such as small children or elderly people have limited self-evacuation capabilites in case of fire. These automatic fire alarms aim at saving lives by a faster response of the fire brigade. However, the fast majority of these automatic alarms are false. As a result these calls constitute a considerable and undesirable drain on the fire brigade resources. These calls cause unwanted direct costs (salaries) and indirect costs (road accidents due to fire brigade mobilisation) apart from the regular maintenance costs. Up to now no data is available for the costs and benefits of the system of automatic fire alarms. This article describes the results of a study of the automatic fire alarm system in the region Twente. The yearly social costs are calculated at about € 3 million. In order to calculate the benefits all incident reports from automatic fire alarms during a period of 29 months have been investigated. In this period no call form an automatic fire alarm system has occured in which the fire brigade had to deploy its resources for a live saving or evacuation action.

    Unlike the physical abusers of children, little is known about downloaders of child pornography. The key questions in this article are: who are the downloaders, what are their backgrounds, why and how they download child pornography, how they behave offline and online and what types of downloaders can be distinguished? A simple answer to these questions is currently impossible to give. There is more, preferably longitudinal, research needed on risk factors for downloading child pornography and the various types of downloaders. Combating the downloaders requires a lot of the police in terms of international cooperation and up to date knowledge and expertise. This also served the treatment practices, which is partly dependent on a properly conducted police investigation.

    A part in Dutch penal law defines money laundering as ‘any person who acquires an object, possesses it, hands it over or sells it or makes use of an object, knowing that the object originates – directly or indirectly – from an offense’. Under object is meant any goods and any property rights. With this in mind, the author argues that whoever knows that money (the object) is derived from crime, but spends the money anyway, is committing a money laundering offense. Taking the argument one step further, it is therefore a reasonable hypothesis that a large number of wives or girlfriends of criminals, have been prosecuted for money laundering. That is, if the women knew that the money they spent was obtained through crime. To test the hypothesis, 62 cases dealing with organized crime were selected and analyzed. These cases largely focus on male perpetrators of drug crimes, money laundering, human smuggling and human trafficking. It turns out that the women often knew their male friends or husbands were involved in crime. The women also profited of these crimes because they used their friends’ expensive cars, lived in large mansions and often went shopping for luxury items. Still, hardly anyone was prosecuted for money laundering offenses. Several explanations were found, ranging from pity of officers, an overload of work, absence of direct proof or simply male chauvinist bias. Only if the women were actively involved in other crimes, would they find themselves prosecuted with (among others) money laundering offenses.

    This article focuses on migration with criminal motives. Two specific groups are discussed, British migrants in the Netherlands and Dutch migrants in Spain. Little is written on criminal migration motives in combination with Western subjects. On the other hand, investigative authorities have first-hand knowledge on this matter. An analysis of 25 closed case files shows that within these two groups of migrants, some people are heavily involved in the international drugs trade. Although their numbers are small, their function is important. Through their actions it becomes possible for certain cities or areas to evolve into international criminal drug marketplaces. There are also some differences between British and Dutch criminals abroad. British criminals are often involved as brokers. They broker drugs for third parties in Great Britain. Their stay in the Netherlands seems temporarily. They do not invest in the economy or buy property. Conversely, Dutch criminals in Spain could be described as leaders of organized crime groups. They invest in Spain by buying companies and property.

    This article focuses on the differences in perception that appear when the English and Dutch discourses on anti-social behaviour and street terror are compared. The political and media discourses in the Netherlands focus on the migration background of the youth responsible (mainly Moroccan juveniles) whereas in England and Wales the possible influence of discrimination is stressed. The analysis of the two discourses reveals that although the problems in the two countries are in essence comparable, very different discourses have developed.

    Increasingly, instruments for risk assessment have been used for the assessment of future violence. This article provides an overview of the risk assessment instruments that are used in the Netherlands for the prediction of criminal recidivism. The quality of these instruments is regarded by examining studies on the interrater reliability and the predictive validity. The benefits as well as the limitations of risk assessment instruments are discussed. It is concluded that these instruments can be valuable, especially for research on treatment effects in the field of forensic psychiatry. On the other hand, it has to be acknowledged that with risk assessment instruments, the possibility to predict criminal recidivism on individual level is still limited. Psychologist and psychiatrists, presenting a mental health assessment to the court, have to inform the judge correctly about these limitations.

    Computers and the internet offer new ways to offenders for committing crimes. The present article uses routine activity theory and large-scale victimization survey data (N=6,896) to study digital threat victimization (i.e. threats people receive by email or chat rooms) in the general population. It assesses risk factors for digital threats and compares them with risk factors for receiving traditional threats and a mixture of digital and traditional threats. The results show that youngsters and offenders of digital crime run higher risks of all types of threat victimization. In extension, outdoor routine activities increase the risk not only of traditional threats but of digital threats as well, while the same holds for certain computer activities (e.g. having a profile on Hyves). These findings point towards the connection of social interactions between people in the physical and digital world. Finally, the results suggest that impulsive people are more vulnerable to threat victimization.

    The authors latest book on Restorative Justice, Self-Interest and Responsible Citizenship has been discussed in this journal in 2009 and the author now responds to the critiques, which came from three jurists and therefore had a predominantly juristic character. Themes discussed are ‘criminal justice and punishment’, ‘restorative justice and the law’, ‘restorative justice, the victim and public interest’, ‘restorative justice and the legal order’ and finally ‘restorative justice and offender rehabilitation’. Walgrave maintains and clarifies the views he developed in the book explaining why it is correct to claim that criminal justice can be identified as fundamentally punitive (although it does not always punish, as one critic has observed) and that it should be possible to elaborate restorative justice into a completely new legal system, offering legal guarantees fitting to what restorative justice is trying to achieve. Legal guarantees as they exist today in criminal procedure cannot be taken as the benchmark for restorative procedures in view of the totally different aims and procedures. Furthermore, it is not true that the victim gets too much power in restorative justice – as one critic stated – because restorative justice is and should be conceived as a system of public law, involving the legal agencies and authorities such as courts in a proper role as guardians of every citizin’s dominion. It is because of the safeguarding of dominion that the victim should have a key-role to play in restorative justice, although not obliged to participate.One critic has mentioned that Walgraves ideas seem to imply that the legal order is only something being imposed upon the citizens ‘top down’, while in many respects one could maintain that the law and the principles of the legal order have been produced ‘bottom-up’ or at least should be the result of democracy. The response is that restorative procedures offer more opportunities for citizens for this democratic participation in producing the norms of the law.Finally some have argued that the rehabilitative interests of the offender should have a more central place in the definition of restorative justice, more or less of the same importance as restoring the harms of the victim. Walgraves experiences with the Belgian model of juvenile protection made him cautious of the risks of doing so, not only in terms of serving the victims needs, but also in terms of the legal protection of the juvenile offender against arbitrary interventions.
