Slachtofferschap: planten en habitats

Waarom habitats en planten ondanks strikte regels toch niet voldoende worden beschermd

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2021
Trefwoorden Antropocene, habitat protection, plants, environmental problems, biodiversity
Auteurs Sander Kole
SamenvattingAuteursinformatie

The current poor conservation status of Dutch nature is a result of human activities and is therefore characteristic of the era of the Anthropocene in which we now live. As a result of climate change, desiccation and a surplus of nitrogen and other environmental problems, the survival of many habitats and plants in the EU and in the Netherlands is at stake. Recent scientific research shows that many habitats and plants are in an unfavorable conservation status. Biodiversity is under great pressure. In almost all cases, the declining biodiversity can primarily be traced back to human activities and the consequences of these activities for nature. The EU Habitats Directive and the Dutch Nature Conservation Act provide a legal system that obliges the protection of all wild habitats and plants. Although the objective of both regulations suggests otherwise, the protection of nature in the application of provisions from the Dutch Nature Conservation Act is not an intrinsic objective. The extent to which habitats and plants are protected is linked to human – often economic – interests. It is this ambivalence in existing laws and regulations – the human perspective – that makes it possible to ‘disable’ rules that are precisely intended to preserve habitat types and plants relatively easily. As a result, environmental problems caused by humans are not or not completely resolved. Remarkably enough, the design and application of current national and international nature conservation law contributes to the undisturbed continuation of the Anthropocene era in which we live.

Herstelrecht en milieuzaken: een verkenning van mogelijkheden in het antropoceen

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2021
Trefwoorden environment, rights of nature, restorative justice, green criminology, Anthropocene
Auteurs Femke Wijdekop en Anneke van Hoek
SamenvattingAuteursinformatie

The environmental crisis makes it clear that our current legal instruments and concepts are not sufficient to effectively combat, remedy and prevent widespread environmental harm. However, new concepts and approaches are being developed that try to reduce these legal imperfections. Our essay explores these developments, in particular the emergence of a legal duty of care for the environment, the rights of nature-movement, the campaign to make ecocide (mass damage and destruction of the environment) an international crime and the application of restorative justice to repair environmental harm. We also advocate a new multidisciplinary perspective launched by us: positive green criminology.

De narratieve sociologie van Lois Presser

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2020
Trefwoorden narrative criminology, critical criminology, mass harm, narrative impacts, power paradox
Auteurs Dr. Bas van Stokkom
SamenvattingAuteursinformatie

In this review-essay, two books by criminologist Lois Presser are discussed: Why We Harm (2013) and Inside Story: How Narratives Drive Mass Harm (2018). In these books the author develops a general theory of harmful action, in particular collective and massive forms of harmful action that are often related to state institutions and large companies. Presser shows that all kinds of stories, scripts and ideologies may justify, support, cover up or deny harmful action. In her publications, cultural sociology, critical criminology and discourse analysis are intimately intertwined.

Normalisering van seksueel grensoverschrijdend gedrag in de (top)sport

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden sexually transgressive behavior, normalization, topsport culture, grooming, coach
Auteurs Dr. mr. Anton van Wijk en Prof. mr. Marjan Olfers
SamenvattingAuteursinformatie

Sexually transgressive behavior occurs in all sections of society, including sports. That includes behavior from making sexual comments to rape. A risk factor is the culture that can prevail in sports, also known as a disruptive culture. There is normalization of deviant behavior. The top sport culture is particularly vulnerable to unacceptable behavior. In this article we will consider the phenomenon of grooming by the coach – the conscious and movement that induce the minor to engage in sexual contact. Within top sport, the opportunity for (sexually) transgressive behavior will be the determining factor. While grooming in recreational or recreational sport is often by isolating (vulnerable) children from the group, grooming can occur in top sport because of the intensity of the relationship, which is in any case of a more closed nature and can be strengthened by the strong performance-oriented top sport culture. In both cases, an alert, open environment is necessary to create a safe sports climate.

De ‘criminele sponsor’ van het lokale amateurvoetbal

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden georganiseerde misdaad, organisatiecriminaliteit, voetbal, witwassen, filantropie
Auteurs Professor Toine Spapens
SamenvattingAuteursinformatie

The social role of criminals in local communities has so far received relatively little systematic academic attention. This applies more specifically to their involvement in philanthropic activities. This paper describes and analyses the role of dubious sponsors particularly in Dutch amateur football. Although it is difficult to estimate the scope of the problem, results indicate that criminal sponsorship is not incidental. It mainly concerns corporate criminals, persons involved in drug crimes and outlaw motorcycle gangs. The main goal is to enhance their public image. In most cases, their involvement in crimes or regulatory offenses is difficult to assess without a doubt, which complicates preventative measures. Our analysis shows several interacting factors which increase clubs’ vulnerability to criminal infiltration: setting overambitious sportive goals; dependence on volunteers and a lack of formal integrity policies and internal compliance mechanisms; financial problems; and external pressures associated with the club’s role as the ‘pride’ of the city, the village or the neighbourhood.

The article pays attention to recent developments in the world of football and the shady business practices in relation to the transfer of football players. Moreover, the article addresses the self-image of football agents and raises the question whether they should take more responsibility themselves in containing fraud and money laundering in the world of football.

Opzichtige consumptie in Nederlandse rap

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2020
Trefwoorden opzichtige consumptie, hiphop, rap, straatcultuur, uitsluiting
Auteurs Robbert Goverts MSc en Dr. Robert Roks
SamenvattingAuteursinformatie

This article examines expressions of conspicuous consumption on 19 recent releases by the most popular Dutch rap artists of 2018. In line with Veblen’s (1899/2017) notion of conspicuous consumption, our content analysis of these rap lyrics shows that Dutch rappers ‘spend’ their money on all kinds of ostentatious and eye-catching luxury goods such as designer clothing and jewelry (‘drip’), cars or holidays, but also that rappers ‘stack’ some of the money they earn by putting it aside. Our results indicate that these expressions of conspicuous consumption seem to be rooted in, and fueled by, experiences with poverty, stigmatization, and discrimination.

Drugsgebruik, exces en criminaliteit

Een historisch perspectief

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2020
Trefwoorden history of drugs, tobacco, drug policy, civilizing process, opium
Auteurs Dr. Stephen Snelders
SamenvattingAuteursinformatie

This article discusses the problem of excessive drug use from a historical perspective. Cultural ambivalence towards excessive use of alcohol, tobacco, and drugs has roots going back into the seventeenth century. A case study is presented of the introduction and adaptation of tobacco in the Dutch republic. Dutch national and colonial drug regulation is discussed. It is concluded that regulations have been primarily motivated by anxieties about excessive behaviour among the labouring classes, endangering public order, and non-white users in the colonies. This has led to criminalization of excessive behaviour, and to the creation of a criminal underground economy.

Overexploitatie bezien vanuit een groen criminologisch perspectief

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2020
Trefwoorden defaunation, corona, wildlife trade, excess, ecological interaction
Auteurs Dr. Daan van Uhm
SamenvattingAuteursinformatie

The overexploitation of nature has led to anthropogenic defaunation, which results in complex socioeconomic, political and ecological consequences. Influenced by the economic growth of modernization and the interconnectedness of globalization, zoonotic diseases emerge as incalculable side effects of defaunation. By rejecting anthropocentric worldviews, this article critically examines anthropogenic defaunation and the causes and consequences of the coronavirus pandemic from a green criminological perspective.

De emotionele beleving van kwalitatief onderzoekers bij onderzoek naar kwetsbare groepen en gevoelige thema’s

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2019
Trefwoorden narrative review, qualitative research, emotions, sensitive topics, vulnerable groups
Auteurs Ciska Wittouck en Gwen Herkes
SamenvattingAuteursinformatie

A narrative review was conducted to develop more coherent awareness and knowledge regarding emotional experiences of qualitative researchers studying sensitive topics or vulnerable groups, as discussions about this topic are currently fragmented and scattered. Qualitative researchers experience many painful as well as enjoyable emotions, which can influence their personal, social and professional lives. These emotions are recurrently reported in relation to the unpredictability of qualitative research and the different roles of qualitative researchers. More structural and individual attention for emotional experiences of qualitative researchers is necessary, for instance, in academic (doctoral) training and general handbooks on qualitative research.
