This article contains a plea for a further operationalization of the subsidiarity principle (penal law and punishment as ultimum remedium) through a maximalist restorative justice, i.e. a restorative justice that not only offers space for ‘voluntary processes’ and agreed restoration, but also for ‘compulsory procedures’ and imposed restoration. An attempt is made to make the maximalist arsenal of restorative sanctions as concrete as possible. Two examples of sanctions that are ‘constructed’ in a restorative way in this article, are restorative community service and restorative electronic home detention. In this article, we report on our initial findings (from the field) regarding conflict resolution among the Maroons in Suriname. After first providing some background information about the Maroons (section 2), we describe their manner of conflict resolution after a crime has taken place and we explain what justice within this context entails for them (section 3). Subsequently, we try to distil ‘the useful elements’ from the Maroons’ approach to crime, that is to say elements with which modern restorative justice, i.e. restorative justice that meets, inter alia, human rights and constitutional requirements, can be nourished and strengthened. We also discuss some of the challenges we have encountered, where the traditional legal system and the modern criminal justice system come together (section 4). Then we try to build some possible bridges between the two legal systems (section 5). The contribution concludes with providing a window on the future of the development of restorative justice in Suriname and the Netherlands. |

This contribution seeks to bring together three themes in a descriptive and exploratory manner: (a) community service orders, (b) traffic offences and (c) restorative justice; the Dutch situation is central. To this end, the Dutch legal regulation regarding community service orders is first explained. Attention is also paid to existing empirical research on the effectiveness of community service orders in terms of reduction of recidivism (section 2). Furthermore, the sanctioning of traffic offences is discussed as well as the consequences for this of the current bill that seeks to sharpen criminal liability for serious traffic offences (section 3). Subsequently, it is examined which restorative justice provisions or modalities are available and how restorative community service orders are and can be designed (section 4). Finally, I describe my ideal when it comes to the sanctioning of traffic offences in the form of a continuum in which a special role is reserved for restorative community service orders (section 5). The contribution ends with a conclusion (section 6). |

The last years victim awareness has received special attention in the Dutch probation service. Three goals are central: respecting the rights and interests of the victim, mapping and increasing victim awareness of the probation client, and working towards the possibilities for recovery. Based on discussions with probation officers, this contribution sketches a picture of how this takes shape in practice. Experience shows that good results are achieved, but that more training and attention to the subject is needed to give it a full place in the probation work. |

This article presents and critically discusses a new Recommendation on restorative justice (CM/Rec(2018)8) that was adopted on 3 October 2018 by the Committee of Ministers of the Council of Europe. This new regulation builds on the previous Recommendation No. R(99)19 on mediation in penal matters and recommends the governments of the 47 member States of the Council of Europe the adopt and implement the principles of restorative justice as described in the Appendix of the new Recommendation. These guidelines apply to national authorities and national agencies in general, and to judges, public prosecutors, police, prisons, probation, juvenile justice agencies, victim support services and restorative justice services in particular. The article presents the origins of the Recommendation, its contents and its meaning for restorative justice developments in Europe and beyond. |

How does the police deal with conflict resolution and (referrals to) mediation? Is this perceived as relevant within the new national police organization? This article elaborates on work processes within the National Police, including ZSM-settlements, the punitive aspects of police culture and the impoverishment of neighborhood-oriented police work. It is concluded that there is little room within the police for responsive approaches to crime and social unsafety. However, there are still police professionals who question ‘assembly line’-processing of criminal cases, support restorative justice strategies and try to improve the citizen-empowerment in neighbourhoods. |

In a recent research study entitled Encountering ‘The Other’: Victim Offender Dialogue in Serious Crime the impact and outcomes for victims/survivors of meeting with the prisoner participants who had caused them harm were examined. In the vast majority of those cases, organised within the context of the Victim Offender Mediation Program (VOMP), forgiveness was offered by victims and received by offenders. This research, utilizing a qualitative multiple case study method, examined twenty-five randomly selected cases referred for victim/offender mediation over a 10-year period, in which victims/survivors, following a period of preparation, had participated in at least one day-long dialogue with their offenders facilitated by trained personnel. This article addresses only one of the research questions posited in this study, namely, the ways in which apology and forgiveness played a part in those dialogues and in the experience of the participants following their mutual encounters. It is argued that granting forgiveness can have great power in its effects when experienced by the participants. |

The apologies offered by young offenders in restorative justice conferences are often of poor quality. In this article the difficulties that accompany the offering of excuses are discussed. Offenders sometimes lack the language skills to pronounce an adequate apology, are anxious or insecure or believe that they have not been treated fairly. The mediation setting itself also has effects: sometimes perpetrators feel intimidated and feel compelled to say something that resembles an excuse. A related problem is that the perceptions about the sincerity of the apology can vary considerably. Over the last twenty years, research on desistance from crime and on restorative justice has grown rapidly and both have emerged as exciting, vibrant, and dynamic areas of contemporary criminological interest. While the implementation of restorative justice practices in Europe has been essentially victim-oriented, there has always also been an emphasis on including the moral and social rehabilitation of the offender. This more offender-centred approach to restorative justice and its practices is not limited to the evaluation of its ability to reduce crime, but is to be seen within the connection between reparation, resettlement (reintegration into the community after sentence), and desistance from crime. This article examines, from a broad perspective, but including some data from research on victim-offender mediation in prison, the capacity of restorative justice interventions to impact positively on offenders’ likelihood of stopping committing criminal offences. |

Through these results, we examine what victims think of restorative justice and why they choose (not) to participate. Restorative Justice is not evident in cases of intimate partner violence, but it can take and does take place under certain conditions. Wolthuis and Lünnemann explain about the European research they coordinated in six European countries (Austria, Denmark, Finland, Greece, the Netherlands and the UK) on context and practicalities of the use of victim-offender mediation in such complex cases. Cases dealing with violence of mainly men against women and where power imbalances often play a role. That means that mediators, referrers and others involved should know about this complexity and the needs of participants. Austria and Finland turned out to have the most experienced working methods. Their models, good practices and challenges are presented as well as the main outcomes of the research. Interviews and focus groups in the countries gave additional insights. It resulted in a guide with minimum standards addressing the different stages of a mediation process with extra attention for safety and empowerment. |

This article sketches an experiment initiated by a local mediation service in Flanders (BAL) with regard to the role of a supporting volunteer in the context of family group conferencing. Engaged as researchers in this experiment, the authors reconstruct the conceptual challenges of this project and the solution proposed by the team of mediators. One of these challenges revolves around finding an appropriative account of restorative justice that fits with the aims of the Belgian conferencing practice and clarifies the role of the supporting volunteer. Another comes down to distinguishing this role with the essential tasks of the moderator, and formulating deontological devices. In the last part of this contribution a few learning points are formulated with regard to the process and results of the experiment. One of these points is the need to rethink how successfully offering the possibility of engaging a supporting volunteer to the stake holding parties. |

Some ten years ago, victim-offender mediation was introduced for the first time in EU-legislation through article 10 of the 2001 framework decision on the standing of victims in criminal proceedings. In 2012 this framework decision was replaced by a more extensive directive establishing minimum standards for victims of crime. This article examines the position of restorative justice in this new legal instrument. The outcome is mixed. The emphasis on safeguards in case restorative justice is applied is a positive move towards good practices, but it is disappointing that a right to access restorative justice services was not adopted. |

The diversity of institutional contexts within which restorative justice has been implemented worldwide has raised the question whether this aspect may have an influence on the experience of victims of crime. Some are of the opinion that certain institutional settings (such as probation) could relegate victims, once more, to a secondary place. This article discusses the results of a two-year research project (2011-2012) that addresses this question. One single questionnaire was administrated in three different countries (Netherlands, Austria and Finland) whose mediation programmes differ in terms of the institutional setting in which mediation is implemented. Our findings suggest that the institutional context does not matter for victims’ levels of satisfaction, but it does in terms of victims’ expectations and experiences. |

Topical developments regarding the use of restorative justice in the Netherlands are discussed. Several initiatives have been taken, showing a genuine interest in the benefits of the use of restorative justice. However, there are underlying risks for a managerial use of restorative justice. Momentarily Dutch criminal justice policy features a shift towards settlement by the Public Prosecution, implying a use of restorative justice in the context of consensual settlement. However, there are no signs directing towards an intrinsic interest for the concept of restorative justice by the criminal justice authorities. Notwithstanding the legislator having started a fundamental revision of the Dutch Code of Penal Procedure, there are no intentions known to acknowledge restorative justice arrangements to be part of the regular penal procedures and sanctions. Nevertheless, incorporating the use of restorative justice arrangements requires a systematic implementation of restorative justice arrangements. |

This article provides information about the results of the experimental project the Courthouse of Amsterdam undertook in 2010-2011 concerning court-connected penal mediation. In The Netherlands, the majority of the restorative projects that have been undertaken, have not been connected to the penal process. The authors describe the positive results, concerning both victims and offenders, the experiences of the lawyers, public prosecutors and judges involved. Various recommendations are made to improve implementation of a court-connected system of penal mediation in The Netherlands. |
