    Since the beginning of 2020 mediation in penal cases (mediation in strafzaken) has officially become the preferred intervention for victim-offender mediation in the criminal procedure in the Netherlands. Although mediation in general has a sound theoretical framework, the methodological elaboration appears pluriform and somewhat limited. In practice mediators in penal cases operate conform their own personal and professional standards and preferences, apparently without tailor made methodology. This article describes the current methodological directions such as transformative or narrative mediation and seeks for useful references. As a part of restorative practice, mediation in penal cases seems to remain secluded from insights and methodology developed in the domain of restorative justice practices. Educational institutes providing trainings for mediators barely refer to this theoretical framework. Besides a methodological reconnaissance this article offers a fundamental comparison of mediation styles and interventions, but is above all an incentive to further methodological research and development.

    The 20th anniversary of this journal is a good reason to glance back at developments with restorative justice for children and young people. Can we say that restorative youth justice has become mature? Some core events and articles about developments in Belgium, the Netherlands and elsewhere are discussed, paying attention to young suspects as well as victims. Subsequently, the embedding of restorative justice in youth laws is discussed. Finally, the article focuses on the question what should be done to improve the implementation into an effective, child friendly and ‘rights based’ youth sanction model.

    In this article, we report on our initial findings (from the field) regarding conflict resolution among the Maroons in Suriname. After first providing some background information about the Maroons (section 2), we describe their manner of conflict resolution after a crime has taken place and we explain what justice within this context entails for them (section 3). Subsequently, we try to distil ‘the useful elements’ from the Maroons’ approach to crime, that is to say elements with which modern restorative justice, i.e. restorative justice that meets, inter alia, human rights and constitutional requirements, can be nourished and strengthened. We also discuss some of the challenges we have encountered, where the traditional legal system and the modern criminal justice system come together (section 4). Then we try to build some possible bridges between the two legal systems (section 5). The contribution concludes with providing a window on the future of the development of restorative justice in Suriname and the Netherlands.

Access_open ‘Radicalisering’ en herstelrecht: bevindingen van het Belgische CONRAD-project

    In this article, some of the findings of a practice and policy oriented research project on ‘radicalisation’ are discussed. The research was carried out in a partnership between three Belgian universities and two field organisations during the years 2017-2019. The project aimed at a ‘Constructive analysis on the attitudes, policies and programmes that relate to “radicalisation”’ (CONRAD). Restorative justice offered the initial framework to design and to set up the project. This article offers some findings and reflections on the opportunities (and the limits) that were found in the project with respect to the relevance of restorative justice. This part of the research was done on the basis of a frame-analysis on the one hand, and field work on the other. The article first presents the restorative justice assumptions that formed the backbone of the project. Then, the method of ‘inductive frame-analysis’ is presented as this was applied to a sample of media and policy documents that reported about ‘radicalisation’ and ‘de-radicalisation’ related issues in Belgium. This resulted in the identification of four frames and eight counterframes. The field work in the form of ‘participatory action research’ with young persons and their organisations in the cities of Brussels and Verviers is then discussed, revealing a complex situation of social tensions. It is argued then that the use of frames and counterframes can help those involved in, or concerned about, social problems to look at these issues from another perspective, through another lens. Based on the method of photo-elicitation, cartoons related to frames and counterframes were designed in the project as a tool to facilitate talking about ‘radicalisation’ from different perspectives. The article ends with reflections on the relevance of restorative justice in dealing with ‘radicalisation’ and violent extremism. A broad relational and participatory approach to respond to these ‘phenomena’ at societal level is proposed.

    Compared to victims, relatively little is known about the role of offenders’ emotions, needs and intentions in their (voluntary) decision to participate in victim-offender mediation (VOM). Insight into this decision process among offenders is important, as it may explain (part of) the positive outcomes participation in VOM can have for them, as well as for victims. Based on the work of Shnabel and Nadler (2008; 2015), we predicted that the need to restore their moral image is an important, underlying explanation for why offenders participate in VOM. To test this, we sampled 91 victim-offender mediation cases from the Dutch mediation agency Perpectief Herstelbemiddeling based on pre-defined characteristics. We approached the mediators who handled these cases and asked them to indicate the emotions, need to restore the moral image and intentions of the offenders in these cases. Consequently, we examined how these variables predicted offenders’ actual willingness to participate (or not) in these cases. Results indicated that the need to restore the moral image is indeed an important underlying factor in offenders’ decision to participate in VOM: according to mediators’ answers, offenders who felt more remorse about their crime, felt a stronger need to restore their moral image, which in turn predicted a stronger intention to apologize and help the victim. This intention to apologize and help emerged as the strongest, direct predictor of offenders’ willingness to participate. The relevance of Shnabel and Nadler’s needs-based model of reconciliation for VOM is discussed as well as important future research questions that remain.

    The last years victim awareness has received special attention in the Dutch probation service. Three goals are central: respecting the rights and interests of the victim, mapping and increasing victim awareness of the probation client, and working towards the possibilities for recovery. Based on discussions with probation officers, this contribution sketches a picture of how this takes shape in practice. Experience shows that good results are achieved, but that more training and attention to the subject is needed to give it a full place in the probation work.

    This article is based on research into the use of mediation in criminal cases at ZSM Midden-Nederland. It focusses on the question how referrals to mediation can be optimized. The research shows that there is much room for improvement and a broader deployment of mediation. Lack of knowledge of the criminal justice partners involved, leads to misconceptions about the mediation process, about which institution should be deployed, and about the (in)suitability of cases for mediation. This lack of knowledge seems to be greatest among the police, while they play an important role within ZSM. Moreover, Victim Support Netherlands has a dominant role in the choice whether or not to refer to mediation. The overall conclusion is that mediation is not yet sufficiently anchored in the criminal justice partners’ system.

    How does the police deal with conflict resolution and (referrals to) mediation? Is this perceived as relevant within the new national police organization? This article elaborates on work processes within the National Police, including ZSM-settlements, the punitive aspects of police culture and the impoverishment of neighborhood-oriented police work. It is concluded that there is little room within the police for responsive approaches to crime and social unsafety. However, there are still police professionals who question ‘assembly line’-processing of criminal cases, support restorative justice strategies and try to improve the citizen-empowerment in neighbourhoods.

    In this article the author discusses the book Anger and Forgiveness written by the well-known and influential American philosopher Martha Nussbaum. In the opinion of the author Anger and Forgiveness is a provocative and challenging book. In the book, Nussbaum makes a distinction between conditional and unconditional forgiveness, she relates conditional forgiveness to the logic of retribution and she disapproves retribution and, by extension, conditional forgiveness on moral grounds. Her disapproval of retribution and conditional forgiveness is related to her disapproval of (vindictive) anger, which in her opinion is intrinsic part of retribution and conditional forgiveness. According to Nussbaum, anger – transitional anger excluded – has to be replaced by unconditional love; only conduct that stems from unconditional love can be qualified as moral. Sometimes unconditional forgiveness can be seen as a form of unconditional love. Subsequently, Nussbaum applies her ideas on anger, retribution, forgiveness and love to the political domain, to which also criminal law belongs. Nussbaum pleads for a criminal law system empty of anger and retribution; in Nussbaum’s criminal law system there is only room for prevention, grace and human welfare – all stemming of unconditional love. Nussbaum’s Anger and Forgiveness offers an alternative view on concepts such as anger, retribution, forgiveness and love, concepts which are important within the context of criminal law and restorative justice. The author argues that, although the reader can certainly learn from Nussbaum’s ideas as explained in Anger and Forgiveness, the radicality of her ideas inevitably causes criticism; Nussbaum holds a very idealistic perspective that neglects the human condition. Instead of ruling out anger and retribution, the author advocates a criminal law system that is capable of canalizing anger and transforming vindictive anger into transitional anger. Furthermore, he pleads for a criminal law system that makes forgiveness possible without forcing victims to forgive. For that reason restorative justice practices need to be incorporated into the criminal law system. In sum, to a certain extent Nussbaum and Claessen share the same moral ideals, but they disagree on the path leading tot those ideals. Where Nussbaum opts for a top-down approach, Claessen opts for a bottom-up approach which respects the human condition.

    The article provides a description of the issues and considerrations facing Flemish victim-offender mediators on the job. Instead of focusing on professinal risks and caveats present within victim-offender mediation, the authors concentrate on the positive concept of ‘enabling high quality mediations’. A description is given of the frames that are felt to be helpful towards mediators, stressing the need to act with due creativity if needed. Moreover, in order to enable high quality victim-offender mediations, conditions need to be met, more specifically a common acknowledgment of the need for teamwork. The latter implies conditions such a sound legal basis, a deontological code, formal procedures and constant interaction with practice.

    Penal mediation is currently gaining ground within the Dutch criminal law system. The practice of penal mediation is still young, however, and therefore vulnerable. Common criminal practice as well as legislation are not yet thoroughly compatible with practicing penal mediation. The authors of this contribution explore some of the dangers mediators in penal cases face while drafting party-agreements that are to be taken into consideration by the judicial authorities.
    The article identifies the responsibilities of penal mediators who at the same time serve the interests of victims and offenders as well as take into account expectations judicial authorities might have. The responsibility of penal mediators is especially delicate whenever mediation parties seek to influence the outcome of the criminal lawsuit through mediation. Criminal law is a highly-regulated field, which – albeit unconsciously – seduces the mediator his- or herself to lose track of the main restorative goals of the mediation process. The authors point out some of the traps penal mediators can and should avoid. The article for instance elaborates the inadequacy of current Dutch regulations to arrange financial compensations and damages through penal mediation. Also, the article enumerates examples of over-juridification as well as the lacking of it. Furthermore, avoidable pitfalls such as McDonald-icing of penal mediation, the uselessness of so-called sunny-weather-vouchers, the dangers of copy-paste-agreements and – the worst – putting the height of their own – currently fixed – fees above party interests, are being addressed.

    The apologies offered by young offenders in restorative justice conferences are often of poor quality. In this article the difficulties that accompany the offering of excuses are discussed. Offenders sometimes lack the language skills to pronounce an adequate apology, are anxious or insecure or believe that they have not been treated fairly. The mediation setting itself also has effects: sometimes perpetrators feel intimidated and feel compelled to say something that resembles an excuse. A related problem is that the perceptions about the sincerity of the apology can vary considerably. This perception-mismatch also occurs among victims: what one victim considers sincere is ‘fake’ for another. Many people
    – also advocates of restorative justice – trust that the offender will offer a sincere apology, without realizing that this is not self-evident in a thorny confrontation setting. This article aims to temper this sincerity-expectation.

    This article presents some of the results of a study in which 25 adult men were interviewed who took part in restorative mediation in the French speaking part of Belgium and were desisting from crime. Their narratives were used to find out whether participation in restorative justice influenced positively their journey towards desistance; if so, which factors in restorative mediation supported this change process and how these factors had been helpful. The results suggest that restorative mediation has the potential to contribute to desistance in a humble, but significant way. Core aspects of mediation supported mostly already started desistance processes and they were helpful in a mainly cognitive way. The authors propose to further investigate the specific and helpful ‘presence’ of mediators and to reflect upon the apparent absence in restorative mediation of practical follow-up support towards desistance.

    The rationale behind refugee law is that people who fear persecution in their home country can seek and find a safe haven in another country. The situation in Eritrea with its national service and wide-spread human rights violations is reason why many Eritreans flee their country. A vast number of them want to apply for asylum in European countries. After a risky journey over the African continent where they face risks of kidnappings, trafficking for ransom, and situations of inhuman and degrading treatment, they reach Europe. Some of them continue their journey to the Netherlands. The central question in this article is whether or not their safety and well-being are at stake once they arrive in the Netherlands. Situations of involvement of and intimidation by the Eritrean regime in the Netherlands, diaspora tax that is forcibly collected, involvement of the Orthodox Church and indications of human trafficking have been reported in media and reports, by individuals and organisations. In this article the outcomes of a research on the concerns about the well-being of Eritrean asylum seekers in reception centres among employers of organisations responsible for their safety and well-being are presented and discussed. Data were collected and discussed during four focus group meetings with a total of 33 professionals. The concerns are divided in three groups: 1) Concerns about the capacities and possibilities to integrate in Dutch society, 2) Concerns about religion and rituals, and 3) Concerns about indications of human trafficking. These concerns are further elaborated based on which the conclusion is drawn that more tailored support and assistance is required for successful integration of Eritreans in Dutch society, their empowerment and resilience against threats and challenges in Dutch society.

    The current vignette experiment among 414 students in the Netherlands explores the effect of the police response on willingness to cooperate and examines whether this relationship is mediated by perceptions of the legitimacy of the police. This is done based on Tyler’s procedural justice theory and previous research among crime victims. The police response in the vignette was manipulated in two ways: the police offered a fair/unfair treatment and had/had not performed investigative actions. There was no police contact in a control group. The results suggest a positive effect of the police response on willingness to cooperate and imply that this relationship is mediated by perceived trust in the police.

    This article reports on a conceptual model that provides insight into the relationship between Twitter use by community policing officers and citizens’ safety perceptions. The model has been tested using data from a relatively large-scale survey study and these results are supporting the model. Furthermore, a small impact of Twitter use has been found on feelings of safety and judgments about the police. To confirm these findings, further research on a larger scale is necessary. To find out more about the exact positive and negative effects of Twitter use by community policing officers, a more experimental design is required.

    Restorative Justice is not evident in cases of intimate partner violence, but it can take and does take place under certain conditions. Wolthuis and Lünnemann explain about the European research they coordinated in six European countries (Austria, Denmark, Finland, Greece, the Netherlands and the UK) on context and practicalities of the use of victim-offender mediation in such complex cases. Cases dealing with violence of mainly men against women and where power imbalances often play a role. That means that mediators, referrers and others involved should know about this complexity and the needs of participants. Austria and Finland turned out to have the most experienced working methods. Their models, good practices and challenges are presented as well as the main outcomes of the research. Interviews and focus groups in the countries gave additional insights. It resulted in a guide with minimum standards addressing the different stages of a mediation process with extra attention for safety and empowerment.

    The authors focus on the restorative justice policies of the city of Utrecht. The Utrecht Mediation Model is a framework in which so called Peaceful Schools and Peaceful Community organisations work together with inhabitants, youth, police officers, public prosecutors and mediators (both voluntary mediators and professional registered mediators). The authors discuss some of the benefits of this large-scale collaboration in Utrecht-neighbourhoods. The added value of the Model is especially felt in so-called Large and Xtra-Large community conflicts. The mediators work together with police officers in order to realise peaceful solutions, while safeguarding the autonomy and independence that both professions require. The authors also discuss some of the competences of the professionals involved. Finally they address the financial revenues of the Model; public spending is relocated from repressive to restorative strategies.

    The mediator in criminal cases operates in special setting which requires specific competences: knowledge of the field of criminal law, knowledge of psychiatric/psychological problems and – if necessary – be able to consult a network of experts in that field, being prepared to operate in complex offender-victim relations and also to deal with high-escalated conflicts. These requirements raise a number of questions regarding the rules of the Dutch mediation federation, which are not designed to be used in the context of criminal law. Mediators in criminal cases are in need of other rules and pre-conditions to fulfil their work adequately.

Jacques Claessen
Jacques Claessen is als universitair docent straf(proces)recht verbonden aan de vakgroep Strafrecht & Criminologie, Faculteit der Rechtsgeleerdheid, Universiteit Maastricht. In 2010 verscheen zijn dissertatie Misdaad en straf. Een herbezinning op het strafrecht vanuit mystiek perspectief. Zijn interessegebieden zijn sanctierecht, herstelrecht en de strafrechtelijke positie van het slachtoffer. Claessen is redacteur van de Nieuwsbrief Strafrecht en het Tijdschrift voor Herstelrecht. Voorts is hij rechter-plaatsvervanger bij de Rechtbank Limburg. Hij is winnaar van de Bianchi Herstelrechtprijs 2012.

Gert Jan Slump
Gert Jan Slump is criminoloog, sociaal-maatschappelijk ondernemer en consultant, adviseur en trainer. In 2010 was hij medeoprichter van de Stichting Restorative Justice Nederland en sindsdien ontwikkelt hij samen met organisaties en professionals binnen het netwerk rond herstelrecht en herstelgericht werken in Nederland allerlei projecten op dit terrein. Hij is ook actief op het terrein van professionaliseringsvraagstukken, onder meer binnen de jeugdzorg.
