    In this contribution, the authors take stock of the many diverse restorative justice programs that have been implemented in many countries, worldwide, over the past twenty years, and that have involved a number of problems. They also discuss a number of new developments and areas of concern, including victim participation, the relationship with common law, cases of serious crime and the role of the community. The authors hope the new UNODC Handbook on Restorative Justice Programmes to be as successful as the previous edition in promoting new ways to apply restorative justice principles in criminal matters and helping practitioners benefit from each other’s experience.

    This article contains a plea for a further operationalization of the subsidiarity principle (penal law and punishment as ultimum remedium) through a maximalist restorative justice, i.e. a restorative justice that not only offers space for ‘voluntary processes’ and agreed restoration, but also for ‘compulsory procedures’ and imposed restoration. An attempt is made to make the maximalist arsenal of restorative sanctions as concrete as possible. Two examples of sanctions that are ‘constructed’ in a restorative way in this article, are restorative community service and restorative electronic home detention. This article is based on work by John Blad and Lode Walgrave that has previously appeared in Tijdschrift voor Herstelrecht.

    The 20th anniversary of this journal is a good reason to glance back at developments with restorative justice for children and young people. Can we say that restorative youth justice has become mature? Some core events and articles about developments in Belgium, the Netherlands and elsewhere are discussed, paying attention to young suspects as well as victims. Subsequently, the embedding of restorative justice in youth laws is discussed. Finally, the article focuses on the question what should be done to improve the implementation into an effective, child friendly and ‘rights based’ youth sanction model.

    In this article, we report on our initial findings (from the field) regarding conflict resolution among the Maroons in Suriname. After first providing some background information about the Maroons (section 2), we describe their manner of conflict resolution after a crime has taken place and we explain what justice within this context entails for them (section 3). Subsequently, we try to distil ‘the useful elements’ from the Maroons’ approach to crime, that is to say elements with which modern restorative justice, i.e. restorative justice that meets, inter alia, human rights and constitutional requirements, can be nourished and strengthened. We also discuss some of the challenges we have encountered, where the traditional legal system and the modern criminal justice system come together (section 4). Then we try to build some possible bridges between the two legal systems (section 5). The contribution concludes with providing a window on the future of the development of restorative justice in Suriname and the Netherlands.

    This article outlines two points of criticism related to Christopher Marshall’s discussion of a relational justice of care. First, addressing the needs of the parties involved in a criminal justice case finds its appropriate place in the post-trial stage. In the pre-trial and trial stages, protecting the legal rights and equal treatment of suspects should take priority over caring for suspects. Secondly, if the outcome of the restorative encounter in the pre-trial stages has a bearing on the verdict of the judge, the encounter may risk to lose its authenticity. The offender may have reason to believe that a socially appropriate performance will be rewarded with less punishment.

    This contribution seeks to bring together three themes in a descriptive and exploratory manner: (a) community service orders, (b) traffic offences and (c) restorative justice; the Dutch situation is central. To this end, the Dutch legal regulation regarding community service orders is first explained. Attention is also paid to existing empirical research on the effectiveness of community service orders in terms of reduction of recidivism (section 2). Furthermore, the sanctioning of traffic offences is discussed as well as the consequences for this of the current bill that seeks to sharpen criminal liability for serious traffic offences (section 3). Subsequently, it is examined which restorative justice provisions or modalities are available and how restorative community service orders are and can be designed (section 4). Finally, I describe my ideal when it comes to the sanctioning of traffic offences in the form of a continuum in which a special role is reserved for restorative community service orders (section 5). The contribution ends with a conclusion (section 6).

    In the past twenty-five years, a lot of attention is paid to a more victim-aware and restorative justice focused policy in prisons in Belgium and The Netherlands, striving for a restorative culture and climate in the institutions (among prisoners and staff) and for more restorative practices like victim-awareness programs and mediation. The focus is primarily on the prison structure and culture, striving to create a more restorative prison culture and climate in the institutions. In this article we argue for a shift from this system-focused pursuit of ‘estorative detention’ to the restorative reintegration of prisoners at the individual level, and by this supporting their desistance from crime. We present a conceptual framework for restorative reintegration in and outside prison as a strengths-based approach, with attention to the structural and individual elements that supports their desistance from crime.

    In this article the development of a restorative justice probation practice is discussed from the perspective of the restorative justice principle of the inclusive community and the contribution of probation volunteers to the reintegration of (ex-)offenders through specific restorative justice intervention strategies. It is shown that in penal policy of the past decades the penal welfare-model and the aim of reintegration of ex-offenders has been overshadowed by a more utilitarian, punitive and management logic of criminal justice. As a result, the reintegration and social inclusion of ex-offenders has become a rather neglected area and, in the current liberal-democratic state, offenders face social conditions in which it is very hard to turn their life around. In addition it is suggested that both in mainstream and in restorative justice interventions, achievement of the goal of reintegration is often problematic or absent. Moreover, this lack of opportunities for connection may undermine and reduce the effects of interventions, including those with a restorative justice approach. Probation services that use specific restorative justice intervention strategies guided by both professionals and probation volunteers might contribute to a more active, inclusive role of the community and society in the reintegration of ex-offenders.

    The last years victim awareness has received special attention in the Dutch probation service. Three goals are central: respecting the rights and interests of the victim, mapping and increasing victim awareness of the probation client, and working towards the possibilities for recovery. Based on discussions with probation officers, this contribution sketches a picture of how this takes shape in practice. Experience shows that good results are achieved, but that more training and attention to the subject is needed to give it a full place in the probation work.

    This article presents some of the results of a study in which 25 adult men were interviewed who took part in restorative mediation in the French speaking part of Belgium and were desisting from crime. Their narratives were used to find out whether participation in restorative justice influenced positively their journey towards desistance; if so, which factors in restorative mediation supported this change process and how these factors had been helpful. The results suggest that restorative mediation has the potential to contribute to desistance in a humble, but significant way. Core aspects of mediation supported mostly already started desistance processes and they were helpful in a mainly cognitive way. The authors propose to further investigate the specific and helpful ‘presence’ of mediators and to reflect upon the apparent absence in restorative mediation of practical follow-up support towards desistance.

    In this contribution, the justification of restorative practices in prison is first discussed from a normative perspective. On the basis of Lippke’s retributive theory of imprisonment it is argued that modern, humane retributive sanctioning entails an obligation to provide prisoners with opportunities to engage in restorative practices. Second, restorative practices in prison are examined from the perspective of possible impacts on the empowerment of prisoners and their experience to move away from crime and do good. Finally, it is argued that in order to yield positive effects, restorative practices in prison need to be supported by a safe and healthy living environment.

    The Dutch Custodial Institutions Agency (DJI) strives for a more restorative prison culture in the Netherlands, incorporating a more victim-oriented and restorative way of working in prisons. To this end, DJI has asked for a plan and process evaluation of three restorative courses among (juvenile and adult) prisoners in the Netherlands: Puinruimen, SOS and DAPPER. This article first offers an overview of the most important findings of this evaluation which was finalized in 2016. Based on the findings of the plan evaluation, a cautious yet clearly positive picture emerges of the design and substantiation of each of the three courses examined. That is, an extensive description and substantiation exists of each course. In addition, evidence exists in the (limited) scientific literature for one of the goals that each of these courses have formulated: to increase prisoners’ awareness of the consequences of crime for victims. The literature also suggests that creating trust among participants and a safe group process during the course is helpful in attaining the goals formulated. The process evaluation of the execution of the three courses in practice further strengthens the cautious, yet positive picture painted by the plan evaluation. An examination of the experiences of the courses’ participants lends further support to the observation that these courses can attain part of their goals. For example, after the course participants were more positive about the added value of victim-offender mediation for them personally than before.
    Aside from these findings, this article also argues for a deeper consideration of the constructive roles that both emotions guilt and shame can play in the restorative process of prisoners during these courses. The article ends with a number of recommendations for restorative courses in prison and a sketch of the current state of affairs in the Netherlands regarding these courses.

    Some believe that the credibility of restorative justice can be increased if more attention is given to the quality of the mediator, as well as methods to select people with the right profile or by training. At first glance this seems a legitimate aim: mediation services should offer quality. Reflecting on practical experience and research into mediation between offenders and victims in Flanders, the author problematizes these assumptions. The quest for tangible quality to ensure ‘credibility’ refers to a neo-liberal approach aimed at reducing risks and promoting the client’s satisfaction. In this article the author confronts the apolitical approach of client satisfaction with alternative ideas about (restorative) justice. Ideally, the mediator is critical of established (legal) authorities and professional expertise. Mediation is political in nature, even if the mediator relies on neutrality. The mediator must be aware of his – inevitable – political stance and should be ready to be interrogated on this matter.

    Based on a literature research and program evaluation of the practice of Victim in Focus (Slachtoffer in Beeld) in 2013, two issues are addressed: What are the possible effects of victim offender mediation? Which active mechanisms will cause or contribute to these effects? The authors describe the current context and developments in The Netherlands concerning restorative justice and then describe the effects and possible active mechanisms such as satisfaction, diminishing fear, anger and shame, information and consent, procedural justice, reduction of recidivism, compliance. In a synthesis of active mechanisms they present four domains or mediating factors: from incomprehension to comprehension (cognitive restoration); from unease to ease (emotional restoration); from injustice to justice (moral restoration); from powerless to powerful feelings (restoration of control). The victim offender mediation as a ritual has an impact or is supposed to have an impact on these four domains for both victims and offenders. Within the four domains four activities or interactions within victim offender mediation are presented: creating understanding through inter-subjectivity; expression of fear, trauma and shame; doing justice by excuses/apologies and restorative actions; regaining self control. Further research is needed to validate the model and to get more insight in essential or primary and secondary aspects in the explanation of the impacts of victim offender mediation.

    This article provides data about qualitative and quantitative research that was executed in juvenile detention centres in The Netherlands in the framework of the EU-funded Restorative Justice in Europe project. The results of a survey amongst 75 staff members are presented. Special attention is paid to the restorative handling of internal conflicts and crimes within the detention centre. Restorative Justice Nederland, executing this research, also developed a self-assessment tool for prisons, the Organisational Maturity Grid Restorative Practices, that can be used to assess how ‘mature’ restorative practices are within an organisation. Based on this maturity grid and the data of the research advice is provided on how restorative practices within juvenile detention centres can be brought to the next level.

    This article presents the backgrounds of a particular restorative practice in Flanders: the Restitution Fund. This fund is meant to give a symbolic instrument into the hands of persons in custody, to send a message to the victim: they will do volunteer work in society (mostly: charity work). Victim offender mediation starts up and at the end of the project the victim will receive an amount of money. Although this project is an excellent example of a restorative justice practice, there is still a long way to go to get it embedded in a longer term policy framework.

Prevalentie van ernstige misdrijven bij slachtoffer-daderbemiddeling

    A debate exists in the literature about the question whether (different forms of) mediated contact between victims and offenders occur and are appropriate only after minor offenses. This contribution therefore examines whether a relationship exists between the seriousness of offenses and the degree to which in practice cases result in mediated contact, in the Dutch context. More specifically, we report the first findings of a study aimed to (a) examine the seriousness of cases that were registered at the foundation Slachtoffer in Beeld (Victim in Focus; responsible for the execution of mediated contacts between victims and offenders in the Netherlands), and (b) compare the seriousness of cases at this foundation that resulted in different forms of mediated contact (including cases in which no contact emerged). To this end, we sampled 200 cases from the data system of Victim in Focus in a random manner; consequently, the seriousness of each of these cases was coded. The mean duration of incarceration sentenced for specific offenses in the Netherlands was used as an (as objective as possible) indication of the seriousness of the offenses in these cases. The results indicated that the cases registered at Victim in Focus do not consist exclusively of minor offenses. A substantial part consists of more serious offenses, especially when this is compared to the prevalence of all (minor and serious) offenses in the Netherlands. In addition, we observed no relationship between the seriousness of cases and the form of mediated contact (or no contact) that emerged at Victim in Focus; mediated contact arose to the same degree for serious compared to minor offenses. The implications of these results for the debate mentioned above are discussed, taking into account the manner in which victim-offender mediation is organized in the Netherlands.

Wendy Schreurs is afgestudeerd aan de vakgroep Psychologie van Conflict, Risico en Veiligheid aan de Universiteit Twente, op onderzoek naar de ontwikkeling van een ernstmonitor in de context van slachtoffer-daderbemiddeling. Ze werkt nu als PhD student op een project over de inzet van burgers bij politiewerk en interventies om die inzet te verbeteren.

Sven Zebel
Sven Zebel is universitair docent aan de vakgroep Psychologie van Conflict, Risico en Veiligheid van de Universiteit Twente. Hij houdt zich bezig met de psychologische reacties op wangedrag, conflicten en misdrijven, en de impact van interventies die trachten te herstellen en de kans op recidive te verkleinen (e.g. bemiddeling, reclasseringstoezicht, toekomstverbeelding).

Elze Ufkes
Elze Ufkes is universitair docent aan de vakgroep Psychologie van Conflict, Risico en Veiligheid aan de Universiteit Twente. Hij richt zich in zijn onderzoek op hoe groepsprocessen zoals groepslidmaatschap en stereotypering conflictgedrag van mensen beïnvloedt.
