    In a recent research study entitled Encountering ‘The Other’: Victim Offender Dialogue in Serious Crime the impact and outcomes for victims/survivors of meeting with the prisoner participants who had caused them harm were examined. In the vast majority of those cases, organised within the context of the Victim Offender Mediation Program (VOMP), forgiveness was offered by victims and received by offenders. This research, utilizing a qualitative multiple case study method, examined twenty-five randomly selected cases referred for victim/offender mediation over a 10-year period, in which victims/survivors, following a period of preparation, had participated in at least one day-long dialogue with their offenders facilitated by trained personnel. This article addresses only one of the research questions posited in this study, namely, the ways in which apology and forgiveness played a part in those dialogues and in the experience of the participants following their mutual encounters. It is argued that granting forgiveness can have great power in its effects when experienced by the participants.

    This article discusses the willingness of the victim to judge the offender more mildly after the latter apologized for his wrongdoing and shows that he is involved in behavioral change. A large group of victims wants to help (young) perpetrators and offer them a second chance, even victims who have been treated violently. It is argued that these forms of compassion express a caring attitude, the wish that the offender will be rehabilitated and that a change in behaviour is more important than compensation. This attitude can also be referred to as ‘forbearance’, in terms that a less severe sanction is sufficient. This goodwill factor may well be the most important aspect of ‘doing justice’ in restorative meetings.

    In this article the author discusses the book Anger and Forgiveness written by the well-known and influential American philosopher Martha Nussbaum. In the opinion of the author Anger and Forgiveness is a provocative and challenging book. In the book, Nussbaum makes a distinction between conditional and unconditional forgiveness, she relates conditional forgiveness to the logic of retribution and she disapproves retribution and, by extension, conditional forgiveness on moral grounds. Her disapproval of retribution and conditional forgiveness is related to her disapproval of (vindictive) anger, which in her opinion is intrinsic part of retribution and conditional forgiveness. According to Nussbaum, anger – transitional anger excluded – has to be replaced by unconditional love; only conduct that stems from unconditional love can be qualified as moral. Sometimes unconditional forgiveness can be seen as a form of unconditional love. Subsequently, Nussbaum applies her ideas on anger, retribution, forgiveness and love to the political domain, to which also criminal law belongs. Nussbaum pleads for a criminal law system empty of anger and retribution; in Nussbaum’s criminal law system there is only room for prevention, grace and human welfare – all stemming of unconditional love. Nussbaum’s Anger and Forgiveness offers an alternative view on concepts such as anger, retribution, forgiveness and love, concepts which are important within the context of criminal law and restorative justice. The author argues that, although the reader can certainly learn from Nussbaum’s ideas as explained in Anger and Forgiveness, the radicality of her ideas inevitably causes criticism; Nussbaum holds a very idealistic perspective that neglects the human condition. Instead of ruling out anger and retribution, the author advocates a criminal law system that is capable of canalizing anger and transforming vindictive anger into transitional anger. Furthermore, he pleads for a criminal law system that makes forgiveness possible without forcing victims to forgive. For that reason restorative justice practices need to be incorporated into the criminal law system. In sum, to a certain extent Nussbaum and Claessen share the same moral ideals, but they disagree on the path leading tot those ideals. Where Nussbaum opts for a top-down approach, Claessen opts for a bottom-up approach which respects the human condition.

    Intimate partner homicide (IPH) constitutes one of the most prevalent types of homicide. This study aims to assess the nature and prevalence of intimate partner homicide in the Netherlands in the period 2009-2014. In doing so, we make use of police data, court data, and media articles. Findings show that IPH occurs 29 times per year, resulting in a victimization rate of 0.20 per 100,000, similar to other Western-European countries. Our results further show a decline in IPH in the last years. IPH in the Netherlands mostly occurs in heterosexual relationships, and involves male perpetrators and female victims. Finally, we reflect on possible causes for the decline of this type of homicide.

    National thematic projects and local authorities aim to improve shelter and transport facilities for mentally disordered non-offenders. A pilot project in the south-western part of the Netherlands investigated the efficiency of psychiatric expertise in the triage process of the police emergency control room.
    To evaluate incoming emergency telephone calls in terms of the type of mentally disordered behavior, the sort and degree of dangerousness, and the urgency and type of response required.
    Between November 2016 and January 2017 social psychiatric nurses did weekend shifts on the emergency control room. Incoming telephone calls concerning public nuisance or disordered behavior were administered using the triage tool developed by the Dutch Association of Mental Health and Addiction Care. Nurses had access to regional information systems and were explicitly allowed to follow up on cases where continuity of care was an issue.
    A total of 155 calls were evaluated producing a representative image of calls concerning mentally disordered behaviour. Results show that this type of emergency calls is not overly frequent, in many cases not extremely urgent (response time target >1 hour: 67%), and about 65% could be followed up by the general practice centre or specialised (psychiatric) healthcare services. More than half (55%) of the emergency calls involved people previously in contact with psychiatric services. Most common types of danger were public disorder (28%) and suicide risk (21%). However, in 29% of cases type of danger was unclear and 14-20% of the triage tool was inconclusive.
    Triage by mental health specialists at the police emergency control room is not efficient because many cases are not very urgent and information quality is often too low to preclude street-triage. Yet screening and follow up of mentally disturbed persons can be improved by close collaboration between control room and psychiatric services.

    The operational leader, the ‘gold commander’, fulfils a crucial function in crisis- and disaster management in the Netherlands. He is held responsible for the total coordination of all collaborating emergency services and supports/advises the Mayor, the Commander in Chief. Unfortunately, this function has never been very effective in practise, as shown by many evaluations. From a scientific point of view, it is easy to understand why the operational leader cannot be effective in the Dutch crisis management organisation. The operational leader has no authorities and has been seated in an emergency operation centre far from the Mayor. This article examines why this issue has not been solved, despite 30 years of studying and adjusting the Dutch crisis management organisation.

    Bill Cosby, Jimmy Savile and Gerrit Achterberg lived in different periods, in the US, UK, and the Netherlands. They were heroes because of what they accomplished during their professional careers but all three turned out to have committed serious crimes. Disclosure is painful, not only for the hero who comes to fall but also for the community that finds itself redefining moral standards when losing a celebrated insider. For this reason, the crimes of these three men have been concealed and kept secret for years. In comparing the three cases, this article tries to find out who decides on keeping the hero on his feet, how this is done, and if this changes over time.

    In the introductory article of this special issue on the downfall of popular heroes, some relevant aspects in relation to the general theme are explored. Who are considered to be heroes and which elements are relevant to understand the process heroes may go through when they start sliding on the slippery slope, and, eventually, fall into the abyss of disgrace? What is the role that (social) media play in the demolition of their reputation and how do heroes perceive their own downfall and respond to it? The theoretical concept that is used in this article is Howard Becker’s master status and, in particular, the notion that the master status of a fallen hero surpasses and contaminates all other statuses, previously possessed by an individual.

    The post-colonial re-evaluation of prominent figures in Dutch history has been resisted fiercely in the public sphere. This article raises the question how lives from the colonial era that are a source of national pride, but are also tainted by their implication in the history of slavery, colonialism and racism can be presented in a way that does justice to their historical context. Jacobus Capitein, who was first enslaved and later became an advocate for slavery in the 1740s, was initially regarded a hero in the eighteenth century, but has received a far more critical evaluation since the second half of the twentieth century. This article takes the way in which professional historians and heritage institutions have dealt with the complex and layered life story of Jacobus Capitein as a model for approaching the lives of the canonical figures of Dutch Atlantic history.

    In criminology, it is generally assumed that the high social status of white-collar offenders prevents them of being targeted by criminal law enforcement. But when they do, they suffer greater social and economic damage because of this high social status. Empirical research on the consequences of criminal law enforcement and conviction for white-collar offenders is scarce, and limited to the US and the UK. This paper used biographies of convicted former executives in business and public office in the Netherlands, to analyse these consequences and the process of the ‘fall from grace’ of white-collar offenders. The consequences are described in four life-domains: health, the private sphere, the occupational sphere and the social sphere. The results show that Dutch executives, in line with findings for the Anglo-American white-collar offenders, experience status degradation and suffer much collateral damage of criminal law enforcement. After the initial horror of imprisonment, they endure prison life fairly well. Individual competences and remaining social and economic capital enable them to return to normal life, although they cannot return to pre-conviction levels of social status.

    The relocation or destruction of the monuments of Soviet heroes in our times is in fact a process of replacement of one myth by the other. The commemoration of historical events has become the subject of struggle and manipulation of political power. The Soviet era is today the subject of divergent interpretations, ranging from nostalgia to denial, depending on the cultural, ethnic and socio-economic context in which these memories take place. In this article the processes are analysed, in which Lithuanians and Georgians change the meaning of symbols of their past in the attempt to redefine history and determine the fate of their fallen heroes.

    Unlike criminal career research into the criminal behavior of natural persons, longitudinal research into rule violations by corporations is still scant. The few available studies are mostly limited to US corporations, and suffer from either a small sample size or a short follow-up period, limiting the generalizability of their findings. The present study uses longitudinal data on rule violating behavior of 494 Dutch chemical corporations derived from yearly inspections (N=4.367) of the relevant safety and environmental agencies between 2006 and 2017. The study aims to gain insight in the patterning of rule violations by Dutch chemical corporations, and the extent to which these patterns are associated with sector and corporate characteristics. The results show that rule violation is common among Dutch chemical corporations. A small minority of chronically violating corporations however, is responsible for a disproportional share of all observed rule violations. Using group-based trajectory modelling (GBTM) we distinguish several longitudinal patterns of rule violations in our data. Available sector and corporation characteristics are only weakly associated with the patterns of rule violations identified.

    Women are less likely to commit criminal acts than men. This gender gap appears to be particularly pronounced in white-collar crime. This systematic literature review examines existing theories, such as the situational hypothesis and the ‘gendered theory of focal concerns’ and evaluates to what extent they find support in empiricism. The results seem to offer the most support to the ‘gendered theory of focal concerns’. This nourishes the hypothesis that with an increase of women at positions in the upper tiers of the company ladder a decrease in the prevalence of white-collar crime can be expected. However, it is also possible that the explanation of corporate crime does not lie in a lack of femininity, but in a lack of gender diversity. Furthermore, limited access to informal criminal networks, the ‘old boys networks’, seems to play an important role in the gender gap of white-collar crime.

    Internationally, research on the experiences of white-collar offenders with the criminal justice system and the consequences of prosecution and conviction is scarce. Such research becomes more relevant, as the response to white-collar crime has become more punitive and more offenders are convicted. This paper presents the experiences of the co-author as a convicted white-collar offender as an autobiographical case-study. In this cases study, the consequences and experiences during four phases (investigation, prosecution, sentence-execution and post-sentencing) are analysed on four live-domains: health, private life, social life and professional life. Such an approach could be a blueprint for further and more systematic study of the experiences with and consequences of criminal justice for white-collar offenders. Such study can shed light on the effects and actual achievement of goals of punishment for white-collar crime.

    This article studies the development in the prison system over the period 1837-2016 in the Netherlands. It describes trends in three characteristics of the Dutch prison system: (a) the number of prisoners, (b) the number of cells, and (c) the inflow of persons from the free society. The findings are twofold. On the one hand – when examining absolute numbers – the article shows that three distinct periods can be distinguished: a period of 140 years with low stable numbers (1837-1975), four decades in which the numbers tripled (1975-2005), and a subsequent decade where the numbers halved (2005-2016). On the other hand – when examining relative numbers, i.e. per 100.000 inhabitants, and thus controlling for the growth in population – the article displays that developments in the prison system in the Netherlands between 1837-2016 can best be characterized by a long-term continuous decrease in detention.

    The Dutch Regional Fire Services collectively aim at preventing fire, casualties and damage. The main activity is informing citizens about fire risks and the appropriate measures they can take. From both a political and social perspective, it is valuable to know what the return of the Community Fire Safety program is. One way to chart the return of the program is a comparison of the cost of, and society’s willingness-to-pay for, the program. To estimate this willingness-to-pay, this article applies the contingent valuation method to a national representative sample of 806 Dutch citizens. The results show that willingness-to-pay of an average Dutch household is estimated to be between € 25.00 and € 35.67 per year provided the Community Fire Safety program improves the fire safety by 10%. At the national level, this amounts to 200 – 270 million euro annually. This value is seven to ten times more than the approximate costs of the current Community Fire Safety program.

    Since the 1970s social integration of the police has been considered as a key element of the Dutch police. This article focusses on the question of the relevance of social integration of the contemporary police. The article is based on interviews with present and former strategic leaders of the Dutch police. This study shows that social integration is still often considered to be a highly important value for the Dutch police, particularly with regard to the growing polarisation in society. However, some of the police chiefs also express their disapproval of the concept of social integration; in their view the concept reminds us of the past. Also, police chiefs are critical of the value of the concept because of its supposed geographical focus. The paper shows that this criticism can be understood as an interpretation of social integration in terms of ‘neighbourhood policing’ and as an operational police strategy.

    Following a crisis, questions are often raised about how this crisis could have happened and whether someone is to be blamed for the crisis or its bad management. The blame game can become fierce as actors try to avoid, shift or mitigate blame in order to stay in office. In 2014, a festival took place in Haaksbergen where a monster truck drove into the audience, killing three people and injuring many others. Not enough safety measures had been taken to prevent the tragedy. Many actors were to blame for that, including the local authority which had granted the permit. Other actors blamed for the events were the mayor, the monster truck driver, and the organization organizing the festival. In the end, the mayor of Haaksbergen resigned. Instead of becoming more accommodative in his response as his blame levels increased, the mayor continued to be quite defensive, stating that the permit would be granted again – even with today’s knowledge. As one council member stated it, one cannot defend something which cannot be defended.

    This contribution reports on a delimited part of a larger, exploratory study, the main question of which was: How do aldermen perceive threats, what are their behavioral intentions and what is the influence of threats on the process and the outcome of decision-making? This question was answered with the help of Q-methodology, semi-structured interviews and case studies. This article discusses the results of the Q-methodology and the semi-structured interviews. The case studies will be reported separately later on. Through the Q-methodology three patterns in perception were found in dealing with threats: ‘combative and decisive’, ‘vulnerable and thoughtful’ and ‘down-to-earth and accepting’. The interviews show that it usually concerns instrumental threats that are deliberately used to influence decision making, which usually take place in the private sphere and vary from verbal aggression to physical violence. Most threats come from individuals, but some come from groups, in some cases there is a relationship with criminals. In the cases reviewed, the consequences in the private sphere are far-reaching, there are indications for the influence on public functioning (from hardening to great caution). There is almost always a report, a fuss in the media can affect the authority of the official.

    In the United States, the term disproportionate minority contact (DMC) is used to refer to the disproportionate number of minority youth who come into contact with the juvenile justice system. Statistics on DMC in the United States put the issue on the political agenda and measures have been taken to reduce the inequality. In the Netherlands, there are some studies on the representation of ethnic minority groups in suspect statistics, but data regarding all ethnic groups at various stages of the juvenile justice chain are lacking. Due to this lack of information, DMC is not mentioned in Dutch research literature and is not a political issue. Therefore, the purpose of this article was to explore whether DMC existed in the Netherlands and whether elements of the US policy could be applied to the Dutch situation. To investigate this, the likelihood (odds ratio (OR)) was calculated for young people with a migration background to be registered and held as a suspect, to participate in an alternative punishment program (Halt) and their likelihood of incarceration. It turned out that the OR for young people with a non-Western migration background to be registered as a suspect was more than three times as high, with an OR of 5 or higher for some ethnic groups. The chances of a Halt-settlement were much lower for young people with a non-Western background. The odds of ending up in a youth prison was over six times higher for youngsters with a non-Western background compared to their Dutch native peers. For young people of Caribbean and Moroccan origin the likelihood was more than ten times higher. These results showed that DMC is present at all examined stages in the Dutch juvenile justice chain. The large overrepresentation of young people with a migration background (especially of Moroccan and Caribbean origin) shows that further research is needed in order to develop programs to reduce DMC. To establish this, it is important to register the ethnic origin of the individuals at all stages of the juvenile justice chain.
