Access_open De betekenis van de verborgen kunst

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2021
Trefwoorden art crime, hidden art, forgeries, looting, restitution
Auteurs Marc Cools en Dina Siegel
SamenvattingAuteursinformatie

Art crime, related to the existence of hidden art, appears in the legal and illegal art market. In the criminal ‘artopolis’ especially iconoclasm, forgeries and looting are longstanding phenomena. Today they are subject to the debate on art restitution.

Nico Gunzburg en het ‘Moskou-Archief’

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2021
Trefwoorden Nico Gunzburg, freemasonry, Einsatzstab Reichsleiter Rosenberg, Moscow-archive, restitution
Auteurs Marc Cools
SamenvattingAuteursinformatie

In 1938, Nico (or Niko) Gunzburg founded the Institute of Criminology at Ghent University.
Because he was a professor of Jewish origin, Flemish-minded, a political liberal and a freemason, he became the victim, in 1940 and in 1941, of looting by the ‘Einsatzstab Reichsleiter Rosenberg für die besetzten Gebiete’. Personal books, documents, art and archives concerning his lodge ‘Marnix van Sint Aldegonde’ were stolen from his house and transported to nazi-Germany. After the Second World War, almost the entire collection was found in the Moscow-Archive and subject to restitution.

Misdaad tegen de kunst?

De Russische avant-gardewereld

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2021
Trefwoorden avant-garde, art smuggling, clandestine collections, criminalisation, forgeries
Auteurs Dina Siegel
SamenvattingAuteursinformatie

The Russian avant-garde world serves as an empirical example of the embeddedness of criminal actors (fraudsters, smugglers, thieves) in the legal art market of curators, collectors and museum directors. The article discusses various dilemmas regarding the interpretation of criminal activities in the art world. Is the smuggling of ‘forbidden art’ from the Soviet Union a patriotic act or a crime? Why do world-famous museums exhibit forgeries? What are the financial and judicial consequences of a lack of consensus between art experts?

Daderschap in het antropoceen

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2021
Trefwoorden environmental crime, offenders, responsibilities, Anthropocene
Auteurs Lieselot Bisschop
SamenvattingAuteursinformatie

Past and present human activity lies at the basis of the unprecedented environmental crisis we face today. This article explores the drivers and dynamics that are directly and indirectly responsible for the environmental crisis in the Anthropocene by using a green and organizational criminology perspective and combining it with insights from perpetrator studies. Responsible actors and responsibilities are discussed on societal, organizational and individual level. Lessons are drawn on how existing insights in criminology can be challenged to better accommodate for the ecological challenges in the antropocene and on what that means for criminologists experiencing and researching the Anthropocene.

Burgers als institutioneel werkers. Een nieuw perspectief op burgerparticipatie in veiligheid

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 3 2021
Trefwoorden institutional work, citizen participation, fire, disruption, actor perspective
Auteurs Jasper Bongers en Wim de Jong
SamenvattingAuteursinformatie

In this article we show how the concept of ‘institutional work’ can be used to study citizen participation in the field of security arrangements. Institutional work starts from the perspective of actors trying to influence security institutions, and not from the perspective of government (as concepts like the ‘participation society’ and ‘ladder’ do). As such, this dynamic concept can be a useful addition to the conceptual arsenal of security experts. By applying the concept to the case of the Voluntary Fire Brigade in nineteenth-century Utrecht (1879-1890) we show how institutional work can work in practice. Finally, we reflect on the contribution that institutional work can make to our understanding of citizen participation in the field of safety.

Criminological research has emphasized the importance of procedural justice of authorities during encounters with citizens. Theory and prior research propose that the procedurally just treatment by the police influences, possibly via legitimacy, citizens’ willingness to cooperate with authorities in the criminal justice chain. This article tests the hypotheses of procedural justice theory using Dutch data of the European Social Survey (N=1,616). The results show an association between the procedurally just treatment of citizens by the police and cooperation with criminal justice authorities. However, this association has not been explained by the legitimacy of the police.

SamenvattingAuteursinformatie

This qualitative study examines how criminal careers in cybercrime start and can be explained. Based on offender and expert interviews, the authors conclude that traditional factors linked with the initiation, such as a maturity gap (for juvenile offenders) and opportunism (for adult offenders), in combination with different types of (online) disinhibition – social, technical, situational and psychological – can explain the start of a criminal career. Features of the digital context appear to play a major role in the development of a criminal career and this requires more online supervision and education about – among other things – legal alternatives and the risks and boundaries of the online environment.

SamenvattingAuteursinformatie

The current study investigates the relationship between the Dark Triad personality traits (consisting of narcissism, psychopathy and Machiavellianism) and three different forms of aggression: online aggression, overt aggression and relational aggression. The sample consisted of 1,051 adolescents between 12 and 16 years old. Results show that psychopathy and Machiavellianism are positive predictors of the three forms of aggression, while narcissism is a positive predictor of online aggression only.

Mediation in strafzaken: de werkstijl is de methode

Reflecties op de praktijk

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 3 2020
Trefwoorden strafzaken, mediation, mediatorprofiel, mediationproces, psychologische veiligheid
Auteurs Makiri Mual
SamenvattingAuteursinformatie

Since the beginning of 2020 mediation in penal cases (mediation in strafzaken) has officially become the preferred intervention for victim-offender mediation in the criminal procedure in the Netherlands. Although mediation in general has a sound theoretical framework, the methodological elaboration appears pluriform and somewhat limited. In practice mediators in penal cases operate conform their own personal and professional standards and preferences, apparently without tailor made methodology. This article describes the current methodological directions such as transformative or narrative mediation and seeks for useful references. As a part of restorative practice, mediation in penal cases seems to remain secluded from insights and methodology developed in the domain of restorative justice practices. Educational institutes providing trainings for mediators barely refer to this theoretical framework. Besides a methodological reconnaissance this article offers a fundamental comparison of mediation styles and interventions, but is above all an incentive to further methodological research and development.

Welke toekomst voor herstelrecht in Brussel?

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 3 2020
Trefwoorden CONRAD, participatief actieonderzoek, Brussel, radicalisering, Marokkaanse jongeren
Auteurs Ali Moustatine, Tom Flachet en Erik Claes
SamenvattingAuteursinformatie

This article critically examines the prospects of restorative justice in Brussels from the perspective of urban youth work. The insights issue from action research on the topic of ‘radicalisation’. The authors develop two arguments. The first tempers restorative optimism. It shows how restorative interventions are not necessarily the most adequate response to tensions and conflicts in urban settings. The second argument points out that resistance from urban youth workers regarding the implementation of restorative interventions should not be seen as a regrettable obstacle for academics who are eager to experiment with these interventions. Such a resistance can lead to new insights and fresh opportunities to radically rethink Restorative Justice. One of the ideas that the article brings to the surface comes down to this. In a city like Brussels, characterised by superdiversity, and clearly marked by social inequalities, academic researchers only gain credibility in initiating restorative interventions if they undeniably denounce these inequalities and fully express their engagement for social justice.

Normalisering van seksueel grensoverschrijdend gedrag in de (top)sport

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden sexually transgressive behavior, normalization, topsport culture, grooming, coach
Auteurs Dr. mr. Anton van Wijk en Prof. mr. Marjan Olfers
SamenvattingAuteursinformatie

Sexually transgressive behavior occurs in all sections of society, including sports. That includes behavior from making sexual comments to rape. A risk factor is the culture that can prevail in sports, also known as a disruptive culture. There is normalization of deviant behavior. The top sport culture is particularly vulnerable to unacceptable behavior. In this article we will consider the phenomenon of grooming by the coach – the conscious and movement that induce the minor to engage in sexual contact. Within top sport, the opportunity for (sexually) transgressive behavior will be the determining factor. While grooming in recreational or recreational sport is often by isolating (vulnerable) children from the group, grooming can occur in top sport because of the intensity of the relationship, which is in any case of a more closed nature and can be strengthened by the strong performance-oriented top sport culture. In both cases, an alert, open environment is necessary to create a safe sports climate.

De ‘criminele sponsor’ van het lokale amateurvoetbal

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden georganiseerde misdaad, organisatiecriminaliteit, voetbal, witwassen, filantropie
Auteurs Professor Toine Spapens
SamenvattingAuteursinformatie

The social role of criminals in local communities has so far received relatively little systematic academic attention. This applies more specifically to their involvement in philanthropic activities. This paper describes and analyses the role of dubious sponsors particularly in Dutch amateur football. Although it is difficult to estimate the scope of the problem, results indicate that criminal sponsorship is not incidental. It mainly concerns corporate criminals, persons involved in drug crimes and outlaw motorcycle gangs. The main goal is to enhance their public image. In most cases, their involvement in crimes or regulatory offenses is difficult to assess without a doubt, which complicates preventative measures. Our analysis shows several interacting factors which increase clubs’ vulnerability to criminal infiltration: setting overambitious sportive goals; dependence on volunteers and a lack of formal integrity policies and internal compliance mechanisms; financial problems; and external pressures associated with the club’s role as the ‘pride’ of the city, the village or the neighbourhood.

Trefwoorden football agents, fraud, money laundering, regulation, self-image
Auteurs Prof. dr. Hans Nelen
SamenvattingAuteursinformatie

The focus of this article is on the role that football agents play in the world of professional football. Their role has also been associated with criminal activities such as money laundering, tax evasion, corruption and the exploitation of under-age players. The article pays attention to recent developments in the world of football and the shady business practices in relation to the transfer of football players. Moreover, the article addresses the self-image of football agents and raises the question whether they should take more responsibility themselves in containing fraud and money laundering in the world of football.

Welke samenleving in het herstelrecht?

Uitdagingen voor burgerschap en samenlevingsopbouw

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 4 2020
Trefwoorden burgerschap, samenlevingsopbouw, samenleving als actor, Vreedzame Wijk, Eigen Kracht-conferentie
Auteurs Ivo Aertsen
SamenvattingAuteursinformatie

This article discusses the concepts of society and community involvement as they appeared in the articles of the Dutch-Flemish Tijdschrift voor Herstelrecht (Journal of Restorative Justice) during last 20 years. It shows how the journal from its very beginning adopted a strong focus on criminal justice reform, although restorative practices within the community occupied a considerable space in the consecutive volumes as well. Studies on restorative justice programmes in Belgium and The Netherlands, such as victim-offender mediation and family-group conferences, revealed a predominant orientation on interpersonal relationships stressing the role of the community of care. In the same sense, also community mediation and other community oriented restorative practices focus on the personal well-being of people and the improvement of personal and social relationships. Hence, both theory and practice face two important challenges in developing restorative justice: (1) which role to give to a larger community and how to operationalize its involvement, and (2) how to deal with underlying causes of crime and social-structural injustices? Referring to European action-research projects and to conceptual models developed outside Europe, a case is made for designing restorative justice methodologies and programmes involving civil society in a more encompassing way and linking micro to macro societal levels. Developing strategic alliances with new social movements could be the way forward.

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 4 2020
Trefwoorden Fellegi, moraliteit, neutralisatietechnieken, schaamte, sociale bindingen
Auteurs Sven Zebel
SamenvattingAuteursinformatie

Why and how mediated contact between victims and offenders (and members from their networks) leads to positive outcomes, remains a difficult question to answer. Not surprisingly therefore, this topic has been the focus of attention of multiple articles in the past twenty years of this journal. In this contribution, the inspiring article of Borbala Fellegi (2008), titled ‘Explaining the impact of restorative justice. The “4-way interaction” of morality, neutralisation, shame and bonds’ is celebrated. Fellegi presents a theoretical framework in which the added value of restorative, mediated victim-offender meetings for the re-integration of offenders is outlined compared to other judicial responses to crime. Central to her argument is that the mediation process affects in particular the four criminogenic factors mentioned in the title. In this contribution two innovative, working mechanisms of the mediation process that she proposes, are highlighted. First, the preparation phase in which the neutral mediator initiates and facilitates discussion of the crime and its consequences for the victim(s) with the offender. Fellegi proposes that this mechanism can (start to) lift the criminogenic factor moral reasoning of the offender. Second, the restorative focus of the encounter itself between the victim and offender, in which both parties can express how they were affected, express their emotions (such as shame feelings of the offender) and discuss jointly how restoration and reparation might be achieved. This should reduce the criminogenic factor neutralisation, increase moral reasoning, and might contribute to integrative social bonds between the parties and their networks. Thus, Fellegi’s work has made innovative suggestions about the working mechanisms of victim-offender mediation – these suggestions offer useful hypotheses that can be tested empirically.

Opzichtige consumptie in Nederlandse rap

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2020
Trefwoorden opzichtige consumptie, hiphop, rap, straatcultuur, uitsluiting
Auteurs Robbert Goverts MSc en Dr. Robert Roks
SamenvattingAuteursinformatie

This article examines expressions of conspicuous consumption on 19 recent releases by the most popular Dutch rap artists of 2018. In line with Veblen’s (1899/2017) notion of conspicuous consumption, our content analysis of these rap lyrics shows that Dutch rappers ‘spend’ their money on all kinds of ostentatious and eye-catching luxury goods such as designer clothing and jewelry (‘drip’), cars or holidays, but also that rappers ‘stack’ some of the money they earn by putting it aside. Our results indicate that these expressions of conspicuous consumption seem to be rooted in, and fueled by, experiences with poverty, stigmatization, and discrimination.

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2-3 2020
Trefwoorden parental monitoring, self-control, delinquency, social control
Auteurs Dr. Jessica Hill MSc en Prof. dr. mr. Arjan Blokland
SamenvattingAuteursinformatie

In this study we examine whether parental monitoring remains a protective factor in the lives of emerging adults, as well as the extent to which monitoring in other settings replaces the protective role of the parents. We use data collected for the TransAM project, a longitudinal survey of 970 emerging adults (18-24 years) to examine monitoring in a range of different contexts using an instrument based on Stattin and Kerr’s parental monitoring scale (2000). Results indicate that whilst parental control plays a protective role in the first years of emerging adulthood, we find no evidence that monitoring in other settings replaces the protective role of parents. However, monitoring of the self, i.e., self-control, has an increasingly strong relationship with delinquency during emerging adulthood.

Welzijn, primaire levensbehoeften en delinquentie bij adolescenten

Etiologische assumpties van het Good Lives Model getoetst

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2-3 2020
Trefwoorden GLM, Rehabilitation, Juvenile delinquency, Life satisfaction, Youth
Auteurs Colinda Serie PhD, Prof. dr. Stefaan Pleysier, Prof. dr. Johan Put e.a.
SamenvattingAuteursinformatie

A recent rehabilitation theory, the ‘Good Lives Model’ (GLM), states that interventions that work towards a higher well-being can reduce recidivism risk more sustainably by promising a happier, pro-social life, rather than just a less harmful one. Although the GLM theory appears promising, limited empirical research has examined its underlying assumptions, applicability and its effectiveness. Research into the GLM with youth is even more limited. Therefore, in the current study, we investigate the main etiological assumptions of the GLM in a large group of adolescents between 14 and 18 years old from the general population (N=5.776), by means of self-report survey data on well-being, primary human goods and delinquency. The results show that a lower subjective global well-being is related to delinquent behavior. Especially the primary human goods of relatedness and working towards a financially stable future appear to be important goals for interventions aimed at rehabilitation of juvenile offenders.
