Reflecties op Leuven Restorative City

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 2 2021
Trefwoorden Restorative City, stad, stadstaat, gemeenschapsvorming, cascades
Auteurs Antony Pemberton
SamenvattingAuteursinformatie

This essay is a scientific reflection on Leuven Restorative City (LRC). The cities, which present themselves as ‘restorative cities’, aim to ensure that restoration continues to nestle in the capillaries of our society. The article argues that realizing the LRC-promise requires restorative thinking through the meso-level of local public life. This involves reference to a number of notions that can be traced back to Ancient Greek thought in Athens, in which the intellectual virtue of phronesis – practical wisdom in a social and political context – is central. Citizens are seen as allies in the solution of social issues. LRC contributes to this through its focus on ‘turning conflict into opportunities’. Restorative justice wisdom is more widely applicable in society. However, the LRC process can sometimes be erratic and unpredictable. The article points to the possible alternation of good and bad periods, and puts forward the expectation that the development of restorative practices in Leuven can be understood as cascades. In these cascades, the course of the diffusion of restorative practices is presented in terms of successive waves of learning experiences and knowledge sharing.

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2021
Trefwoorden climate litigation, Urgenda, green criminology, climate justice, climate victims
Auteurs Yanna Hoek, Daan van Uhm en Damián Zaitch
SamenvattingAuteursinformatie

Climate litigation is an understudied phenomenon in criminology. In this article we will discuss the rise of climate change litigation and growing recognition of global environmental harms from a green criminological perspective. More specifically, we will discuss both the legal reasoning and the impact of the Urgenda case in the Netherlands in the context of environmental, ecological and climate justice. We will conclude with how this case contributes for the recognition of diverse climate victims and strengthening of climate justice in the near future.

De criminologische uitdaging in de 21ste eeuw

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2021
Trefwoorden antropocene, criminology, non-speciesism
Auteurs Janine Janssen en Marc Schuilenburg
SamenvattingAuteursinformatie

‘Antropocene’ is a wellknown concept among those that are concerned about the Earth’s future. Nevertheless, there is a heated scientific debat about the start of this era in history and the name ‘antropocene’in itself. In this contribution it is stated that that debate is helpful in raising important questions about the desatrous influence of mankind on live on this planet. Criminologists should take a stance and address these questions as well. This contribution includes a manifest that contains points for further action for criminologists.

Exploring narrative, convictions and autoethnography as a convict criminologist

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2020
Trefwoorden convict criminology, narrative, autoethnography, reflexivity, post-colonial perspective
Auteurs Dr. Rod Earle
SamenvattingAuteursinformatie

Convict criminology draws from personal experience of imprisonment to offer critical criminological perspectives on punishment and prisons. In this article I discuss how some of these are aligned with questions of narrative and post-colonial perspectives in criminology. I use autoethnographic vignettes to communicate the experiences of imprisonment that inform the development of convict criminology, and I explore their relationship to narrative criminology’s interest in personal stories.

Whose narratives?

The Self as (also) an alien – for a complex concept of ‘Self’ in narrative criminology

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2020
Trefwoorden Self, narrative criminology
Auteurs Professor Alfredo Verde
SamenvattingAuteursinformatie

This paper, answering to a recent critique by Ben Laws to the concept of Self developed by narrative criminology, and recognizing its importance, shows that narrative criminology has formulated a complex dynamic definition of it, in addressing both the limit-experiences and the unconscious dimension. Such enlargement can be attained by adding to narrative criminology the contributions of psychosocial criminology, that considers also the emotional dimension of crime narratives and the enjoyment connected to crime: the offender Self, in this perspective, is a multiplex, not completely definable, sometimes alien entity, which can be exposed analysing in depth criminal narratives.

Alsof slachtofferschap een verhaal is: de narratieve victimologie en haar grenzen

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2020
Trefwoorden victimology, narrative criminology, cultural criminology, Susan Brison, Hans Vaihinger
Auteurs Prof. dr. Antony Pemberton
SamenvattingAuteursinformatie

This article adopts German philosopher Hans Vaihinger’s Philosophy of “as if” as a vehicle to sketch the main features of the emerging research domain of narrative victimology, as well as address some of its limitations. Vaihinger emphasizes the importance of useful untruths, i.e. things we know to be untrue, but nevertheless behave as if they are not, if that strengthens their use as instruments for us to find our way more easily in the world. This applies to our daily lives, but also to our societal institutions and the models and metaphors that underlie our approaches to (social) science. The paper argues that the narrative metaphor of the historical event is often more apt to enhance our understanding of victimological phenomena than that of the mechanism, which is the default metaphor of (social) science. The paper subsequently describes four areas of inquiry of narrative victimology: victimisation’s impact on (life) stories; narratives in the aftermath of victimization; narratives of victim’s experiences with justice processes and the coincidence and juxtaposition of the victims’ narrative with narratives of other significant parties. For all its merits however, the narrative metaphor is also a “useful untruth”, equipped with its own limitations, for instance the difficulty of language in describing first hand experiences of victims and the possibility that narrative structures will be imposed upon victim experiences.

Verhalen in interviews

Kritisch meekijken met de narratieve criminologie

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2020
Trefwoorden narrative criminology, storytelling, interview, thick description, police
Auteurs Dr. Merlijn van Hulst
SamenvattingAuteursinformatie

Narrative criminology focuses on stories. It initially contrasted itself with standard approaches to interviewing. The founders of narrative criminology proposed that we understand that what the persons we investigate are telling us, as acting discursively and not as factual descriptions of events or accurate representations of their perspective. This critique I compare to previous critique on interviewing to show their overlap. Next, I critique these critiques. Finally, I propose several ways through which narratives in interviews can be enriched.

Legitimering van massale schade

De narratieve sociologie van Lois Presser

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2020
Trefwoorden narrative criminology, critical criminology, mass harm, narrative impacts, power paradox
Auteurs Dr. Bas van Stokkom
SamenvattingAuteursinformatie

In this review-essay, two books by criminologist Lois Presser are discussed: Why We Harm (2013) and Inside Story: How Narratives Drive Mass Harm (2018). In these books the author develops a general theory of harmful action, in particular collective and massive forms of harmful action that are often related to state institutions and large companies. Presser shows that all kinds of stories, scripts and ideologies may justify, support, cover up or deny harmful action. In her publications, cultural sociology, critical criminology and discourse analysis are intimately intertwined.

Narratieve criminologie meets participatief actieonderzoek

Een reflectie over epistemologische mogelijkheden en uitdagingen

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2020
Trefwoorden participatory action research, critical narrative criminology, counter narratives, drug use, stigma
Auteurs Michelle Van Impe MA
SamenvattingAuteursinformatie

Critical narrative criminologists analyse dominant and institutionalised stories that can contribute to harm but they might also become more involved in interrogating and changing such narratives. The following question would be: in what ways can this be done? Based on experiences from a Participatory Action Research (PAR) project on stigma with people who use(d) illegal drugs, this paper reflects on the epistemological opportunities and challenges of fusing narrative criminology with PAR. Although such an integration raises potential tensions – especially with regard to the role of the researcher – PAR can amplify narrative criminology by offering a framework for practicing critical, ethical and socially engaged scholarship. Vice versa, narrative criminology can deepen PAR in its analysis of discursive power structures and the relation between narratives and action.

Cultural criminology and narrative criminology’s shared interests

More than just criminological verstehen

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2020
Trefwoorden verstehen, cultural criminology, media looping, narrative criminology, storytelling
Auteurs Dr. Avi Brisman
SamenvattingAuteursinformatie

This article explores the intersection of two criminological perspectives—cultural criminology and narrative criminology. Taking inspiration from Mills and Fleetwood’s article, ‘Prepping and verstehen: A narrative criminological perspective’, where the authors contend that stories complement the pursuit of criminological verstehen, this article draws attention to other ways in which cultural criminology and narrative criminology are imbricated, taking notice of commonalities in cultural criminology’s analysis of media looping and narrative criminology’s identification of cycles of storytelling practice and lived experiences. A consideration of Donald Trump’s attempts to control narrative is used to develop an argument regarding cultural criminology’s and narrative criminology’s joint questioning of linear sequencing and mutual recognition of circulating fluidity

Mediation in strafzaken: de werkstijl is de methode

Reflecties op de praktijk

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 3 2020
Trefwoorden strafzaken, mediation, mediatorprofiel, mediationproces, psychologische veiligheid
Auteurs Makiri Mual
SamenvattingAuteursinformatie

Since the beginning of 2020 mediation in penal cases (mediation in strafzaken) has officially become the preferred intervention for victim-offender mediation in the criminal procedure in the Netherlands. Although mediation in general has a sound theoretical framework, the methodological elaboration appears pluriform and somewhat limited. In practice mediators in penal cases operate conform their own personal and professional standards and preferences, apparently without tailor made methodology. This article describes the current methodological directions such as transformative or narrative mediation and seeks for useful references. As a part of restorative practice, mediation in penal cases seems to remain secluded from insights and methodology developed in the domain of restorative justice practices. Educational institutes providing trainings for mediators barely refer to this theoretical framework. Besides a methodological reconnaissance this article offers a fundamental comparison of mediation styles and interventions, but is above all an incentive to further methodological research and development.

Pro-cycling’s doping pentiti

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden doping, cycling, cultural criminology, crime facilitative system, organisational crime
Auteurs Dr. mr. Roland Moerland en Giulio Soana
SamenvattingAuteursinformatie

Throughout the last decade several cyclists have published memoirs in which they account for their doping use. In previous literature such autobiographical accounts have been characterized as attempts of fallen sports stars to sanitize their spoiled public image. In contrast, the analysis in this article will show that the accounts are of relevance when it comes to understanding the problem of doping in professional cycling. Their accounts break the omertà regarding doping, providing insights about the motivation and opportunity structures behind doping and how such structures are endemic to the system of professional cycling.

Opzichtige consumptie in Nederlandse rap

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2020
Trefwoorden opzichtige consumptie, hiphop, rap, straatcultuur, uitsluiting
Auteurs Robbert Goverts MSc en Dr. Robert Roks
SamenvattingAuteursinformatie

This article examines expressions of conspicuous consumption on 19 recent releases by the most popular Dutch rap artists of 2018. In line with Veblen’s (1899/2017) notion of conspicuous consumption, our content analysis of these rap lyrics shows that Dutch rappers ‘spend’ their money on all kinds of ostentatious and eye-catching luxury goods such as designer clothing and jewelry (‘drip’), cars or holidays, but also that rappers ‘stack’ some of the money they earn by putting it aside. Our results indicate that these expressions of conspicuous consumption seem to be rooted in, and fueled by, experiences with poverty, stigmatization, and discrimination.

Moral injury en herstel

Een existentiële verkenning

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 2 2020
Trefwoorden moral injury, PTSS, verantwoordelijkheid, vertrouwen, veiligheid
Auteurs Joachim Duyndam
SamenvattingAuteursinformatie

This paper examines moral injury, in relation to recovery from this kind of psychic damage and to restorative justice. In recent research the concept is developed in distinction from the psychiatric diagnosis PTSD. Whereas PTSD is rooted in anxiety, as it occurs during or after life-threatening situations, people suffering from moral injury are disruptively affected by guilt and shame, in the slipstream of which they may be tormented by remorse, self-loathing, anger and self-disgust – with symptoms similar to PTSD. Unlike PTSD, however, the risk of moral injury is part of ordinary life. It may happen to anyone. Therefore, this paper takes an ‘existential’ perspective by relating moral injury to the fundamental human condition of relationality. Moral injury is interpreted as the disturbance of the responsibility, the confidence and the security that fundamentally sustain the human relationships to the world, to each other, and to oneself. One way of recovering from moral injury is through empathy, primarily performed by caregivers or chaplains who guide the morally injured, and consequently accomplished by the injured themselves, in a narrative way.

Een positief criminologische visie op radicalisering

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 1 2020
Trefwoorden positieve criminologie, polarisatie, staircase model, continuum of violence, typologie van geweld
Auteurs Anneke van Hoek
SamenvattingAuteursinformatie

The first part of this article presents three academic theories on radicalisation: Moghaddam’s staircase model of radicalisation, Galtung’s typology of violence (direct, structural and cultural violence), and Staub’s psycho-educative approach. The core of Staub’s approach is that in conflict periods, people can be psychologically manipulated through their own fears, insecurities and unresolved traumas. Therefore, psycho-education and the empowerment of people are highly necessary to stimulate citizens to function as active bystanders when they are confronted with wrongdoing. In the second part of this article some promising approaches are presen‍ted which might increase personal and social resilience. The role of narratives in understanding experiences and changing identities is discussed. Radio La Benevolencija in Rwanda uses the power of storytell‍ing to stimulate resilience among the population. In the concluding paragraph a two-pronged strategy on radicalization is presented. This positive criminological perspective aims to promote active bystandership, participation and resilience.

De kracht van verbinding

Een kwalitatief onderzoek naar de rol van lotgenotencontact voor nabestaanden van zware verkeersdelicten

Tijdschrift Tijdschrift voor Criminologie, Aflevering 1 2020
Trefwoorden peer support, co-victims, traffic offenses, Big Two, narratives
Auteurs Dr. Pauline Aarten, Pien van de Ven MSc en Rik Ceulen MSc
SamenvattingAuteursinformatie

For co-victims of severe traffic offenses in the Netherlands, peer support is offered. However, no research into the meaning of peer support for this specific group of victims has been conducted. In this study, nineteen narrative interviews with co-victims of traffic offenses were collected. These interviews show that through dialogue and the sharing of experiences, as well as the care and support for each other, peer support offers the possibility to work on the meaning-making of the traffic offense and its aftermath. The article ends with policy implications and steps for follow-up research.

The concept of violence in (times of) crisis

On structural, institutional and anti-institutional violence

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2019
Trefwoorden structural violence, institutional violence, anti-institutional violence, economic crisis, Greece
Auteurs Marilena Drymioti
SamenvattingAuteursinformatie

Attempting to understand the Greek narrative of crisis, this paper examines the most prominent forms of violence that emerged in the period of acute economic recession and political upheaval in Greece namely structural, institutional and anti-institutional violence. This paper aims to highlight existing theoretical gaps and avoid common fallacies of the current body of knowledge. In contrast to some of the more common features of the discussion on violence, this note sets out to: a) acknowledge that violence is not necessarily a physical act, b) acknowledge that the outcomes of violence performances might not be physical either, c) specify and adequately distinguish agency and structural dynamics and d) address the cultural and contextual aspects of violence. Vital to this endeavor is to acknowledge, identify and understand the interactive relation between different forms of violence that emerge during the same period of time in a context in which conflict escalates.

De emotionele beleving van kwalitatief onderzoekers bij onderzoek naar kwetsbare groepen en gevoelige thema’s

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2019
Trefwoorden narrative review, qualitative research, emotions, sensitive topics, vulnerable groups
Auteurs Ciska Wittouck en Gwen Herkes
SamenvattingAuteursinformatie

A narrative review was conducted to develop more coherent awareness and knowledge regarding emotional experiences of qualitative researchers studying sensitive topics or vulnerable groups, as discussions about this topic are currently fragmented and scattered. Qualitative researchers experience many painful as well as enjoyable emotions, which can influence their personal, social and professional lives. These emotions are recurrently reported in relation to the unpredictability of qualitative research and the different roles of qualitative researchers. More structural and individual attention for emotional experiences of qualitative researchers is necessary, for instance, in academic (doctoral) training and general handbooks on qualitative research.
