Auteurs Richard Staring, Lieselot Bisschop, Charlotte Colman e.a.
SamenvattingAuteursinformatie

The ports of Rotterdam and Antwerp are among the main European ports of entry for the import and further distribution of cocaine. Earlier research underlines the interchangeability of these ports regarding the criminal networks trafficking cocaine into Europe. In this contribution, the interchangeability of these European sea ports regarding cocaine trafficking is questioned. Based on empirical research, and applying the routine activity approach, the Port of Rotterdam and the Port of Antwerp are compared with respect to their physical characteristics, the potential, motivated offenders, as well as the existing public and private security measures.

Trefwoorden climate litigation, Urgenda, green criminology, climate justice, climate victims
Auteurs Yanna Hoek, Daan van Uhm en Damián Zaitch
SamenvattingAuteursinformatie

Climate litigation is an understudied phenomenon in criminology. In this article we will discuss the rise of climate change litigation and growing recognition of global environmental harms from a green criminological perspective. More specifically, we will discuss both the legal reasoning and the impact of the Urgenda case in the Netherlands in the context of environmental, ecological and climate justice. We will conclude with how this case contributes for the recognition of diverse climate victims and strengthening of climate justice in the near future.

SamenvattingAuteursinformatie

The aim of the present research was to gain insight into the topic of ‘task-related rule-breaking behavior’ (TRB) among Dutch police officers. TRB is a more refined alternative for the concept of noble cause corruption and has been defined as: police officers breaking rules or formal agreements for the purpose of acting in a manner that contributes to the lawful police task. Qualitative research has been conducted within one of the ten regional police forces in the Netherlands. Results show that TRB appears to be a relatively common phenomenon during policework. Behaviors are categorized in sixteen categories and five overarching outlines. In addition, attention is given to several important factors that could be related to TRB being distinguishable between police officers’ individual responsibility and organizational factors. To handle TRB, it is recommended to pay attention to the police officers’ approach of judging and rationalizing their own behavior, their level of knowledge, and social skills. Furthermore, organizational structure (i.e., spam of control) and police leadership may, among other factors, play an important role in encouraging TRB. Especially the way supervisors deal with police officers’ professional autonomy needs specific attention in order to reduce TRB. Autonomy needs guidance in the form of clear orders followed by feedback and coaching. Also, an active form of ethical leadership is needed. An action framework is presented that could be helpful to supervisors to judge and thereby reduce forms of TRB.

SamenvattingAuteursinformatie

The Financial Action Task Force reported that money launderers may operate in professional money laundering networks. Whether such money laundering networks operate in the Netherlands is unclear. In this article the authors therefore explore whether professional money launderers collaborate in network structures and the business-like manner in which they offer their services. Business-like refers to their involvement in multiple cases, the amount of repeat customers, and excludes family relations. The research is based on Dutch police registrations of 236 professional money launderers. Our results suggest that professional money laundering networks are indeed active in the Netherlands and that money launderers in these networks offer their services in a business-like manner to a varying extent. An important caveat to the current findings is that the criminal cases analyzed predominantly pertain drug-related offenses, leaving the existence and professionalism of money laundering networks in other types of crime, like large-scale fraud, a question open for future research.

De ‘criminele sponsor’ van het lokale amateurvoetbal

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2020
Trefwoorden georganiseerde misdaad, organisatiecriminaliteit, voetbal, witwassen, filantropie
Auteurs Professor Toine Spapens
SamenvattingAuteursinformatie

The social role of criminals in local communities has so far received relatively little systematic academic attention. This applies more specifically to their involvement in philanthropic activities. This paper describes and analyses the role of dubious sponsors particularly in Dutch amateur football. Although it is difficult to estimate the scope of the problem, results indicate that criminal sponsorship is not incidental. It mainly concerns corporate criminals, persons involved in drug crimes and outlaw motorcycle gangs. The main goal is to enhance their public image. In most cases, their involvement in crimes or regulatory offenses is difficult to assess without a doubt, which complicates preventative measures. Our analysis shows several interacting factors which increase clubs’ vulnerability to criminal infiltration: setting overambitious sportive goals; dependence on volunteers and a lack of formal integrity policies and internal compliance mechanisms; financial problems; and external pressures associated with the club’s role as the ‘pride’ of the city, the village or the neighbourhood.

Trefwoorden football agents, fraud, money laundering, regulation, self-image
Auteurs Prof. dr. Hans Nelen
SamenvattingAuteursinformatie

The focus of this article is on the role that football agents play in the world of professional football. Their role has also been associated with criminal activities such as money laundering, tax evasion, corruption and the exploitation of under-age players. The article pays attention to recent developments in the world of football and the shady business practices in relation to the transfer of football players. Moreover, the article addresses the self-image of football agents and raises the question whether they should take more responsibility themselves in containing fraud and money laundering in the world of football.

Moniek Hutten
SamenvattingAuteursinformatie

There is no clear answer to the question if corruption makes victims. Currently an (international) discussion is taking place about this matter. On the one hand it can be discussed that corruption in general does not know any direct victims and that corruption can even take place without any damage. On the other hand it is known that corruption can cause tremendous public and financial damage, with society as a whole as the victim of this crime, whether or not in primary gradation. In the underlying article these two perspectives will be discussed and applied on two cases. Special attention will also be paid to the impact and relevance of pointing out the victims.

Access_open Criminaliteit en macht: een inleiding

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2019
Trefwoorden crimes of the powerful, white collar crime, hate crime, eco crime, ‘lawful but awful’
Auteurs Prof. dr. René van Swaaningen
SamenvattingAuteursinformatie

Criminologists have by and large sought to explain crime by the deficiencies people may have. It took till the 1970s until the idea that crime can also be caused by structural power inequalities got an actual name in criminology: crimes of the powerful. Starting with the works of Willem Bonger and Edward Ross in the early 20th century, the author analyses how critical criminologists like Frank Pearce introduced the term ‘crimes of the powerful’ in the 1970s and how this concept was subsequently applied to gender- and racial inequalities, state crime, corruption et cetera, whilst pointing at the topical relevance of using a lens of ‘crimes of the powerful’ as a sensitising concept to analyse present-day problems, ranging from sexual abuse in the Roman Catholic church to the banking sector or indeed the expropriation of indigenous lands in the Amazon by soy-farmers and timber traders.

Researching elites at the margins of research ethics frameworks

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2019
Trefwoorden code of ethics, corporate crime, research ethics, gaining access, interviewing elites
Auteurs Daniel Beizsley PhD
SamenvattingAuteursinformatie

For social scientists undertaking critical research on elites in organisational contexts securing access is a challenging exercise that may rely on the use of several access strategies over extended periods. This process is further complicated by the existence of research ethics frameworks that establish boundaries to access strategies, posing dilemmas on how to best balance access needs with a commitment to ethical practices. This article focuses on such dilemmas – or the ‘ethics of access’ – through a reflection on PhD fieldwork during 2016-2017 in Luxembourg spent researching the European Investment Bank. The paper will conclude by calling for an overhaul of existing frameworks in order to foster more research on elites.

Top-down and out?

Reassessing the labelling approach in the light of corporate deviance

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2019
Trefwoorden labelling, corporate crime, moral entrepreneurs, peer group, late modernity
Auteurs Anna Merz M.A.
SamenvattingAuteursinformatie

Multi-national corporations are increasingly facing attention and disapproval by different actors, including authorities, public and (non-) commercial organizations. Digital globalization and especially social media as a low-cost, highly interactive and multidirectional platform shape a unique context for this rising attention. In the literature, much attention has been devoted to top-down approaches and strategies that corporations use to avoid stigmatization and sanctioning of their behaviour. Reactions to corporate harm are, however, seldom researched from a labelling perspective. As a result, corporations are not considered as objects towards whom labelling is targeted but rather as actors who hamper such processes and who, as moral entrepreneurs, influence which behaviour is labelled deviant. Based on theoretical analysis of literature and case studies, this article will discuss how the process of labelling has changed in light of the digitalized, late-modern society and consequently, how the process should be revisited to be applicable for corporate deviance. Given a diversification of moral entrepreneurs and increasingly dependency of labelling and meaning-making on the online sphere, two new forms of labelling are introduced that specifically target institutions; that is bottom-up and horizontal labelling.

Ambtelijke en bestuurlijke corruptie in Nederland; waar staan we anno 2018?

Tijdschrift Tijdschrift voor Criminologie, Aflevering 4 2018
Trefwoorden Corruptie, Integriteit, Rechtshandhaving, Openbaar bestuur
Auteurs Prof. dr. Hans Nelen en Prof. dr. Emile Kolthoff
SamenvattingAuteursinformatie

The most recent extensive study on political and administrative corruption in The Netherlands dates back to 2005 (Huberts & Nelen, 2005). Afterwards various studies have been conducted on related subthemes and areas. In this contribution, the state of affairs regarding political and administrative corruption – and the responses to them – in The Netherlands in 2018 is described, based on the results of these studies. Starting with an overview of the nature and severity of political and administrative corruption, the focus shifts to relevant developments in the control and prevention of corruption, partly addressing the causes of the phenomenon.

Auteurs Dr. Karin Van Wingerde, Prof. dr. Antoinette Verhage en Dr. Lieselot Bisschop
SamenvattingAuteursinformatie

In this introductory article we will discuss some of the recent developments in corporate crime research in the Netherlands and Belgium since 2008. In doing so, we will answer the following three questions: (1) What are the most important developments in the way research on corporate crime has been carried out? (2) What are key themes in corporate crime research? (3) What are the most important blind spots in research into corporate crime? We will conclude with some avenues for future research on corporate crime and its enforcement.

Georganiseerde houtcriminaliteit in de Braziliaanse Amazone

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2018
Trefwoorden criminal timber networks, community-based and situational forest crime prevention, Amazon rainforest, Brazil, Illegal logging
Auteurs Dr. Tim Boekhout van Solinge
SamenvattingAuteursinformatie

That criminal networks are active in the illegal exploitation of timber is increasingly acknowledged. The degree of organization of these networks, and the way in which they use (threats of) violence and corruption, is less known. This article describes and analyses, on the basis of various, including local, sources, how organized criminal groups in the Amazon rainforest illegally harvest trees which they sell on the (international) market and how they try to stay immune from the law by using threats, violence, fraud and corruption. This article also discusses the first results of a three-year pilot (2014-2017) of community-based forest monitoring and protection with waterproof GPS-camera’s, developed with communities and with support of the Brazilian Public Prosecutor’s Office.

Trefwoorden green criminology, illicit trade in species of endangered birds, CITES convention
Auteurs Dr. Daan van Uhm en Prof. dr. Toine Spapens
SamenvattingAuteursinformatie

The Netherlands are considered as an important hub for the illicit trade in species of endangered birds protected by the CITES convention. In this article the authors analyze five substantial criminal cases from three different perspectives. First, from a criminal business perspective, the cases illustrate that logistics vary from relatively simple to highly complex, but always require in-depth knowledge of the animals as well as regulations, to be able to keep the birds alive to make a profit, and to smuggle them to the Netherlands, respectively. Second, from a network perspective, it is clear that those who are involved in the illicit trade – suppliers, traders and customers – are part of a closed and often long-lasting group of people who know the trade. Finally, from a green criminological perspective, the authors conclude that harms of the illicit trade in protected birds are mentioned only to a limited extent in court rulings, contrary to what one might expect based on social construction theories of criminalization and sentencing.

De anomie van machtsillusies

Onbegrensde ambities in de ‘risk and win’-zakenwereld

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2018
Trefwoorden anomie, illusion of control, corporate crime, competition, entitlement
Auteurs dr. Bas van Stokkom
SamenvattingAuteursinformatie

Generally, large listed companies and banks immersed in a ‘risk and win’-culture do not have to deal with ‘deprivation of resources’ which may trigger violations of the law. The anomie-theory of Merton does not seem to fit in this context. It is more obvious that the pressure to realize lofty ambitions is the trigger for potential violations of the law. I therefore work out a ‘post-Mertonian’ anomie-concept using the ‘European Durkheim’ to examine some excessive tendencies of an originally American ‘risk and win’-culture. The aim is to work towards an anomie-theory of power illusions that makes sense in the context of corporate crime. The leading question is: which anomic attitudes prevail in an over-ambitious corporate culture and which aspirations and rationalizations can be distinguished? It is argued that an approach focused on CEO-personality traits is too limited and that the sociological approaches of Durkheim and Shover offer many points of departure to construct a plausible anomie-theory. The dimensions of that theory have been taken from studies which focus at two criminogenic norm-systems: an ‘ethos of winning at any price’ and an ‘ethos of entitlement’.

SamenvattingAuteursinformatie

Shipbreaking is the dismantling of discarded vessels to reuse parts and recycle secondary raw materials. The majority of discarded vessels ends up on Southeast Asian beaches, dismantled without regard for the environment or human health. Our case study analyses the environmental crime of shipbreaking by using the theoretical framework of state-corporate crime as a frame of analysis. We focus on Germany and Greece as countries of origin and Bangladesh as a country of destination. Our findings show that shipbreaking is the result of a complex criminogenic interplay of economic and political actors on national as well as international level.
