Over de criminologische erfenis van Stanley Cohen

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2017
Trefwoorden Stanley Cohen, moral panic, denial, social control, intellectual scepticism
Auteurs prof. dr. René van Swaaningen
SamenvattingAuteursinformatie

On the occasion of the publication of a collection of articles by Stanley Cohen in 2016 (edited by Tom Deams), René van Swaaningen pays a tribute to this important, thought-provoking and pioneering thinker in criminology. He takes Cohen’s adage that we as critical criminologists always have to balance between intellectual scepticism and political commitment as a starting point for an analysis of his work. Cohen’s rejection of criminology as a liberal project may have led him to defining himself as an ‘anti-criminologist’, yet at the same time Cohen has been able to transform the discipline as such into a more power-critical direction. Two of Cohen’s key-contributions to criminological theory, those on moral panics and on denial, are discussed and related to each other. Whilst adopting Foucault’s analyses of power as a constructing practice, Cohen, in his work on social control, rejects the pessimist implications of Foucault’s work, in which human agency is defined away. In this essay, the relation of Cohen’s work with that of his mentor David Matza is also discussed, as well as is his great and ironic style of writing.

Over criminologie, emoties en ongerijmdheden

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2016
Trefwoorden Herman Bianchi, labelling approach, critical criminology, abolitionism, historical criminology
Auteurs prof. dr. René van Swaaningen
SamenvattingAuteursinformatie

Herman Bianchi, who passed away on the 30th of December 2015, has been a true ‘significant other’ for cultural criminologists. This article is a ‘criminological Verstehen’ of Bianchi’s work. His general attitude towards criminology is characterised by a mix of academic analysis, emotional outrage and incongruities. In order to understand this, his contributions to criminology are linked to biographical notes and to the mixed reactions he got on his work. Bianchi played an important role in the establishment of criminology as an autonomous academic discipline, yet he was very critical of this ‘discipline of shame’ because it has always served the exclusion of the most vulnerable members of society. He has been one of the frontmen of critical criminology, but he was not a Marxist. His concern for the despised other is related to his eternal fear, as a gay man in a ‘closet with a revolving door’, of new waves of discrimination against gays, and his rigorous abolitionism to his experience as a prisoner in a Nazi-concentration camp in 1944. Bianchi’s historical interest led him at the end of his career in the 1980s to support the emergence of strong historical criminology, but his utilitarian use of historical studies, also resulted in some clashes with professional historians.

Het belang van ideologie

Een reactie op Marc Groenhuijsen

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 4 2010
Trefwoorden restorative justice, Paradigma, Tailoring, victims
Auteurs John Blad
SamenvattingAuteursinformatie

Blad responds to Groenhuijsen by showing how political decisions in the Netherlands, after successful experiments with restorative justice for juveniles and adults, were based on the belief that criminal justice would lose its punitive foundation and tenor when restorative justice practices would become integrated in the justice system. Criminal justice should not be about resolving conflicts between victims and offenders and the type of mediation, that could lead to an agreement as an important element to be considered in sentencing, was therefore rejected. In so far as restorative justice ideology took influence, it seems to have been a misconception of restorative justice as merely a new form of penal abolitionism. The fact that restorative justice does not deny the legitimacy of the provisions in the substantive criminal law and that all important restorative projects co-operate with criminal justice agencies was apparently ignored. Against the background of the dominant political culture of ‘punitive populism’ and intensified use of severe punishments it seems highly unlikely that abandoning the ambition to develop a restorative justice paradigm would further the implementation of restorative justice.

Gacaca in postconflict Rwanda

De zoektocht naar verzoening en gerechtigheid

Tijdschrift Tijdschrift voor Criminologie, Aflevering 1 2009
Trefwoorden Gacaca, Rwanda, genocide, verzoening, gerechtigheid
Auteurs Drs. Hester Baboelal-Bosman
SamenvattingAuteursinformatie

Based on a prize-winning master thesis in criminology, this article describes how the Rwandan Government chose to bring to justice all suspects of (crimes during) the 1994 genocide. Accordingly, it was decided to turn to Gacaca, the traditional Rwandan method of dispute resolution, in order to reach reconciliation as well as justice. A field study indicates that, when asked whether they think Gacaca can lead to reconciliation and justice, the majority of Rwandans think it can. However, six determinants of reconciliation have been deduced from the interviews. Because Gacaca can only have a clear positive impact on one of these factors – the need to meet – Gacaca can not be considered as an appropriate mechanism to achieve reconciliation in Rwanda. It also appears that justice is not a determinant for reconciliation.
