    Traditionally, the mayor has an important role as a citizen’s father and as a maintainer of public order. In the context of the so-called ‘undermining’ criminality, the mayor has been increasingly empowered with new legal instruments to combat undermining criminality. Some mayors see themselves as a sheriff. However, in the Dutch Municipal Act, the mayor only has a task of maintaining the public order. How does this task relate to combating undermining criminality? What is the role of the mayor in the combat of undermining criminality? Nowadays, there is no legal basis in the Dutch Municipal Act to equip the mayor with crime-fighting duties. This article proposes to equip the mayor with a legal duty as a crime fighter.

    Several authors fear that the expansion of Dutch mayors’ executive powers in the field of safety and security will harm their position as non-partisan and consensus-oriented leaders. Empirical research into how mayors use their powers, however, is still rare. From a leadership perspective, the current article analyzes how mayors in the region of South East Brabant in Netherlands use their administrative power to close homes involved in drug-related crime. Drawing on Fischer’s framework of discursive practices, we analyze mayors’ considerations in terms of the argumentation they provide for closing homes. Our analysis, which draws on interviews and document analysis, covers 27 cases from the police region of South-East Brabant and includes 120 considerations. Our findings indicate that mayors vindicate home closures mostly through policy-derived technical and situational argumentations. Vindications that aspire a particular societal effect, such as the reduction of criminal activity, or ideological motivations are rarer, which is indicative of a non-decisive leadership style. In addition, mayors mostly respect the local closure policies. As such, they show very little decisive and individualistic leadership. And, to the extent that they deviate from agreed-upon regional policies, their motivation is to be able to take into account unique local circumstances. In the use of their administrative powers mayors, thus, show mostly situational and adaptive leadership, which, rather than as visionaries, positions them as caretakers. The leadership style of Dutch mayor in the use of this administrative power is, thus, much more in accordance with their traditional bridging-and-bonding leadership style than some authors suspect. Some of the limitations of our study are that we have analyzed closure decisions from one region only and that real-life decisions are susceptible to contextual influences. At the same time, our study provides a rare insight into real-world mayoral leadership in the Netherlands in the field of safety and security.

    In the Netherlands, over the past 25 years mayors have had an increasing number of formal powers, based on administrative law, to fight against crime and disorder. Now, the Dutch mayors have the power to impose a restraining order, to close houses in case of drugs and/or drugs trade, or to decline a request for a permit when it might be used for illegal activities.
    To implement these measures, the local government is highly dependent on (information provided by) the police. At this moment we do not have much information about this cooperation between local government and the police in the management of crime and disorder. This paper is based on an empirical study concerning this issue. It shows that the inter-organizational cooperation between local government and the police may differ strongly, however this cooperation still often depends on central factors and circumstances. An important factor is the (growing) distance between the police and local government in regard to the local approach of problems of crime and disorder. A significant number of local police officers concentrates mainly on the maintenance of law and order by criminal law enforcement instead of the implementation of administrative measures. As a result, local government is often unsatisfied about the contribution of the police. For example, the quality of the information provided by the police is often perceived as insufficient. In some cases local governments try to diminish the degree of interdependency with the police and to strengthen their own position in the local safety domain.

    During the recent ‘refugee crisis’, governments have been confronted with various problems concerning asylum reception. In several locations in the Netherlands, as well as elsewhere in Europe and beyond, new local forms of experimenting around the issue of asylum reception have begun. One example is Utrecht’s ‘Plan Einstein’. In Overvecht, a district of the city, an office building has been converted into an asylum shelter, where 400 asylum seekers live together with 38 non-refugee youngsters from Utrecht. The Centre runs courses and activities, offered to both asylum seekers (including those who do not yet have a residence status) and local residents. Employing the concepts of ‘multilevel governance’ and ‘experimental governance’, this article indicates why this initiative was able to be realized at this location and at this time.

    Dutch mayors are confronted with various crises differing from a deadly incident with a monster truck to societal unrest due to convicted sex offenders returning to local society. This article presents the results of a research about the role of the mayor in so-called ‘youth crises’. The ‘big decentralization operation’ of January 1, 2015 resulted in new tasks and responsibilities for local governments regarding youth care. This research focuses on the implications of this decentralization for the leadership style of the mayor when a youth related crisis causes societal unrest. The way in which mayors deal with such a crisis was studied by means of in-depth interviews and a vignette study before and after the decentralization. This research concludes that the leadership style of the mayor did not change after the decentralization. Mayors consistently show two dominant leadership styles when managing a youth crisis: ‘First Civilian’ and ‘Peer Governor.’ As a ‘First Civilian’ the mayor’s crisis management actions focuses primarily on the community and the affected family. The style ‘Peer Governor’ is all about gathering relevant information and consultation with various partners, such as youth care organizations and aldermen. More interestingly, the results show that decentralization of youth care redefines the relationship between the local alderman responsible for youth care and the mayor as a crisis manager safeguarding local order and public safety. This relationship is currently under construction and could grow either competitive or fruitful.

    On 1 January 2009, the Dutch Temporary Restraining Order Act (Wth) entered into force. This act allows mayors to impose a ten-day restraining order (which may be extended to 28 days) on (potential) perpetrators of domestic violence, which prohibits these perpetrators from entering their own house and contacting their partner and/or children. During the restraining order everyone involved (evicted persons, those who stay behind and children) is offered a range of support and intervention measures. The law requires that within five years after its entry into force the Dutch parliament is informed of the effectiveness. To this end, a study was conducted between September 2011 and August 2013. The aim of this impact assessment is to gain insight in the effectiveness of the restraining order and the support services that are connected to it. The study was designed as a quasi-experimental study with an intervention group (restraining orders) and a control group (similar situations in which no restraining order was imposed). The study shows that the restraining order is associated with less incidence of new domestic violence. After imposing a restraining order new domestic violence occurs less frequently, and in case it does occur, fewer incidents occur than in (comparable) situations where no restraining order was imposed. The main explanation for the correlation found between the restraining order and the lower incidence of new domestic violence seems to lie in the support that is offered after the imposition of a restraining order. Moreover, the support seems to be more effective in the more serious cases than in the lighter cases. The degree in which antecedents of the evicted person are present and whether or not the evicted person is criminally prosecuted are not related to a lower degree of repeated domestic violence.

    The theme of governing anti-social behaviour and incivilities in the public space became more important on the policy and research agenda over the last twenty years. This article describes the law on incivilities in Belgium, namely the ‘administrative communal sanctions’ (GAS). This law is studied in a broader context of contemporary crime control and its organizing patterns. The development of the politics of behaviour can be explained by different characteristics of the period referred to as the late modernity. In the dissertation ‘A culture of control?’ (Devroe 2012) we studied the application and the concrete strategies behind the governance of incivilities on a national and on a city level. The incivility law broadened the competences of the Mayor and the city council especially in the completion of anti social behaviour and public disorder problems in his/her municipality. Instead of being dealt with on a traditional judicial way by the police magistrate, the Mayor can, by this law; himself lay on fines until maximum 250 euro. We mention ‘city republics’ as this punitive sanction became a locally assigned matter, which means that one municipality differs from another in their ‘incivility policy’. Due to the split up of competences of the Belgian state arrangements of 1988, each municipality finds itself framed in different political and organisational executive realities. In this view, Mayors can be called ‘presidents’ of their own municipality, keeping and controlling the process of tackling incivilities as their main responsibility and determining what behaviour had to be controlled and punished and what behaviour can be considered as normal decent behaviour in the public space. Problems of creating a ‘culture of control’, creating inequality for the poor, the beggars and the socially ‘unwanted’ can arise, especially in big cities.

De preventieve inzet van het tijdelijk huisverbod bij dreigend huiselijk geweld

    On January 1, 2009 the Temporary Restraining Order Act entered into force allowing mayors to impose a ten-day restraining order on potential perpetrators of domestic violence. This restraining order, which may be extended to 28 days, prohibits the perpetrator from entering his or her house as well as from contacting the persons staying behind in the home (partner, children, or other members of the household). In order to impose a temporary restraining order, risk factors relating to the perpetrator, the incident, and the family have to be assessed using a domestic violence risk assessment tool (RiHG).The immediate cause to introduce the Act was to enable mayors to take action in situations that, before, would not have given police just cause to intervene because no offences had (yet) been committed. However, evaluations show that temporary restraining orders are mainly imposed in conjunction with criminal proceedings. Yet, researchers suggest that the temporary restraining order may be imposed as a truly preventive measure in a large amount of situations that until now have not been considered (for instance, situations that have not escalated into physical violence). This article examines whether such preventive restraining orders exist within a sample of imposed orders and if so, what characteristics they share.Results show that truly preventive restraining orders are extremely rare. Closer inspection of cases that according to the available risk assessment were not notably violent showed that most of these cases could not be regarded as cases of truly preventive restraining orders. The discussion of the article focuses on the implications of these results for the suggestion that a large number of situations could be suitable for imposing a preventive restraining order.

    Lately, mayors’ powers for maintaining public order and safety have been considerably extended, and even more powers are in preparation. These powers must enable the mayor to act quickly against public order disturbances and security threats. The novelty is that the mayor may conditionally use and exercise these new powers preventively against groups of rioters. Their freedom of action and their privacy can also be considerably curtailed. This means these powers have to be used carefully and reluctantly. If the mayor overdoes the crimefighter role, he/she may lose the public’s confidence.
