Prisoners often encounter multiple barriers when returning to society, resulting in higher risks of recidivism. To overcome these barriers, prison-based and community-based professionals assist with preparation for release. Prison-based professionals, such as the case manager and mentor, screen and monitor the problems regarding work and income, housing, healthcare, financial debts and valid identification. Community-based professionals, such as municipal officials, parole officers, healthcare professionals and volunteers, can provide additional and specialized help. First, this research discusses the current policy of the Dutch Custodial Institutions Agency (DJI) and the role of different types of professionals. Second, it presents a nationwide picture of the extent to which prisoners report contact with prison-based and community-based professionals, and to what degree prisoners appreciate this contact. The results are specified for various types of regimes and time served and are based on 4308 prisoner surveys of the Dutch Prison Visitation Study (DPVS), part of the Life in Custody Study (LIC-study). It turns out that most prisoners seem to be in close contact with prison-based professionals and that prisoners positively value this contact. However, contact with community-based professionals is limited and prisoners are somewhat dissatisfied about their contact with parole officers and municipal officials. Furthermore, the amount of contact differs across various types of regimes and time served. In particular, individuals who recently entered prison report less contact. To conclude, policy implications will be discussed. |

Convict criminology draws from personal experience of imprisonment to offer critical criminological perspectives on punishment and prisons. In this article I discuss how some of these are aligned with questions of narrative and post-colonial perspectives in criminology. I use autoethnographic vignettes to communicate the experiences of imprisonment that inform the development of convict criminology, and I explore their relationship to narrative criminology’s interest in personal stories. |

This article explores the intersection of two criminological perspectives—cultural criminology and narrative criminology. Taking inspiration from Mills and Fleetwood’s article, ‘Prepping and verstehen: A narrative criminological perspective’, where the authors contend that stories complement the pursuit of criminological verstehen, this article draws attention to other ways in which cultural criminology and narrative criminology are imbricated, taking notice of commonalities in cultural criminology’s analysis of media looping and narrative criminology’s identification of cycles of storytelling practice and lived experiences. A consideration of Donald Trump’s attempts to control narrative is used to develop an argument regarding cultural criminology’s and narrative criminology’s joint questioning of linear sequencing and mutual recognition of circulating fluidity |

As an approach to law and justice, restorative justice focuses squarely on addressing human needs; it acknowledges the equal dignity of all parties, irrespective of their role in the harmful act; it accepts responsibilities for addressing the disadvantages or inequities that crime has bequeathed to victims and that often have contributed to offending on the part of the perpetrator; and it derives its creative potential from the shared vulnerability and reciprocal exchange of concern that occurs through respectful face-to-face encounter. Therefore restorative justice constitutes a relational justice of care. |

This contribution seeks to bring together three themes in a descriptive and exploratory manner: (a) community service orders, (b) traffic offences and (c) restorative justice; the Dutch situation is central. To this end, the Dutch legal regulation regarding community service orders is first explained. Attention is also paid to existing empirical research on the effectiveness of community service orders in terms of reduction of recidivism (section 2). Furthermore, the sanctioning of traffic offences is discussed as well as the consequences for this of the current bill that seeks to sharpen criminal liability for serious traffic offences (section 3). Subsequently, it is examined which restorative justice provisions or modalities are available and how restorative community service orders are and can be designed (section 4). Finally, I describe my ideal when it comes to the sanctioning of traffic offences in the form of a continuum in which a special role is reserved for restorative community service orders (section 5). The contribution ends with a conclusion (section 6). |

In the past twenty-five years, a lot of attention is paid to a more victim-aware and restorative justice focused policy in prisons in Belgium and The Netherlands, striving for a restorative culture and climate in the institutions (among prisoners and staff) and for more restorative practices like victim-awareness programs and mediation. The focus is primarily on the prison structure and culture, striving to create a more restorative prison culture and climate in the institutions. In this article we argue for a shift from this system-focused pursuit of ‘estorative detention’ to the restorative reintegration of prisoners at the individual level, and by this supporting their desistance from crime. We present a conceptual framework for restorative reintegration in and outside prison as a strengths-based approach, with attention to the structural and individual elements that supports their desistance from crime. |

Previous research on intergenerational continuity of crime is primarily focused on transmission from fathers to children. In this article, we aim to give insight in the role of mothers in (the prevention of) continuity of organized crime. The results of our explorative study on 25 organized crime offenders based in Amsterdam and their partners and children, show that parenting skills and norms and values of mother seem to have an important role in both the intergenerational continuity of organized crime and the prevention of the transmission. |

De psychische gezondheid van gedetineerden in België en Nederland: een systematisch overzicht |
Tijdschrift | Tijdschrift voor Criminologie, Aflevering 1 2019 |
Trefwoorden | prison, mental disorders, distress, substance use, suicide |
Auteurs | Drs. Louis Favril en Dr. Anja Dirkzwager |
SamenvattingAuteursinformatie |
A well-established body of epidemiological research suggests that the prevalence of mental health problems (mental disorders, psychological distress, and substance use) in prisoner populations far exceeds that of non-incarcerated people in the surrounding community. Poor mental health in prisoners is associated with multiple adverse outcomes, including suicidal behaviour. In the past decade, novel data in Belgium and the Netherlands have been published on this topic, which have not been synthesized to date. The aim of the current systematic literature review was to provide an up-to-date overview of the mental health of prisoners in Belgium and the Netherlands. Based on 24 empirical studies conducted in 1997-2018, the authors conclude that people with mental health problems are overrepresented in Belgian and Dutch prisons, providing both a challenge and a public health opportunity to address the mental health care needs of a vulnerable and hard-to-engage population. Investing in the prevention and treatment of mental health problems not only benefits the prisoners concerned, but equally, society at large. |

Gevallen helden van bedrijfsleven en openbaar bestuurDe ‘fall from grace’ van witteboordencriminaliteit |

Trefwoorden | white-collar crime, status degradation, sanctioning, executives, punishment |
Auteurs | Prof. dr. Wim Huisman en Drs. Dennis Lesmeister |
SamenvattingAuteursinformatie |
In criminology, it is generally assumed that the high social status of white-collar offenders prevents them of being targeted by criminal law enforcement. But when they do, they suffer greater social and economic damage because of this high social status. Empirical research on the consequences of criminal law enforcement and conviction for white-collar offenders is scarce, and limited to the US and the UK. This paper used biographies of convicted former executives in business and public office in the Netherlands, to analyse these consequences and the process of the ‘fall from grace’ of white-collar offenders. The consequences are described in four life-domains: health, the private sphere, the occupational sphere and the social sphere. The results show that Dutch executives, in line with findings for the Anglo-American white-collar offenders, experience status degradation and suffer much collateral damage of criminal law enforcement. After the initial horror of imprisonment, they endure prison life fairly well. Individual competences and remaining social and economic capital enable them to return to normal life, although they cannot return to pre-conviction levels of social status. |

Internationally, research on the experiences of white-collar offenders with the criminal justice system and the consequences of prosecution and conviction is scarce. Such research becomes more relevant, as the response to white-collar crime has become more punitive and more offenders are convicted. This paper presents the experiences of the co-author as a convicted white-collar offender as an autobiographical case-study. In this cases study, the consequences and experiences during four phases (investigation, prosecution, sentence-execution and post-sentencing) are analysed on four live-domains: health, private life, social life and professional life. Such an approach could be a blueprint for further and more systematic study of the experiences with and consequences of criminal justice for white-collar offenders. Such study can shed light on the effects and actual achievement of goals of punishment for white-collar crime. |

Het verloop van de partnerrelaties van gedetineerden tijdens en na detentie |
Tijdschrift | Tijdschrift voor Criminologie, Aflevering 3 2018 |
Trefwoorden | detention, partnerships, relationship quality, longitudinal |
Auteurs | Anne Brons MSc, Prof. dr. Paul Nieuwbeerta en Dr. Anja Dirkzwager |
SamenvattingAuteursinformatie |
In the current criminological literature surprisingly little is known about the development of partnerships of detainees during and after detention. In particular, it is unknown to what extent existing differences in the relationship quality at the start of the detention period continue. Therefore, this study examined how the partnerships of detainees developed by using data from the Prison Project. This is a longitudinal study in which 747 detainees with a partner were interviewed at various moments during detention and six months after detention. The results show that bad partnerships at the beginning of detention remain in general bad or end during and/or after detention, while the average to good relationships remain the same. |

This study explores the influence of police detention centres environments on police suspects’ psychological wellbeing and sleep problems. Results showed that suspects detained in a police cell experience a decreased psychological wellbeing, that they sleep poorly, and that their psychological wellbeing is related to sleep problems. Implications for police detention in relation to suspects’ psychological wellbeing and sleep problems, as well as directions for future research on police detention centre environments, are discussed. |

Tijdschrift | Tijdschrift voor Herstelrecht, Aflevering 4 2017 |
Trefwoorden | Desistance, restorative justice, Mediation, Prison |
Auteurs | Bart Claes en Joanna Shapland |
SamenvattingAuteursinformatie |
Over the last twenty years, research on desistance from crime and on restorative justice has grown rapidly and both have emerged as exciting, vibrant, and dynamic areas of contemporary criminological interest. While the implementation of restorative justice practices in Europe has been essentially victim-oriented, there has always also been an emphasis on including the moral and social rehabilitation of the offender. This more offender-centred approach to restorative justice and its practices is not limited to the evaluation of its ability to reduce crime, but is to be seen within the connection between reparation, resettlement (reintegration into the community after sentence), and desistance from crime. This article examines, from a broad perspective, but including some data from research on victim-offender mediation in prison, the capacity of restorative justice interventions to impact positively on offenders’ likelihood of stopping committing criminal offences. |

Auteurs | Peter Nelissen |
SamenvattingAuteursinformatie |
In this contribution, the justification of restorative practices in prison is first discussed from a normative perspective. On the basis of Lippke’s retributive theory of imprisonment it is argued that modern, humane retributive sanctioning entails an obligation to provide prisoners with opportunities to engage in restorative practices. Second, restorative practices in prison are examined from the perspective of possible impacts on the empowerment of prisoners and their experience to move away from crime and do good. Finally, it is argued that in order to yield positive effects, restorative practices in prison need to be supported by a safe and healthy living environment. |
