Expert Judgement geeft crisisteam continu ­inzicht in effectiviteit van maatregelen

    Crisis teams from waterauthorities want to have insight into the current risks for the area. The ‘Continuous insight’-method is used by them to monitor the risks of drought and high water and to draw up what-if scenarios for training and exercise. Various cases have now shown that Expert Judgment can be used to gain a clearer picture of the effectiveness of measures and to take a more balanced decision. The Expert Judgment method has been tested and applied by a group of international experts as part of the EU project DRIVER +. During an extreme situation, the crisis team may encounter dilemmas. The engaged group of experts follows a fixed procedure to provide advice to reduce flood risk evacuate to prevent loss of life.
    Each expert makes his own assessment of the effect and impact of the measure envisaged. Each expert provides an explanation of the individual assessment. Then, under the guidance of a process supervisor, the experts discuss individual assessments and exchange arguments. This can lead to new insights. Each expert makes his own assessment again. The result is a probability distribution of estimates and an expected value. This expert assessment of the measure is taken to the crisis team, so that the chance of success and the assessment of the consequences of the proposed measure can be adjusted. The crisis team can take the decision immediately afterwards.
    By following this procedure risk information is made visible. By linking expert knowledge with observations, a better substantiated expectation can be drawn up. According to the participants in the international meetings, the Expert Judgment method in combination with ‘Continuous insight’ helps to make better informed and faster choices. The method fits within the existing crisis management structure. The next step is to implement this method in the day-to-day affairs of crisis management.

    Traditionally, the mayor has an important role as a citizen’s father and as a maintainer of public order. In the context of the so-called ‘undermining’ criminality, the mayor has been increasingly empowered with new legal instruments to combat undermining criminality. Some mayors see themselves as a sheriff. However, in the Dutch Municipal Act, the mayor only has a task of maintaining the public order. How does this task relate to combating undermining criminality? What is the role of the mayor in the combat of undermining criminality? Nowadays, there is no legal basis in the Dutch Municipal Act to equip the mayor with crime-fighting duties. This article proposes to equip the mayor with a legal duty as a crime fighter.

    This article discusses the concepts of society and community involvement as they appeared in the articles of the Dutch-Flemish Tijdschrift voor Herstelrecht (Journal of Restorative Justice) during last 20 years. It shows how the journal from its very beginning adopted a strong focus on criminal justice reform, although restorative practices within the community occupied a considerable space in the consecutive volumes as well. Studies on restorative justice programmes in Belgium and The Netherlands, such as victim-offender mediation and family-group conferences, revealed a predominant orientation on interpersonal relationships stressing the role of the community of care. In the same sense, also community mediation and other community oriented restorative practices focus on the personal well-being of people and the improvement of personal and social relationships. Hence, both theory and practice face two important challenges in developing restorative justice: (1) which role to give to a larger community and how to operationalize its involvement, and (2) how to deal with underlying causes of crime and social-structural injustices? Referring to European action-research projects and to conceptual models developed outside Europe, a case is made for designing restorative justice methodologies and programmes involving civil society in a more encompassing way and linking micro to macro societal levels. Developing strategic alliances with new social movements could be the way forward.

By rejecting anthropocentric worldviews, this article critically examines anthropogenic defaunation and the causes and consequences of the coronavirus pandemic from a green criminological perspective.

    Young people’s delinquent behavior remains a social problem of concern to parents, local residents, teachers, police officers and administrators. With respect to effective interventions, the dominant focus is on ‘what works’. Relatively little is known about ‘who works’. In this study, based on a survey of 679 vmbo-pupils, it was investigated to what extent receiving ‘sternness with love’ from a professional may contribute to mitigating delinquency. For this research, unique graphically supported measuring instruments were developed that enable participants of the target group – including those who suffer from mild intellectual disabilities – to independently fill out the questionnaire. The results based on regression analyses suggest that there is no support for the supposed contribution of the interaction between sternness and love or of the three-way interaction between delinquent friends, sternness and love in explaining the variance of delinquent behavior. The results further show that having delinquent friends is related to participants’ delinquency. The results of these analyses also suggest that the relevant professional’s approach with ‘sternness’ or with ‘love’ moderates the relationship between delinquent friends and committing theft.

    Citizens investigating crimes themselves is a growing trend, because of democratization of information (e.g. social media), tools (e.g. apps) and knowledge (e.g. explanimations on YouTube). More and more citizens do their own research as modern Sherlocks. The police has to handle these trends in line with participant wishes and the law, but does not yet have concrete tools to do so. This article explores how the police participate in contemporary citizen criminal investigations, including the difficulties and benefits experienced. The obtained insights of the presented research serve as guidance, which can help police officers understand how to participate with citizens who have started, or want to start, a criminal investigation. The presented model explains how police can use it to better guide and stimulate, but also stop or protect citizens in their investigative activities. An app with professional guidance was piloted in four police units to participate with citizens that do their own research and learn from expectations and experiences. Citizens need guidance, but more importantly expect a certain degree of reciprocity in collaborating with police in criminal investigations.

    This study describes how penal protection orders contribute to victim perceptions of safety, drawing upon data collected via a victim survey (n=101). Perceived victim safety is explored based on the factors of personal vulnerability, procedural justice, and experiences with compliance and enforcement. Results show that more than half of the victims in this study does not feel safer because of the protection order. The effects of the orders are even weaker for feelings of relaxation and feelings of anger about the situation. An increase in perceptions of control over the situation appears to be the most important predictor of an increase in feelings of safety and a decrease in feelings of anger, but is unrelated to an increase in feelings of relaxation. The effect of procedural justice differs per outcome measure. It is associated positively with increased feelings of safety, but negatively with decreased feelings of anger because of the protection order. The positive association with feelings of safety is partly indirect via personal vulnerability. Findings result in various suggestions for future research.

    Crises and disasters can seriously affect the health, well-being and functioning of the people involved. From a governance perspective, it is important that public leaders and crisis managers are aware of what the psychosocial dimension of crisis management entails. The objective of the current contribution is to analyse dilemmas and challenges described in evaluations of crises that occurred in the Netherlands between 2012 and 2016. Thirty-six evaluations were analysed against the background of a theoretical framework combining crisis leadership tasks and psychosocial support principles along the crisis life cycle. Public leaders and crisis managers had to deal with classical crisis problems concerning coordination, collaboration and communication. Other recurring themes were linked to social media, and the tension between tasks such as meaning making (social recognition), account giving and learning. Moreover, the analysis illustrates how difficult it is to gain insight into the needs, problems and vulnerabilities of the individuals and groups affected.

    This article presents and critically discusses a new Recommendation on restorative justice (CM/Rec(2018)8) that was adopted on 3 October 2018 by the Committee of Ministers of the Council of Europe. This new regulation builds on the previous Recommendation No. R(99)19 on mediation in penal matters and recommends the governments of the 47 member States of the Council of Europe the adopt and implement the principles of restorative justice as described in the Appendix of the new Recommendation. These guidelines apply to national authorities and national agencies in general, and to judges, public prosecutors, police, prisons, probation, juvenile justice agencies, victim support services and restorative justice services in particular. The article presents the origins of the Recommendation, its contents and its meaning for restorative justice developments in Europe and beyond.

    This article is based on research into the use of mediation in criminal cases at ZSM Midden-Nederland. It focusses on the question how referrals to mediation can be optimized. The research shows that there is much room for improvement and a broader deployment of mediation. Lack of knowledge of the criminal justice partners involved, leads to misconceptions about the mediation process, about which institution should be deployed, and about the (in)suitability of cases for mediation. This lack of knowledge seems to be greatest among the police, while they play an important role within ZSM. Moreover, Victim Support Netherlands has a dominant role in the choice whether or not to refer to mediation. The overall conclusion is that mediation is not yet sufficiently anchored in the criminal justice partners’ system.

Starting with an overview of the nature and severity of political and administrative corruption, the focus shifts to relevant developments in the control and prevention of corruption, partly addressing the causes of the phenomenon.

    Internationally, research on the experiences of white-collar offenders with the criminal justice system and the consequences of prosecution and conviction is scarce. Such research becomes more relevant, as the response to white-collar crime has become more punitive and more offenders are convicted. This paper presents the experiences of the co-author as a convicted white-collar offender as an autobiographical case-study. In this cases study, the consequences and experiences during four phases (investigation, prosecution, sentence-execution and post-sentencing) are analysed on four live-domains: health, private life, social life and professional life. Such an approach could be a blueprint for further and more systematic study of the experiences with and consequences of criminal justice for white-collar offenders. Such study can shed light on the effects and actual achievement of goals of punishment for white-collar crime.

    The Dutch Regional Fire Services collectively aim at preventing fire, casualties and damage. The main activity is informing citizens about fire risks and the appropriate measures they can take. From both a political and social perspective, it is valuable to know what the return of the Community Fire Safety program is. One way to chart the return of the program is a comparison of the cost of, and society’s willingness-to-pay for, the program. To estimate this willingness-to-pay, this article applies the contingent valuation method to a national representative sample of 806 Dutch citizens. The results show that willingness-to-pay of an average Dutch household is estimated to be between € 25.00 and € 35.67 per year provided the Community Fire Safety program improves the fire safety by 10%. At the national level, this amounts to 200 – 270 million euro annually. This value is seven to ten times more than the approximate costs of the current Community Fire Safety program.

    Following a crisis, questions are often raised about how this crisis could have happened and whether someone is to be blamed for the crisis or its bad management. The blame game can become fierce as actors try to avoid, shift or mitigate blame in order to stay in office. In 2014, a festival took place in Haaksbergen where a monster truck drove into the audience, killing three people and injuring many others. Not enough safety measures had been taken to prevent the tragedy. Many actors were to blame for that, including the local authority which had granted the permit. Other actors blamed for the events were the mayor, the monster truck driver, and the organization organizing the festival. In the end, the mayor of Haaksbergen resigned. Instead of becoming more accommodative in his response as his blame levels increased, the mayor continued to be quite defensive, stating that the permit would be granted again – even with today’s knowledge. As one council member stated it, one cannot defend something which cannot be defended.

    This contribution reports on a delimited part of a larger, exploratory study, the main question of which was: How do aldermen perceive threats, what are their behavioral intentions and what is the influence of threats on the process and the outcome of decision-making? This question was answered with the help of Q-methodology, semi-structured interviews and case studies. This article discusses the results of the Q-methodology and the semi-structured interviews. The case studies will be reported separately later on. Through the Q-methodology three patterns in perception were found in dealing with threats: ‘combative and decisive’, ‘vulnerable and thoughtful’ and ‘down-to-earth and accepting’. The interviews show that it usually concerns instrumental threats that are deliberately used to influence decision making, which usually take place in the private sphere and vary from verbal aggression to physical violence. Most threats come from individuals, but some come from groups, in some cases there is a relationship with criminals. In the cases reviewed, the consequences in the private sphere are far-reaching, there are indications for the influence on public functioning (from hardening to great caution). There is almost always a report, a fuss in the media can affect the authority of the official.

    On 1 April 2014, the Dutch Act on Adolescent Criminal Law entered into force. With this law, the age limit in article 77c of the Criminal Code, which allows for the application of juvenile criminal law to young adults, was stretched from 21 to 23 years. In this article stock is taken of the developments that have taken place in the four years after the introduction of this law. In practice, article 77c Criminal Code is increasingly being applied in case of young adult suspects, however still to a little extent. Among others, this has to do with confusion about the target group that qualifies for the adolescent criminal law. The access to and justification for the application of the law show a very diverse picture.

    In the current criminological literature surprisingly little is known about the development of partnerships of detainees during and after detention. In particular, it is unknown to what extent existing differences in the relationship quality at the start of the detention period continue. Therefore, this study examined how the partnerships of detainees developed by using data from the Prison Project. This is a longitudinal study in which 747 detainees with a partner were interviewed at various moments during detention and six months after detention. The results show that bad partnerships at the beginning of detention remain in general bad or end during and/or after detention, while the average to good relationships remain the same.

    The article provides a description of the issues and considerrations facing Flemish victim-offender mediators on the job. Instead of focusing on professinal risks and caveats present within victim-offender mediation, the authors concentrate on the positive concept of ‘enabling high quality mediations’. A description is given of the frames that are felt to be helpful towards mediators, stressing the need to act with due creativity if needed. Moreover, in order to enable high quality victim-offender mediations, conditions need to be met, more specifically a common acknowledgment of the need for teamwork. The latter implies conditions such a sound legal basis, a deontological code, formal procedures and constant interaction with practice.
