Een positief criminologische visie op radicalisering

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 1 2020
Trefwoorden positieve criminologie, polarisatie, staircase model, continuum of violence, typologie van geweld
Auteurs Anneke van Hoek
SamenvattingAuteursinformatie

The first part of this article presents three academic theories on radicalisation: Moghaddam’s staircase model of radicalisation, Galtung’s typology of violence (direct, structural and cultural violence), and Staub’s psycho-educative approach. The core of Staub’s approach is that in conflict periods, people can be psychologically manipulated through their own fears, insecurities and unresolved traumas. Therefore, psycho-education and the empowerment of people are highly necessary to stimulate citizens to function as active bystanders when they are confronted with wrongdoing. In the second part of this article some promising approaches are presen‍ted which might increase personal and social resilience. The role of narratives in understanding experiences and changing identities is discussed. Radio La Benevolencija in Rwanda uses the power of storytell‍ing to stimulate resilience among the population. In the concluding paragraph a two-pronged strategy on radicalization is presented. This positive criminological perspective aims to promote active bystandership, participation and resilience.

SamenvattingAuteursinformatie

This contribution provides an overview of the legal and criminological research into the decision following the determination of a supervisor that the conditions of a freedom-restricting sanction are not met. It is an important decision, on the one hand because it can result in a more severe sanction than was initially imposed, on the other hand because a decision that is perceived as unfair can influence the extent to which suspects and convicts are willing to comply with conditions, and recidivism. Yet little research has been conducted into this decision. The legal safeguards with which it is accompanied are lagging behind those of the original sentencing decision. Undeserved according to penitentiary experts. The scarce empirical research shows that decision-making involves many different layers and that the actors involved have different goals, ranging from deterrence and emphasizing the credibility of the system to the successful completion of the sanction. Even in countries where regulations have been tightened considerably, the discretionary power of direct supervisors, such as employees of the working project or therapists, is still large. This raises the question to what extent the final decision maker (usually a judge) still has sufficient room to make an independent decision.

Prepping and verstehen

A narrative criminological perspective

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2019
Trefwoorden Verstehen, narrative, prepping, experience, ethnography
Auteurs Michael F. Mills en Jennifer Fleetwood
SamenvattingAuteursinformatie

Talk, chat, and stories are ubiquitous in ethnographic research. Engaging with the recently burgeoning literature around narrative criminology, this article argues that considerations of stories and storytelling can add much to cultural criminologists’ pursuit of ‘criminological verstehen’ (Ferrell, 1997). In doing so, we focus on one case study: ethnographic research grounded within the USA’s contemporary ‘doomsday’ prepping subculture. The article considers the value of attending to narrative during the pursuit of verstehen at two levels. First, we address the importance of storytelling upon entry to the ethnographic field – drawing attention to how the narratives researchers share, and their respect for certain stories, can facilitate deep and experiential access to stigmatized fields of activity (such as prepping). Second, we explore how narrative remains in play during immediate experiences. In particular, we argue that fleeting excitements featured in prepping lifestyles are often shaped by the significance of the ‘moments’ in which they occur to numerous personal narratives. We therefore contend that, for ethnographers interested in verstehen, a consideration of narrative offers a means to expand and deepen empathetic appreciation of participants’ worldviews and activities.

Nieuwe conceptuele landkaart naar succesvol re-integreren

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 2 2019
Trefwoorden gedetineerden, re-integratie, herstelgerichte detentie, strength-based benadering
Auteurs Bart Claes
SamenvattingAuteursinformatie

In the past twenty-five years, a lot of attention is paid to a more victim-aware and restorative justice focused policy in prisons in Belgium and The Netherlands, striving for a restorative culture and climate in the institutions (among prisoners and staff) and for more restorative practices like victim-awareness programs and mediation. The focus is primarily on the prison structure and culture, striving to create a more restorative prison culture and climate in the institutions. In this article we argue for a shift from this system-focused pursuit of ‘estorative detention’ to the restorative reintegration of prisoners at the individual level, and by this supporting their desistance from crime. We present a conceptual framework for restorative reintegration in and outside prison as a strengths-based approach, with attention to the structural and individual elements that supports their desistance from crime.

Auteurs Peter Nelissen
SamenvattingAuteursinformatie

In this article the development of a restorative justice probation practice is discussed from the perspective of the restorative justice principle of the inclusive community and the contribution of probation volunteers to the reintegration of (ex-)offenders through specific restorative justice intervention strategies. It is shown that in penal policy of the past decades the penal welfare-model and the aim of reintegration of ex-offenders has been overshadowed by a more utilitarian, punitive and management logic of criminal justice. As a result, the reintegration and social inclusion of ex-offenders has become a rather neglected area and, in the current liberal-democratic state, offenders face social conditions in which it is very hard to turn their life around. In addition it is suggested that both in mainstream and in restorative justice interventions, achievement of the goal of reintegration is often problematic or absent. Moreover, this lack of opportunities for connection may undermine and reduce the effects of interventions, including those with a restorative justice approach. Probation services that use specific restorative justice intervention strategies guided by both professionals and probation volunteers might contribute to a more active, inclusive role of the community and society in the reintegration of ex-offenders.

Crimineel gedrag over de levensloop én over generaties: de rol van het gezin

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2019
Trefwoorden intergenerational continuity, Criminal behavior, Family, Family relations, Generations
Auteurs Dr. Veroni Eichelsheim
SamenvattingAuteursinformatie

In criminology, explanations for engagement in externalizing or criminal behavior are often found within the direct (social) environment of the individual. More specifically, family functioning, the quality of family relations and parenting strategies during childhood and adolescence are found to be related to the development of externalizing problems or criminal behavior over the life-course. Although less well studied, the opposite might also be true: externalizing problems or delinquency during childhood and adolescence may in turn also affect some important (family-related) transitions over the life-course, such as engagement in romantic relationships, the transition to parenthood, parenting strategies and broader family functioning. Not surprisingly, in life-course criminology there is increasing attention for familial similarities in externalizing and delinquent behavior. What underlies intergenerational continuity of criminal behavior? Under which circumstances behavior is continued over the course of generations? What is the role of the family? What is needed to break intergenerational cycles and facilitate earlier and more effective interventions? In this article, a literature review is provided on the role of the family in intergenerational continuity of externalizing or criminal behavior over the life-course and across generations.

SamenvattingAuteursinformatie

This article is based on research into the use of mediation in criminal cases at ZSM Midden-Nederland. It focusses on the question how referrals to mediation can be optimized. The research shows that there is much room for improvement and a broader deployment of mediation. Lack of knowledge of the criminal justice partners involved, leads to misconceptions about the mediation process, about which institution should be deployed, and about the (in)suitability of cases for mediation. This lack of knowledge seems to be greatest among the police, while they play an important role within ZSM. Moreover, Victim Support Netherlands has a dominant role in the choice whether or not to refer to mediation. The overall conclusion is that mediation is not yet sufficiently anchored in the criminal justice partners’ system.

Terrorism could be regarded as an extreme type of (violent) criminal behaviour. Against this background, there is much to gain if criminological attention would be extended to terrorism. In this overview, the authors describe how and to what extent criminological theories may provide a significant contribution to underlying causes of terrorism. Previous criminological contributions to the field of terrorism have primarily taken a theory-extended approach, including routine activity theory, rational choice theory and strain theory. However, so far such studies lacked empirical data. Further, to this day, not much is known about the empirical applicability of other criminological theories, including desistance theories, which warrant particular attention. In order for criminology literature to contribute effectively to our understanding of terrorism and to pursue better counter-terrorism policies, empirical evidence should first be obtained. In this way, terrorism researchers, in close collaboration with criminologists, can deepen our theoretical and empirical understanding of this relatively underexplored field.

Vechter buiten de ring; Narratief en biografie

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 4 2017
Trefwoorden Narratieve criminologie, Vechter, Biografie
Auteurs Frank van Gemert
SamenvattingAuteursinformatie

The most important mechanism for crime prevention is just the presence of guardians. Some counter arguments against this thesis are discussed and rejected. By manipulating the presence of guardians it is possible to influence the level of prevention. It is argued that a large scale evaluation of such measures is wanted.

Positieve effecten op stoppen met misdaad?

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 4 2017
Trefwoorden Desistance, restorative justice, Mediation, Prison
Auteurs Bart Claes en Joanna Shapland
SamenvattingAuteursinformatie

Over the last twenty years, research on desistance from crime and on restorative justice has grown rapidly and both have emerged as exciting, vibrant, and dynamic areas of contemporary criminological interest. While the implementation of restorative justice practices in Europe has been essentially victim-oriented, there has always also been an emphasis on including the moral and social rehabilitation of the offender. This more offender-centred approach to restorative justice and its practices is not limited to the evaluation of its ability to reduce crime, but is to be seen within the connection between reparation, resettlement (reintegration into the community after sentence), and desistance from crime. This article examines, from a broad perspective, but including some data from research on victim-offender mediation in prison, the capacity of restorative justice interventions to impact positively on offenders’ likelihood of stopping committing criminal offences.

De cruciale rol van de bemiddelaar

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 4 2017
Trefwoorden Desistance, victim-offender mediation, restorative justice, criminal justice
Auteurs Ivo Aertsen en Katrien Lauwaert
SamenvattingAuteursinformatie

This article presents some of the results of a study in which 25 adult men were interviewed who took part in restorative mediation in the French speaking part of Belgium and were desisting from crime. Their narratives were used to find out whether participation in restorative justice influenced positively their journey towards desistance; if so, which factors in restorative mediation supported this change process and how these factors had been helpful. The results suggest that restorative mediation has the potential to contribute to desistance in a humble, but significant way. Core aspects of mediation supported mostly already started desistance processes and they were helpful in a mainly cognitive way. The authors propose to further investigate the specific and helpful ‘presence’ of mediators and to reflect upon the apparent absence in restorative mediation of practical follow-up support towards desistance.

Gevangenissen en herstel: reflecties over nut en noodzaak van een herstelgerichte detentiepraktijk

Trefwoorden Retribution, desistance, behavioural change, empowerment, remoralization

SamenvattingAuteursinformatie

In this contribution, the justification of restorative practices in prison is first discussed from a normative perspective. On the basis of Lippke’s retributive theory of imprisonment it is argued that modern, humane retributive sanctioning entails an obligation to provide prisoners with opportunities to engage in restorative practices. Second, restorative practices in prison are examined from the perspective of possible impacts on the empowerment of prisoners and their experience to move away from crime and do good. Finally, it is argued that in order to yield positive effects, restorative practices in prison need to be supported by a safe and healthy living environment.

In a vignette study, we investigated the extent to which factors may mitigate the relative ‘unattractiveness’ of one-time offenders as cohabitation partners. These factors include having a job, not having a criminal record and the amount of time that has passed since the offence was committed. This was done by asking students to advise a hypothetical person whether he or she should start cohabiting with his or her partner who had offended once. The factors of interest were systematically varied. Our findings showed a more positive cohabitation advice when the offender had committed the offence relatively long ago. Our findings also showed a more positive cohabitation advice when the offender was employed. This is an important finding, as this may indicate that being employed also helps ex-offenders getting their lives back on track with respect to cohabitation.

How could positive security policies take shape? On what kind of empirical research should these policies be based? And what sort of concepts would we need for this development? If the starting point is to understand safety as a positive notion, it seems wise to avoid the terms of war that are prevailing in current policy programs on security and public safety (fighting, frontline and city-marines). On the other hand some type of decisive jargon might be unavoidable when one sets out to have an actual impact on youth crime policies and policy makers. Is it possible to keep using some type of military terminology in research benefitting the development of positive security policies and still emphasize a positive composition? This dilemma has arisen in recent research activities on positive, street-oriented role models in response to Dutch problematic youth groups and youth at risk. De Jong argues that with the sensitizing concept of the ‘liaison officer’ it might be possible to encourage a positive change through applied social science.
