De toepassing van artikel 13b Opiumwet en de positie van de burgemeester

    In the reduction of undermining crime in the Netherlands, the role of local government has become more important over the past decade. One of the means used for this is Article 13b of the Opium Act (the Damocles Act). That has evolved from a way of closing down local dealer properties to a means of disrupting the criminal drug world. In this article we analyse the developments that the application of the article has gone through. We make an inventory of the actual use of the article in a region known as one of the hotbeds of subversive crime in the Netherlands, the region of West and Central Brabant. Finally, we will discuss the consequences that application of the article has for the position of the mayor. Does this lead to a mayorship in which this officer becomes more of a ‘sheriff’ and less of a mayor? We show that this is not the case.

Nevertheless, there is a heated scientific debat about the start of this era in history and the name ‘antropocene’in itself. In this contribution it is stated that that debate is helpful in raising important questions about the desatrous influence of mankind on live on this planet. Criminologists should take a stance and address these questions as well. This contribution includes a manifest that contains points for further action for criminologists.

    In this article we show how the concept of ‘institutional work’ can be used to study citizen participation in the field of security arrangements. Institutional work starts from the perspective of actors trying to influence security institutions, and not from the perspective of government (as concepts like the ‘participation society’ and ‘ladder’ do). As such, this dynamic concept can be a useful addition to the conceptual arsenal of security experts. By applying the concept to the case of the Voluntary Fire Brigade in nineteenth-century Utrecht (1879-1890) we show how institutional work can work in practice. Finally, we reflect on the contribution that institutional work can make to our understanding of citizen participation in the field of safety.

Expert Judgement geeft crisisteam continu ­inzicht in effectiviteit van maatregelen

    Crisis teams from waterauthorities want to have insight into the current risks for the area. The ‘Continuous insight’-method is used by them to monitor the risks of drought and high water and to draw up what-if scenarios for training and exercise. Various cases have now shown that Expert Judgement can be used to gain a clearer picture of the effectiveness of measures and to take a more balanced decision. The Expert Judgement method has been tested and applied by a group of international experts as part of the EU project DRIVER +. During an extreme situation, the crisis team may encounter dilemmas. The engaged group of experts follows a fixed procedure to provide advice to reduce flood risk evacuate to prevent loss of life.
    Each expert makes his own assessment of the effect and impact of the measure envisaged. Each expert provides an explanation of the individual assessment. Then, under the guidance of a process supervisor, the experts discuss individual assessments and exchange arguments. This can lead to new insights. Each expert makes his own assessment again. The result is a probability distribution of estimates and an expected value. This expert assessment of the measure is taken to the crisis team, so that the chance of success and the assessment of the consequences of the proposed measure can be adjusted. The crisis team can take the decision immediately afterwards.
    By following this procedure risk information is made visible. By linking expert knowledge with observations, a better substantiated expectation can be drawn up. According to the participants in the international meetings, the Expert Judgement method in combination with ‘Continuous insight’ helps to make better informed and faster choices. The method fits within the existing crisis management structure. The next step is to implement this method in the day-to-day affairs of crisis management.

    This article relates criminological research on youth delinquency to the social development of adolescents. Starting point is a goal-framing approach which assumes that young people aim for the achievement of two goals: status (‘getting ahead’) and belonging (‘getting along’). Peers form an important context for achieving these goals. Therefore, the role of delinquency in peer networks is examined: on the one hand, the extent to which delinquency contributes to peer status, and on the other hand, how delinquency contributes to the formation of network relationships and, vice versa, how network relationships influence adolescents’ delinquency. Finally, several directions for further research are discussed.

    Attempting to understand the Greek narrative of crisis, this paper examines the most prominent forms of violence that emerged in the period of acute economic recession and political upheaval in Greece namely structural, institutional and anti-institutional violence. This paper aims to highlight existing theoretical gaps and avoid common fallacies of the current body of knowledge. In contrast to some of the more common features of the discussion on violence, this note sets out to: a) acknowledge that violence is not necessarily a physical act, b) acknowledge that the outcomes of violence performances might not be physical either, c) specify and adequately distinguish agency and structural dynamics and d) address the cultural and contextual aspects of violence. Vital to this endeavor is to acknowledge, identify and understand the interactive relation between different forms of violence that emerge during the same period of time in a context in which conflict escalates.

    Crises and disasters can seriously affect the health, well-being and functioning of the people involved. From a governance perspective, it is important that public leaders and crisis managers are aware of what the psychosocial dimension of crisis management entails. The objective of the current contribution is to analyse dilemmas and challenges described in evaluations of crises that occurred in the Netherlands between 2012 and 2016. Thirty-six evaluations were analysed against the background of a theoretical framework combining crisis leadership tasks and psychosocial support principles along the crisis life cycle. Public leaders and crisis managers had to deal with classical crisis problems concerning coordination, collaboration and communication. Other recurring themes were linked to social media, and the tension between tasks such as meaning making (social recognition), account giving and learning. Moreover, the analysis illustrates how difficult it is to gain insight into the needs, problems and vulnerabilities of the individuals and groups affected.

The impact of mobile interviews on sensitive research with street-based sex workers

    This article draws on a piece of ethnographic research carried out with outreach workers in London working with street-based sex workers (SBSWs). The aim of the research was to determine the efficacy of the services offered to this hard-to-reach client group. The charitable organization has a long history (20+ years) working with SBSWs in the Kings Cross area; we evaluated their drop-in and outreach services for this client group, many of whom have high-level needs due to substance misuse and mental health issues. We initially conducted semi-structured interviews with women at the drop-in services, but encountered a number of ethical and logistical issues that prompted us to consider alternative methodological approaches. This article explores our use of mobile interviews with SBSWs and the outreach team who encounter them, which we argue gives us unique insights into the realities and lived experiences of both women who work (and sometimes live) on the street and the outreach team members who engage with this hard-to-reach group. We argue that mobile interviews offer a highly effective way of conducting research with a vulnerable population, and enabled us to gain a unique perspective into best practice around effectively and ethically researching hard-to-reach groups. Critically, we maintain that these walking interviews gave detailed insights into the lives of SBSWs that would not have been possible using more traditional methods. We provide empirical data in this article from these walking interviews, including fieldnote excerpts, and consider the value of using mobile and innovative methods for criminological research with hard-to-reach populations.

    Both major disasters and smaller incidents at chemical companies impact the environment. Seveso regulations aim to limit the impact of the chemical industry on man and the environment. This leads to the expectation that violation of these rules is predictive of incidents. In the current study, incidents at chemical companies are predicted from the company’s history of rule violation, previously reported incidents and corporate characteristics. Analysis of three years of inspection data and of six years of reported incidents, shows that the company’s branch and previous reported incidents predict the occurrence of an incident. The company’s history of rule violation, however, does not. Future research is needed to examine the different possible explanations for these contra intuitive results.

    Intimate partner homicide (IPH) constitutes one of the most prevalent types of homicide. This study aims to assess the nature and prevalence of intimate partner homicide in the Netherlands in the period 2009-2014. In doing so, we make use of police data, court data, and media articles. Findings show that IPH occurs 29 times per year, resulting in a victimization rate of 0.20 per 100,000, similar to other Western-European countries. Our results further show a decline in IPH in the last years. IPH in the Netherlands mostly occurs in heterosexual relationships, and involves male perpetrators and female victims. Finally, we reflect on possible causes for the decline of this type of homicide.

    The operational leader, the ‘gold commander’, fulfils a crucial function in crisis- and disaster management in the Netherlands. He is held responsible for the total coordination of all collaborating emergency services and supports/advises the Mayor, the Commander in Chief. Unfortunately, this function has never been very effective in practise, as shown by many evaluations. From a scientific point of view, it is easy to understand why the operational leader cannot be effective in the Dutch crisis management organisation. The operational leader has no authorities and has been seated in an emergency operation centre far from the Mayor. This article examines why this issue has not been solved, despite 30 years of studying and adjusting the Dutch crisis management organisation.

    Internationally, research on the experiences of white-collar offenders with the criminal justice system and the consequences of prosecution and conviction is scarce. Such research becomes more relevant, as the response to white-collar crime has become more punitive and more offenders are convicted. This paper presents the experiences of the co-author as a convicted white-collar offender as an autobiographical case-study. In this cases study, the consequences and experiences during four phases (investigation, prosecution, sentence-execution and post-sentencing) are analysed on four live-domains: health, private life, social life and professional life. Such an approach could be a blueprint for further and more systematic study of the experiences with and consequences of criminal justice for white-collar offenders. Such study can shed light on the effects and actual achievement of goals of punishment for white-collar crime.

Artsen en moreel ondernemerschap. De casus van de normalisering van verslavende opioïde pijnstillers in de Verenigde Staten

    In this article, I am using Becker’s concept of moral entrepreneur to analyse the role of pain specialists in the labelling process, which has led to the normalisation of the use of opioid painkillers in the United States and ultimately to the death over 200.000 Americans. In general, the literature on labelling centres on crusading reformers, and the criminalisation and stigmatisation of transgressive behaviour. Here I will focus on the moral entrepreneurship of medical experts. What was their role in the normalisation process of opioid painkiller use and are there any similarities with the strategies of crusading reformers? My findings, based on qualitative analysis of documents such as newspaper articles and academic publications, show that, with two exceptions, pain specialists use the strategies of moral crusaders. First, in their narratives, pain specialists represented themselves as neutral objective experts without the emotional stance of moral crusaders. The second exception, which is related to the first, is that there was less emphasis in their narrative on creating villains, as they could not blame openly standard medical practice because they needed the support of the established medical world in order to normalise and legalise opioid painkillers.

    Following a crisis, questions are often raised about how this crisis could have happened and whether someone is to be blamed for the crisis or its bad management. The blame game can become fierce as actors try to avoid, shift or mitigate blame in order to stay in office. In 2014, a festival took place in Haaksbergen where a monster truck drove into the audience, killing three people and injuring many others. Not enough safety measures had been taken to prevent the tragedy. Many actors were to blame for that, including the local authority which had granted the permit. Other actors blamed for the events were the mayor, the monster truck driver, and the organization organizing the festival. In the end, the mayor of Haaksbergen resigned. Instead of becoming more accommodative in his response as his blame levels increased, the mayor continued to be quite defensive, stating that the permit would be granted again – even with today’s knowledge. As one council member stated it, one cannot defend something which cannot be defended.

This decision cannot be taken lightly and requires a balancing exercise between the rights of the suspect (and other people involved), specifically the right to privacy, the interest of criminal investigations, such as the identification of the suspect or witnesses, and public pressure to fight crime.
    In the current digital society, the prosecutor can choose between a wide range of (new) media and modes of communication to ask for information. Next to wanted notices on paper posters and broadcasts on television, appeals for information are published on websites, social media platforms, apps and digital screens. Citizens can modify and share these appeals and they can comment on them. This necessitates careful consideration by the prosecutor on whether and how to appeal for information. After all, these appeals could lead to DIY-policing or online vigilantism (digilantism), leading to infringements on the right to privacy and even possibly to misidentification of suspects.
    This article contributes to the continuing debate. We describe the legal framework the prosecution has to take into account in such cases. The importance of a considered decision is illustrated by three cases in which judicial authorities appealed to the public for help in the criminal investigations, resulting in massive (media) attention and consequently affecting the eventual criminal case against the defendants. In two of these cases the prosecutorial decision to involve the public’s help resulted in a violation of the defendants’ rights to privacy and consequently had to be remedied by the court. Both cases led to social, legal and political debate about the balance between privacy and crime control.

    Changing ecological conditions in a globalizing world pose new challenges for human societies. Global warming, large-scale pollution, deforestation and species extinction have increasingly become topics on the international agenda. Even though many of these harmful activities are criminogenic, criminology pays rather little attention to environmental crimes and harms.
    Therefore, this article discusses the anthropocentric perspective within criminology and argues that a non-anthropocentric criminology can lead to new theoretical insights.

    This article addresses disaster recovery preparedness characteristics prescribed by literature and guidelines. An exploratory study was conducted in 25 Dutch safety regions to describe the status of disaster recovery preparedness with an emphasis on psychosocial support aspects. The study pointed at substantial cross-regional variation. Particular areas of improvement were identified in relation to involving citizens and partner organizations in safety regions’ recovery planning efforts, and the extent to which preparedness activities are guided by regional risk profiles. Optimization of preparedness takes place in an everyday context where relatively little priority is assigned to disaster recovery. Also, as major crises are fairly scarce there is little room for learning or routinization. Deliberate investments to enhance disaster recovery preparedness are needed, they would however benefit from more research into the association between relevant conditions, the disaster recovery preparedness level and the quality of service delivery when an event actually takes place.
