    In the past twenty-five years, a lot of attention is paid to a more victim-aware and restorative justice focused policy in prisons in Belgium and The Netherlands, striving for a restorative culture and climate in the institutions (among prisoners and staff) and for more restorative practices like victim-awareness programs and mediation. The focus is primarily on the prison structure and culture, striving to create a more restorative prison culture and climate in the institutions. In this article we argue for a shift from this system-focused pursuit of ‘estorative detention’ to the restorative reintegration of prisoners at the individual level, and by this supporting their desistance from crime. We present a conceptual framework for restorative reintegration in and outside prison as a strengths-based approach, with attention to the structural and individual elements that supports their desistance from crime.

    In recent years, measures have been taken to involve victims in the Netherlands more in the criminal proceedings of their offenses. This development, has led the three Dutch probation organizations (together 3RO) to aim for a more victim focused and restorative oriented approach with their clients. Two reports have been written to aid this victim-oriented approach within probation services. This contribution reflects on these reports and provides additions based on scientific literature. Both reports offer a good overview of existing practices and approaches to work in a more victim focused and restorative way, which can help to increase awareness among probation workers. The additions concern research about the positive outcomes of organizing contact between offenders and victims from unrelated crimes and new research findings concerning the role of feelings of guilt and shame. In addition, consciously talking and acknowledging clients’ victimization is presented as an essential mechanism to create willingness among them to consider the experiences of (their) victims, especially for those who are initially unwilling to do so.

    In this article the development of a restorative justice probation practice is discussed from the perspective of the restorative justice principle of the inclusive community and the contribution of probation volunteers to the reintegration of (ex-)offenders through specific restorative justice intervention strategies. It is shown that in penal policy of the past decades the penal welfare-model and the aim of reintegration of ex-offenders has been overshadowed by a more utilitarian, punitive and management logic of criminal justice. As a result, the reintegration and social inclusion of ex-offenders has become a rather neglected area and, in the current liberal-democratic state, offenders face social conditions in which it is very hard to turn their life around. In addition it is suggested that both in mainstream and in restorative justice interventions, achievement of the goal of reintegration is often problematic or absent. Moreover, this lack of opportunities for connection may undermine and reduce the effects of interventions, including those with a restorative justice approach. Probation services that use specific restorative justice intervention strategies guided by both professionals and probation volunteers might contribute to a more active, inclusive role of the community and society in the reintegration of ex-offenders.

    Since it has become apparent that so many Western women have travelled to Syria and Iraq to join Islamic State, there is a relentless stream of publications dealing with the motivations of these women to join the terrorist organization. Most of these publications, based on ‘open sources’, are focusing on the motives spread by the women via social media. These social media reports, however, only provide a distorted view of the women’s motives. This article is based upon ethnographic research focusing on 28 Belgian and Dutch families, whose daughters have left for Syria to join the armed struggle.
    Although the existing literature shows that the feelings of exclusion in Western societies by Muslim women is seen as an important motive for their departure to Syria, the conversations with the families rarely supported this. Moreover, religion and ideology have played a minor role in the departure of their daughters from the perspective of the families, compared to what literature suggests. According to the families the departure of their daughters was mainly driven by romantic motives and the problems they were dealing with in their daily lives.

    In this contribution, the justification of restorative practices in prison is first discussed from a normative perspective. On the basis of Lippke’s retributive theory of imprisonment it is argued that modern, humane retributive sanctioning entails an obligation to provide prisoners with opportunities to engage in restorative practices. Second, restorative practices in prison are examined from the perspective of possible impacts on the empowerment of prisoners and their experience to move away from crime and do good. Finally, it is argued that in order to yield positive effects, restorative practices in prison need to be supported by a safe and healthy living environment.

    The Dutch Custodial Institutions Agency (DJI) strives for a more restorative prison culture in the Netherlands, incorporating a more victim-oriented and restorative way of working in prisons. To this end, DJI has asked for a plan and process evaluation of three restorative courses among (juvenile and adult) prisoners in the Netherlands: Puinruimen, SOS and DAPPER. This article first offers an overview of the most important findings of this evaluation which was finalized in 2016. Based on the findings of the plan evaluation, a cautious yet clearly positive picture emerges of the design and substantiation of each of the three courses examined. That is, an extensive description and substantiation exists of each course. In addition, evidence exists in the (limited) scientific literature for one of the goals that each of these courses have formulated: to increase prisoners’ awareness of the consequences of crime for victims. The literature also suggests that creating trust among participants and a safe group process during the course is helpful in attaining the goals formulated. The process evaluation of the execution of the three courses in practice further strengthens the cautious, yet positive picture painted by the plan evaluation. An examination of the experiences of the courses’ participants lends further support to the observation that these courses can attain part of their goals. For example, after the course participants were more positive about the added value of victim-offender mediation for them personally than before.
    Aside from these findings, this article also argues for a deeper consideration of the constructive roles that both emotions guilt and shame can play in the restorative process of prisoners during these courses. The article ends with a number of recommendations for restorative courses in prison and a sketch of the current state of affairs in the Netherlands regarding these courses.

    In this exploratory study, two questions are addressed. Firstly, examining police files on honour based violence (HBV), do we find conflicts that take place in asylum centers, and if so, what can we learn from those files? Secondly, to what extent can these police files provide insight into the role of HBV in the lives of refugees in the Netherlands? What are the possibilities and limitations and how can they be dealt with in future research?
    We apply the importation and deprivation models within total institutions on asylum centers and zoom in on honour based conflicts within these centers. The conflicts revolved around family life and morality issues, and resulted in both threats and physical violence. Among younger victims, their choice of partner was the main stumbling block, while later in the course of life conflicts arose from divorces and new relationships. Distinguishing between importation and deprivation factors within these HBV cases turned out to be difficult for two reasons. Firstly, within Dutch policy HBV is primarily viewed as violence within (extended) families and often originating from conflicts regarding partner choice and morality. This focus corresponds to importation rather than deprivation. Secondly, many cases showed interaction between the two factors, for example the many different backgrounds of the inhabitants of the asylum center can be viewed as both importation and deprivation. Future research should look into (a combination of) different data sources to shed light on the role of deprivation, because deprivational factors are more susceptible for (short term) policy measures to help prevent unnecessary stress and causes of conflict, whether honour based or not.

    Contemporary cities are increasingly characterised by ‘super diversity’. As Putnam’s thesis about the negative social consequences of ethnic diversity is correct, we may assume that growing diversity also negatively affects crime and fear of crime in cities. After all: the more diversity, the less social cohesion and the less collective efficacy, ultimately resulting in higher crime rates. More diversity also implies less (public) familiarity in neighbourhoods and more fear of crime. On the other hand, some qualitative studies show that particularly residents of relatively homogeneous districts perceive migrants as threatening. Migrants are seen as less threatening when neighbourhood residents are familiarized with ‘the other’ and when there are more interethnic contacts. Various foreign and Dutch studies show an independent effect of ethnic diversity in the neighbourhood on fear of crime. However, this effect disappears when other resident characteristics are included into the analysis. Residents of ethnically diverse and deprived districts are generally less satisfied with their neighbourhood, have less trust in the government and are more often victimized. Precisely these perceptions and experiences explain why they more often feel unsafe in their own neighbourhood.

    GHB is an anaesthetic that in Netherlands since the 1990s is used as a drug by various groups. Although GHB is often defined as a ‘party drug’, particularly in rural areas it is also used in street cultures. GHB is mainly used recreationally, but a minority uses the drug frequently and/or becomes addicted. GHB use and associated problems are disproportionately spread across the Netherlands and are concentrated in certain rural areas (‘trouble spots’), especially in low SES villages or neighbourhoods. Predominantly based on qualitative research, this article describes supply and use of GHB in rural ‘trouble spots’. The profile of experienced current GHB users in rural areas is characterized by a wide age range, a low level of education, often multiple psychosocial problems and poly drug use. They are almost exclusively ‘white’, in majority male users, of whom a large part has been arrested on several occasions. From a supply perspective, GHB could spread quickly because of the short distribution chain, the limited social distance between dealers and users, as well as the closeness an reticence of user groups. Even though as a drug GHB is very different from methamphetamine, there are striking similarities in set and setting characteristics between rural GHB use in the Netherlands and rural methamphetamine use in the US.

    In a recent novel that received much public revulsion, Flemish writer Kristien Hemmerechts identifies with Michelle Martin, ex-wife and accomplice of the notorious criminal Marc Dutroux. To a certain extent her book is a plea for rehabilitation and re-socialization of Martin. By the wider public this ‘humanization’ is experienced as unacceptable. Nowadays re-acceptation of ex-convicts has become increasingly problematic. It seems the public would prefer to banish many ex-offenders to a desert island or a distant country. This development shows that the ethic of forgiveness has lost social influence. In this essay Hemmerechts' position is compared to that of Dostoevsky, especially with his novel Crime and Punishment in which the Gospel message of humility, charity and compassion reverberates.


Jaap Goedegebuure
Jaap Goedegebuure was van 2005 tot 2012 hoogleraar moderne Nederlandse letterkunde aan de Universiteit Leiden. Eerder vervulde hij leeropdrachten aan de universiteiten van Berlijn, Tilburg en Nijmegen. Hij publiceert regelmatig over de literatuur van de negentiende en twintigste eeuw. Zijn laatste publicatie in boekvorm is Nederlandse schrijvers en religie 1960-2010.

    In 2011 we executed a quantitative and qualitative research on the extent of discrimination, polarisation and radicalisation in a region in the Netherlands. The results are representative for The Netherlands. The research shows that there is breeding ground for radicalization, in particular Muslim youths. The outcome also provides insights in relevant avenues for public policy. Over the past years, several inventories have been made of public policy that aims to counter radicalisation. Most of the interventions listed do not conjure with the interventions we propose on the basis of our research, such as awareness raising for practitioners, prevention of and education about discrimination, focus on neighbourhood grievances and nuisances caused by specific ethnic groups and the negative tone of the public debate regarding Islam and the multicultural society. If measures to counter radicalization are even evaluated, they tend to focus on the process and effectiveness of the intervention, but they do not answer the question if that is actually also the right intervention. We therefore propose not only to focus on doing things right, but also to ask the question if we are doing the right things. We suggest not only measuring effectiveness, but also measuring impact.

    Irregular immigrants were disproportionally present in jihadi movements in the Netherlands between 2001 and 2005. By analyzing closed police files and interviewing imams and personnel from Asylum Seeker Centers and Detention Centers, this paper claims that the attractiveness of jihadi movements can be explained by a combination of pragmatic and ideological factors. Jihadi movements are able to fulfil the needs of the irregular immigrants in a pragmatic way, in which crime is an important feature. In addition, the results show that irregular immigrants are searching for meaning, which the jihadi movements can offer. Nonetheless, the salafi-jihadi ideology does not seem to be the core factor to most of the illegally residing immigrants that expresses the attractiveness of the jihadi movements.

    The current phase in which Dutch government increasingly criminalizes the illegal residence of migrants is simultaneously characterized by decreasing numbers of illegal migrants in this country. In the process of crimmigration, some newly developed policies indirectly influence daily lives of specific groups of illegal migrants while other policies and laws more directly try to hinder illegal stay. These policies that aim to exclude and ban illegal migrants are continued even though they are increasingly criticized by academics and divergent (inter)national actors. These policies and laws can be contradictory, sometimes conflict with international treaties, and lead to unforeseen and undesirable outcomes in which human dignity is challenged.

    In the Netherlands the discussion on the recent increase in residential domains with some sort of enclosure is fuelled by references to foreign examples (gated communities). However, large scale gated communities are absent in the Netherlands. Rather, we speak of enclosed residential domains. This article analyses the societal forces behind their popularity. Trends facilitating the further development of enclosed residential domains appear to be stronger than those impeding it. The growing need for shelter and a living environment that is predictable and familiar is especially important. Lack of safety, however, cannot directly be regarded as a prominent factor.

    The literature on using Social Network Analysis (SNA) in criminological research is expanding. The SNA perspective already changed the way we look at organized crime. More often organized crime is referred to as changeable social networks instead of hierarchical structured organizations like the Italian or American mafia. In this respect, SNA seems to lack behind in empirical research on organized crime. Mainly, this is due to the lack of suitable network data on organized crime. For obvious reasons, commonly used methods of gathering network data – such as questionnaires – are less suitable for research on organized crime. Suspects of organized crime have not much to gain from talking about their ‘comrades in crime’. Alternative data need to be explored. Wiretaps from criminal investigations are one such source. In this contribution the SNA perspective is used to present an overview of the possibilities and limitations of using wiretaps for SNA. It follows that wiretaps from criminal investigations should be regarded as ego-centered network data.
