Bauhaus, moderniteit en de Unrechtstaat

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2021
Trefwoorden Bauhaus, National Socialism, architecture, Bauhäusler
Auteurs Martina Althoff
SamenvattingAuteursinformatie

The article discusses the connection between Bauhaus, a modern art and architecture school founded in 1919, and National Socialism. The central question is to what extent modern ideas about art and culture, architecture and modern life went hand in hand with the emerging and assertive National Socialist ideas. In the review of an art and architecture collection, activities of famous Bauhaus figures are traced in order to discuss the Bauhaus myth. Accordingly, it must be concluded that neutrality of art and architecture does not exist and Bauhaus modernity was not incompatible with National Socialism.

Art crime, related to the existence of hidden art, appears in the legal and illegal art market. In the criminal ‘artopolis’ especially iconoclasm, forgeries and looting are longstanding phenomena. Today they are subject to the debate on art restitution.

Trefwoorden Nico Gunzburg, freemasonry, Einsatzstab Reichsleiter Rosenberg, Moscow-archive, restitution
Auteurs Marc Cools
SamenvattingAuteursinformatie

In 1938, Nico (or Niko) Gunzburg founded the Institute of Criminology at Ghent University.
Because he was a professor of Jewish origin, Flemish-minded, a political liberal and a freemason, he became the victim, in 1940 and in 1941, of looting by the ‘Einsatzstab Reichsleiter Rosenberg für die besetzten Gebiete’. Personal books, documents, art and archives concerning his lodge ‘Marnix van Sint Aldegonde’ were stolen from his house and transported to nazi-Germany. After the Second World War, almost the entire collection was found in the Moscow-Archive and subject to restitution.

Vervalsingen van archeologische objecten

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2021
Trefwoorden archaeological forgery, James Ossuary, Shroud of Turin, Piltdown Man Skull, Archaeoraptor Fossil
Auteurs Noah Charney
SamenvattingAuteursinformatie

This paper looks at a selection of famous forgeries of archaeological objects – the James Ossuary, the Shroud of Turin, the Piltdown Man Skull and the Archaeoraptor Fossil – to consider how these artefacts were falsified for personal benefit, whether in terms of fame or finance. The Shroud of Turin was identified as a forgery as early as 1389, and yet the value in terms of income from pilgrims was such that it continued to be displayed and venerated. The James Ossuary was forged for profit and notoriety, to gain renown and then to sell. The Piltdown Man Skull was one of many alleged forgeries by a man who sought renown by finding the ‘missing link’ that proved the Darwinian theory of evolution from ape to homo erectus. The same motivation drove the scientists who tried to pass off the Archaeoraptor Fossil as the ‘missing link’ that proved the relation of dinosaurs and birds.

Auteurs Richard Staring, Lieselot Bisschop, Charlotte Colman e.a.
SamenvattingAuteursinformatie

The ports of Rotterdam and Antwerp are among the main European ports of entry for the import and further distribution of cocaine. Earlier research underlines the interchangeability of these ports regarding the criminal networks trafficking cocaine into Europe. In this contribution, the interchangeability of these European sea ports regarding cocaine trafficking is questioned. Based on empirical research, and applying the routine activity approach, the Port of Rotterdam and the Port of Antwerp are compared with respect to their physical characteristics, the potential, motivated offenders, as well as the existing public and private security measures.

Omzetberekeningen van synthetische-drugsproductie in Nederland

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2021
Trefwoorden Drug trafficking, Organized Crime, Turnover Estimates
Auteurs Judith van Valkenhoef en Pieter Tops
SamenvattingAuteursinformatie

In 2018 we published a report on the production of synthetic drugs in the Netherlands. We calculated the turnover of synthetic drugs produced in the Netherlands in 2017; we estimated it to be at least 18.9 billion euro (worldwide, street prices). In this article, we will discuss how these calculations were executed and on which assumptions they were based. We describe the responses to these calculations, nationally and internationally. Finally, we describe problems we encountered when performing a repetition of the calculations for the year 2018. Our central message is: drug turnover calculations can be an important addition to scientific and political discussions about illicit drugs, provided they are presented in a transparent way and acknowledging the inherent limitations of these calculations.

Trefwoorden Drug trafficking, Drug production, Subversive crime, Drug economy, Narco state
Auteurs Robby Roks, Edward Kleemans en Arjan Blokland
SamenvattingAuteursinformatie

As drug producing countries and logistical hubs, the Netherlands and Belgium are topping the worldwide charts in the field of international drug trafficking. For this reason, the Netherlands – and to a lesser extent Belgium – is depicted as a ‘narco state’ in the media and the political arena. Another term that is frequently used when it comes to crime problems related to drugs is ‘subversive crime’. In this introduction of the special issue on drug crime, the authors elaborate on two themes that are central to the terms ‘narco state’ and ‘subversive crime’: the size and estimates of the drug economy and the embeddedness of the drug industry in the legal world in the Netherlands and Belgium.

Het grensgebied als waterbed voor drugscriminaliteit?

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2021
Trefwoorden displacement, cross-border crime, organized drug crime, policy effectiveness, balloon effect
Auteurs Rik Ceulen, Stephan Van Nimwegen en Toine Spapens
SamenvattingAuteursinformatie

This paper concerns the question whether in the period 2011-2017 displacement effects occurred from the Netherlands to Belgium in the context of synthetic drugs production, cannabis cultivation, and retail of illicit drugs, and if so, how these may be explained. We conclude that displacement took place in modi operandi of retail drug dealers. This is explained foremost by the policy of banning non-residents from Dutch coffeeshops in border region municipalities. Dealers and traffickers responded by switching to local distribution in Belgium as well as deliveries by drug couriers. The synthetic drugs and cannabis cultivation markets show minor changes in modi operandi, but no changes occurred in choosing production locations. Displacement effects in the context of organized drug crime must be explained from a range of factors. Reality is therefore more complex than assuming that government interventions are the main cause of a balloon effect.

Over slachtofferschap en dieren in het antropoceen

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2021
Trefwoorden dieren, antropoceen, dierethiek, slachtofferschap
Auteurs Joost Leuven, Eva Meijer en Bernice Bovenkerk
SamenvattingAuteursinformatie

In recent years, there has been a shift within animal ethics, in which animals are no longer seen purely as passive suffering subjects, but attention is also being paid to their role as agents. In this essay, we look at what that agency means and argue that in the Anthropocene animals are actually victimized in two ways: because their agency is literally curtailed by human actions and because at the knowledge level agency is taken away from them: we see them as victims even when they are not. In this text, we focus on zoo animals to illustrate how this works.

Een antropologie van herstelrecht

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 1 2021
Trefwoorden Suriname, Inheemsen, herstelrecht, gewoonterecht, Krutu
Auteurs Makiri Mual
SamenvattingAuteursinformatie

This article deals with restorative justice practices in Surinam. It is based mainly on anthropological literature and preliminary research findings of four indigenous villages in Surinam, and is part of a broader study of Indigenous and Marron communities. In these villages the age-old customary law approach to conflict remains a lively practice, especially in the rainforests where central authority has little influence. The author highlights a number of restorative aspects of indigenous (criminal) justice practices, such as the group conferencing model of the Krutu and the role of the community (rehabilitation). Other aspects are not at all restorative, such as cases of double punishment (ne bis in idem), corporal punishment and the lack of the possibility of appeal. Because the trend of opening the hinterland seems to be unstoppable, it is recommended to coordinate national law and customary law and improve cooperation between indigenous and central authority. The article gives some suggestions for reforming the Surinamese Penal Code.

Meningen van Surinaamse ex-gedetineerde jongemannen

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 1 2021
Trefwoorden Suriname, herstelrecht, jongvolwassenen, ex-gedetineerden
Auteurs Sabine de Vries
SamenvattingAuteursinformatie

This article analyzes the opinion of twenty-four Surinamese ex-convicted young men on restorative justice. The results were obtained through four focus group sessions and a concise survey form. The factors (a) type of offense, (b) seriousness of offense and (c) prevention of recurrence were discussed. The opinions are divided, but the majority is of the opinion that restorative justice can mainly work for serious and violent crimes. Fear of revenge appears to be a barrier to participation. Employment has been indicated as the key to real recovery of the offender and prevention of recidivism (and thus satisfaction for the victim). The results provide insight into the susceptibility to restorative justice among this specific group in Suriname.

Burgers als institutioneel werkers. Een nieuw perspectief op burgerparticipatie in veiligheid

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 3 2021
Trefwoorden institutional work, citizen participation, fire, disruption, actor perspective
Auteurs Jasper Bongers en Wim de Jong
SamenvattingAuteursinformatie

In this article we show how the concept of ‘institutional work’ can be used to study citizen participation in the field of security arrangements. Institutional work starts from the perspective of actors trying to influence security institutions, and not from the perspective of government (as concepts like the ‘participation society’ and ‘ladder’ do). As such, this dynamic concept can be a useful addition to the conceptual arsenal of security experts. By applying the concept to the case of the Voluntary Fire Brigade in nineteenth-century Utrecht (1879-1890) we show how institutional work can work in practice. Finally, we reflect on the contribution that institutional work can make to our understanding of citizen participation in the field of safety.

Mensenhandel en mensensmokkel op Curaçao: een crime-scriptanalyse

Tijdschrift Tijdschrift voor Criminologie, Aflevering 1 2021
Trefwoorden exploitation, crime scripting, situational crime prevention, Caribbean, Latin America
Auteurs Zahyanne Luisa
SamenvattingAuteursinformatie

This article contains the results of a crime script analysis regarding the processes of human trafficking and human smuggling in Curaçao. The crime script analysis was conducted using data from five criminal investigations of human trafficking and seven criminal investigations of human smuggling. The results show that human trafficking in Curaçao consists of labor exploitation and sexual exploitation in bars, cafes and clubs. Young women are recruited from Colombia, Venezuela and the Dominican Republic to work as waitresses, trago girls and/or prostitutes. Once they arrive on the island, the women are dependent on the perpetrators and are subjected to exploitation In this research, two types of human smuggling have been witnessed. The first type consists of Venezuelan smugglers who transport fellow Venezuelan nationals to Curaçao by boat in exchange for payment. The second type of smugglers are Curaçao locals who rent out rooms to Venezuelans that reside on the island illegally.

Expert Judgement geeft crisisteam continu inzicht in effectiviteit van maatregelen

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 1 2021
Trefwoorden Continu inzicht, Expert Judgement, Impact inschatting, Flood risk management, Besluitvorming
Auteurs Hanneke Vreugdenhil, Bas Kolen, Martin Nieuwenhuis e.a.
SamenvattingAuteursinformatie

Crisis teams from waterauthorities want to have insight into the current risks for the area. The ‘Continuous insight’-method is used by them to monitor the risks of drought and high water and to draw up what-if scenarios for training and exercise. Various cases have now shown that Expert Judgement can be used to gain a clearer picture of the effectiveness of measures and to take a more balanced decision. The Expert Judgement method has been tested and applied by a group of international experts as part of the EU project DRIVER +. During an extreme situation, the crisis team may encounter dilemmas. The engaged group of experts follows a fixed procedure to provide advice to reduce flood risk evacuate to prevent loss of life.
Each expert makes his own assessment of the effect and impact of the measure envisaged. Each expert provides an explanation of the individual assessment. Then, under the guidance of a process supervisor, the experts discuss individual assessments and exchange arguments. This can lead to new insights. Each expert makes his own assessment again. The result is a probability distribution of estimates and an expected value. This expert assessment of the measure is taken to the crisis team, so that the chance of success and the assessment of the consequences of the proposed measure can be adjusted. The crisis team can take the decision immediately afterwards.
By following this procedure risk information is made visible. By linking expert knowledge with observations, a better substantiated expectation can be drawn up. According to the participants in the international meetings, the Expert Judgement method in combination with ‘Continuous insight’ helps to make better informed and faster choices. The method fits within the existing crisis management structure. The next step is to implement this method in the day-to-day affairs of crisis management.

Een longitudinale analyse van de geleverde prestaties per bestede euro in de V&J-sector in de periode 1980-2016

SamenvattingAuteursinformatie

Policy coherence in the area of safety and justice – A longitudinal analysis of service delivery per euro spent in the S&J sector during the period 1980-2016

In the safety and justice policy area, there is a strong intertwining between performances of the various sectors, such as police, judiciary and prison system. The question is whether policy takes these interdependencies into account sufficiently. Are the resources used – from a broader wealth perspective – optimally allocated amongst the various safety and justice provisions? The authors answer this question on the basis of an integrated time series analysis of the productivity development of the Dutch safety and justice system in the period 1980-2016. The analysis shows that productivity of safety and justice services has hardly changed since 1980. At best, in 2016, citizens will receive as much value per euro of taxpayers’ money as in 1980, but probably slightly less. It is striking, however, that the S&J system as a whole operates more efficient than the sum of its parts (the individual sectors). There have been substantial changes in the allocation of resources over time. Obviously money from the police was transferred to the judiciary and municipalities.

SamenvattingAuteursinformatie

The aim of the present research was to gain insight into the topic of ‘task-related rule-breaking behavior’ (TRB) among Dutch police officers. TRB is a more refined alternative for the concept of noble cause corruption and has been defined as: police officers breaking rules or formal agreements for the purpose of acting in a manner that contributes to the lawful police task. Qualitative research has been conducted within one of the ten regional police forces in the Netherlands. Results show that TRB appears to be a relatively common phenomenon during policework. Behaviors are categorized in sixteen categories and five overarching outlines. In addition, attention is given to several important factors that could be related to TRB being distinguishable between police officers’ individual responsibility and organizational factors. To handle TRB, it is recommended to pay attention to the police officers’ approach of judging and rationalizing their own behavior, their level of knowledge, and social skills. Furthermore, organizational structure (i.e., spam of control) and police leadership may, among other factors, play an important role in encouraging TRB. Especially the way supervisors deal with police officers’ professional autonomy needs specific attention in order to reduce TRB. Autonomy needs guidance in the form of clear orders followed by feedback and coaching. Also, an active form of ethical leadership is needed. An action framework is presented that could be helpful to supervisors to judge and thereby reduce forms of TRB.

Boulevard Zuid in Rotterdam: een onderzoek naar het vertrouwen van winkeliers in politie en gemeente

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 4 2020
Trefwoorden shopkeepers, procedural justice, the Netherlands, ethnic minorities, performance theory
Auteurs Marc Schuilenburg, Laura Messie en Darnell de Vries
SamenvattingAuteursinformatie

In this article, we analyze which aspects of performance theory and the procedural justice-based model are explaining the trust of shopkeepers in the police and local government. Utilizing a survey of 156 shopkeepers and 94 semi-constructed interviews with shopkeepers, which are located at the South Shopping Boulevard in Rotterdam (The Netherlands), the study finds that shopkeepers have a relatively high trust in the police and local government. This is surprising because various attempts in the past 30 years to revive the high street by the government have failed to improve its bad image, as dwindling visitor numbers, poor turnover, limited range of retailers, empty shops and high crime and offence levels show only too plainly. The findings also highlight that ethnic minority respondents have more trust in local government than Dutch shopkeepers. The explanation therefor is sought in the dual frame of reference theory.

Plattelandscriminologie

Trefwoorden Rural criminology, Policing, Critical criminology, Cultural criminology, Environmental crime
Auteurs Toine Spapens
SamenvattingAuteursinformatie

Criminology has traditionally focused on urban areas where crime visibly concentrates. However, since the 1990s, attention for ‘rural criminology’ has steadily increased. First, rural areas are confronted with partly different and less visible crime problems, such as environmental crimes. Second, public actors such as enforcement and other agencies are less present and ‘available’ in rural areas, and people on average trust the government less to provide support when necessary. This chronicle presents an overview of international and Dutch research in the context of rural criminology. The paper addresses cultural differences between urban and rural areas, high-volume crimes, gender-related violence, alcohol and drug abuse, environmental crime, and enforcement in rural areas.
