With the international community taking up the responsibility to protect populations from these crimes and the prominence of international criminal justice on the world stage, it is argued that international criminology should embrace international relations more as an important sub-discipline.

    Empirical research on restorative justice shows that offenders can apologise to victims. Because of the ritual component of restorative justice and the possible influence on the justice system, certain questions arise: how do victims perceive these apologies? Is it important for victims that these apologies are sincere? The aim of the article is to discuss these questions through three topics, namely the physical aspect of the ritual, the symbolic meaning for victims and the relation between the offender’s apologies and the victim’s reaction.

    Journalists are accustomed to investigate and interpret current forms of violent conflicts and massacres. Psychologists and social scientists lag behind and seem to focus more on ‘remote’ forms of evil, often focusing on forms of authoritarian behaviour and obedience, especially related to the Holocaust. It is striking that reflections on collective violence are often ignored by criminologists. How can this ‘distance’ be explained? Why is there little incentive to study ‘evil’? In this introduction we first discuss the difficult issue of how to define ‘evil’ and we clarify its various meanings. Then we focus on the Holocaust, an oppressive theme that still instigates much debate. In particular, the thesis of the ‘banality of evil’ is controversial. This interest in appalling forms of mass destruction – by theologians, ethicists and historians – raises once again the question why criminological reflection and research of barbarity remains underdeveloped.

    Genocide is so cruel and extreme that a first natural reflex is to distance ourselves from the perpetrators and qualify them as deranged criminals, psychopaths and sadists – very different from us ordinary people. Although some of the perpetrators fit this description, most perpetrators are ordinary people in extraordinary circumstances who commit so-called crimes of obedience. A genocidal regime is usually led by a criminal mastermind, who is supported by a number of fanatics and opportunistic careerists who take advantage of the situation to make themselves a career. Many of these perpetrators are special cases who deliberately participated in the genocide. Perpetrators in the middle cadre as well as the rank and file members are however often very ordinary people who just go along and follow the flow out of ideological conviction, fear or material gain.

    The politization of the concept of genocide by Western states has been severely criticised, because it has led to an impunity for genocidal crimes. In certain instances however, such criticism has contributed to the dynamic of victimization, instead of resisting it. The article discusses how Professor Edward S. Herman and journalist David Peterson’s staunch criticism of the politics of genocide amounts to a brazen denial of the genocide against the Tutsi which recycles much of the extremist discourse of the former Rwandan authorities that were implicated in genocide. In this case Herman and Peterson’s resistance against the politics of genocide has profound implications, several of which the article will address.

    The Netherlands pursues an active policy of excluding and prosecuting potential perpetrators of international crimes. In recent years hundreds of people have been excluded from taking part in the asylum procedure. Bringing cases to court, however, has proven to be very difficult in practice. Most excluded persons reside illegally in the Netherlands or elsewhere in Europe. A good overview of the grounds upon which persons have been excluded and with what types of crimes they are associated is currently lacking. The Netherlands – actually the international community as a whole – still struggles with a number of legal and ethical issues. International law, for example, does not provide an adequate solution for some convicted excluded asylum seekers after their release.

    This article develops a victimological perspective on international criminal justice, based on a review of the main victimological characteristics of international crimes. These include the complicity or active involvement of government agencies, the large numbers of victims and the peculiar position of international crime victims who, at the time the crimes are committed, are usually not viewed as victims by the perpetrators, but placed outside the moral sphere or even depicted as perpetrators rather than victims.Key elements of this perspective concern the external coherence of the criminal justice reaction - the interlinking of criminal justice with other reparative efforts - as well as its internal coherence - the extent to which the procedures of international criminal justice are aligned with what it realistically can and should achieve. With internal coherence in mind, the article examines the victimological findings relating to the main rights of victims in the criminal procedure (recognition/acknowledgement, information/participation and compensation/reparation) and subsequently analyzes how the specifics of international crimes moderate them.

    What do we know about the criminological aspects of international crimes? What do they entail and what are facilitating factors which can help us understand their causes and how should we respond to these crimes? Are international crimes merely a more extreme form of ordinary crimes or are they a different kind of criminality? In the past few years a growing number of scholars both at a national and at an international level have devoted their scholarly attention to this important and urgent research theme. In this special issue we aim to present a number of articles in which different perspectives on this topic are presented. By doing so we hope to enhance our knowledge of this phenomenon and to provide an impulse to further criminological research within this area in both the Netherlands and Belgium. This introductory article gives an overview of the state of the art of international crime criminology in the Netherlands and Belgium, and the rest of the world.

    The author advises the protagonists of restorative justice to become less paradigmatic and more pragmatic in their approach of criminal justice and victims needs and interests. The offer of a restorative procedure is not suitable for all victims, nor for all thinkable moments after the event of a crime. Tailoring is needed to make each victim the best offer, and the utility of restorative justice is important, but limited. The author believes that much of the restorative justice literature is aiming at proving the superiority of restorative justice practices above any other type of intervention or service, and he feels that this is partly why restorative justice has not been well received in the Netherlands. A piecemeal implementation of mediation and conferencing in the sphere of criminal justice might be served by being less paradigmatic.

    In this article, theories on organisational crime are applied to the involvement of the German corporation Topf & Söhne in the Holocaust. This corporation produced ovens for various concentration and destruction camps in Germany and Poland and contributed significantly to the execution of the Holocaust with their innovative products. The motivation to procure these ovens to the SS does not seem to stem from force, ideological agreement or maximisation of profit. Instead loss-minimisation and a ‘culture of perfection’ seem to form the explanation. Opportunity was provided by the Nazi-Germany regime and the knowledge and skills were already at hand within the organisation. Because of the close collaboration between these two parties, this case can be qualified as a form of state-corporate crime. Administrative, political and social control was absent and neutralisations only seem to have been formed after the Holocaust. The analysis shows how theories about ‘regular’ organisational criminality can form an explanation of the involvement of corporations in international crimes.

Gacaca in postconflict Rwanda

    Based on a prize-winning master thesis in criminology, this article describes how the Rwandan Government chose to bring to justice all suspects of (crimes during) the 1994 genocide. Accordingly, it was decided to turn to Gacaca, the traditional Rwandan method of dispute resolution, in order to reach reconciliation as well as justice. A field study indicates that, when asked whether they think Gacaca can lead to reconciliation and justice, the majority of Rwandans think it can. However, six determinants of reconciliation have been deduced from the interviews. Because Gacaca can only have a clear positive impact on one of these factors – the need to meet – Gacaca can not be considered as an appropriate mechanism to achieve reconciliation in Rwanda. It also appears that justice is not a determinant for reconciliation.
