Protected living in some sort of gated community is popular. However Dutch protected living differs from, for instance, the living in American gated communities, the development tends to social discussions whether it is undesirable or not. Safety seems in the Netherlands not the first reason for protected living. Here, domestic and aesthetic reasons are much more important.

De ervaren mogelijkheden om te re-integreren vanuit detentie

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 0304 2015
Trefwoorden Prison life, staff-prisoner relationships, correctional officers, rehabilitation, survey
Auteurs Toon Molleman en Karin Lasthuizen
SamenvattingAuteursinformatie

In this article we examine which factors are correlated to the rehabilitation of prisoners. Central is the prisoners’ willingness during their imprisonment to work on a successful return in society. Assumptions derived from the theory were statistically tested with data from the Dutch Detainee Survey 2014; a large-scale study, in which prisoners held in all Dutch penitentiary institutions (N = 29) were surveyed (n = 2120). The results are in line with the theory and show that detainees are more positive about their (potential for) rehabilitation when they are more satisfied with a) the way they are treated by correctional officers (staff orientation); b) active deployment of the so-called Detention and Re-integration Plan; c) their daily program and activities, and; d) the experienced autonomy and personal decision-making. These outcomes offer fruitful perspectives on how the prison system can promote a successful return of prisoners in our society.

Vervolg je reis en struikel niet: antropologie van dood en taboe

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2015
Trefwoorden Death, denial, taboo, anthropology, Suriname
Auteurs dr. ir. Yvon van der Pijl
SamenvattingAuteursinformatie

This article explores the relation between death, the fear and denial of it, and the appeal of mortuary rites attempting to transcend senses of mortality. It aims to show how our Own death, as a shamefull and solitary characteristic of modernity, has become a taboo and how it simultaneously continues to spur our imagination of the way Others die. Building on research in Suriname, it argues that both colonial compulsion and anthropological gazing have contributed to distorted and ambiguious attitudes toward death cross-culturally. As such, the article seeks to advance discussions on death and taboo as a perpetuum mobile of dread and everlasting enchantment.

Godslastering voor en na de aanslagen op Charlie Hebdo

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2015
Trefwoorden Blasphemy, Freedom of speech, Religious Extremism, Terrorism
Auteurs dr. Jean-Marc Piret en prof. mr. dr. Jeroen ten Voorde
SamenvattingAuteursinformatie

Triggered by the recent Paris attacks the authors make an attempt to answer the question how liberal democracies can react to religious extremists that respond with violence to utterances they consider to be blasphemous. After a brief historical survey of the reactions to blasphemy in penal law and philosophy, the authors compare blasphemy laws and their relation to the freedom of speech in various European countries. Then they analyse the relevant case law of the European Court of Human Rights and the U.S. Supreme Court. In their conclusion the authors defend the position that liberal democracies should be cautious in order to prevent the principles of liberal democracy from being subverted by self-censorship induced by fear of extremism.

De seksuele tiener en de sociale orde

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2015
Trefwoorden youth, sex, transgression, criminal law
Auteurs Mr. drs. Juul Gooren
SamenvattingAuteursinformatie

A taboo serves the social order for it facilitates social control. This article will focus on taboos related to sexual contact by youngsters. The way authorities guard sexual taboos is indicative of the way authorities envision the organization of society. It is this organization through the control of youth and sex which will receive attention. In the classic study by Mary Douglas on pollution and taboo dirt is understood as ‘matter out of place’. The sexual teenager is an illustration of this ‘matter out of place’ because it is difficult to categorize sexual teenagers on the basis of asexual children and sexual adults as an organizing principle for society. In criminal law lewd conduct by youngsters refers to wrong sex at the wrong age. By criminalizing these sexual transgressions the proper place of youth and sex is once again restored. This is necessary for it will be argued that the interests of society are somewhat under pressure because of transgressions when it comes to children as asexual and when it comes to sex as something for within a relationship. The perpetrator of lewd conduct should be understood as a scapegoat reestablishing when and how sex should take place. By restoring the asexual child and the sexual relationship it is hoped sex and youngsters can once again offer some guidance in a social order lacking these clear markers.

Het episodisch geheugen en getuigenverhoor

Wat weten politieverhoorders hiervan?

Tijdschrift Tijdschrift voor Criminologie, Aflevering 3 2015
Trefwoorden interview, interviewer, police, witness, episodic memory
Auteurs Dr. Geralda Odinot, Drs. MCI Roel Boon en Laura Wolters BSc
SamenvattingAuteursinformatie

In this study, we examined what police interviewers know about factors that affect the reliability of eyewitness testimony. We asked 143 specialist investigative interviewers from the Dutch police to complete a questionnaire about eyewitness memory. The results indicate that the police interviewers have limited knowledge of episodic memory and accompanying interviewing issues. In addition, we analyzed the interview manual from the Dutch Police Academy on coverage of the topics in our questionnaire. The poor level of knowledge of the police interviewers was correlated with lack of knowledge in the manual. Results are discussed in relation to education in police interviewing in the Netherlands.

Diversiteitsbewuste communicatie. Niet culturen, maar mensen ontmoeten elkaar

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 3 2015
Trefwoorden intercultural communication, diversity, TOPOI
Auteurs Edwin Hoffman
SamenvattingAuteursinformatie

Intercultural communication is often portrayed as communication between people with a different ethnic or national background. People may interpret differences and misunderstandings arising in communication as especially grand and problematic. Sometimes, people see the reason for a difference in opinion or the conflict to be situated within the other (often national or ethnic) culture. They see themselves and others as a member of a different group, with a different culture and thus claim the differences to be related to the culture and not the individual person (culturalising or culturistic approach). This approach entails certain risks when it is seen as a condition to be able to speak to others and when handled as the sole frame of reference to interpret people’s meaning-making. An alternative approach can be found in a systemic and communication-theory approach, linking it to intersectionality, pluralism, diversity competence and the TOPOI model, as this article explains.

Anders omgaan met interculturele conflicten

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 3 2015
Trefwoorden conflict, security, intercultural settings, restorative justice approaches
Auteurs Inge Vanfraechem
SamenvattingAuteursinformatie

This article describes the European research project ALTERNATIVE, which studies the possible implementation of restorative justice approaches in intercultural conflicts. Besides theoretical research into concepts such as justice, security, conflict (transformation) and restorative justice, action-research was implemented in four diverse intercultural settings (Austria, Hungary, Serbia and Northern Ireland). In order to compare those settings, an innovative comparative research method was developed through which the various realities are ‘thickly described’ within evaluation grids. The article describes the different aspects of the research and reflects upon the question whether a more broad understanding of restorative justice, surpassing the judicial sector and aspects, is emerging.

De bestudering van criminaliteit op macroniveau: een inleiding

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2015
Trefwoorden macro criminology, theory, crime drop, punitive turn, micro-macro problem
Auteurs Dr. Frank Weerman, Dr. André van der Laan, Prof. Ineke Haen Marshall e.a.
SamenvattingAuteursinformatie

In this introductory article we introduce the subject of our thematic issue on ‘macro criminology’, and illustrate it with a short historical overview and examples of ‘typical macro criminological’ research. Successively we address the recent decrease in crime in many Western countries (the ‘crime drop’), the increased tendency to punish more severely in the last decennia (the ‘punitive turn’), and historical developments in homicide (‘history of violence’). After that we address an important theoretical and philosophical problem with regard to macro criminology: the balance between micro and macro factors in explaining macro phenomena. Finally, the contributions of this thematic issue are introduced.

Van secularisering naar securitisering

Een beschouwing over de relatie tussen religie, criminaliteit en veiligheid

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2015
Trefwoorden religion and crime, secularization, radicalization, surveillance
Auteurs Prof. dr. Hans Boutellier
SamenvattingAuteursinformatie

The Western world seems to be a secular one. Although secularization has long roots, from the sixties onwards the role of religion in public life has diminished. How did that affect the crime and security issue? Criminological literature learns that there is a two-sided relationship: (1) in a religious context there is an inhibiting effect of being religious; and (2) religion can also legitimize or neutralize criminal or violent behavior – for example in the case of Islam-related terrorist acts. Secularization did indeed contribute to the rise of crime; in nowadays secular context religion can – the other way around – legitimize criminal behavior. The author argues that secularization also has facilitated the growth of the security issue as such. Fear of crime was the driving force behind a process in which secularization resulted in securitization of Western society.

Daling in geregistreerde jeugdcriminaliteit

Enkele mogelijke verklaringen

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2015
Trefwoorden crime drop, juvenile suspects, trends, macro explanations, time series analysis
Auteurs Dr. André van der Laan en Dr. Gijs Weijters
SamenvattingAuteursinformatie

In the Netherlands, from 2007 police census data show a sharp decrease in the number of suspects of crime among juveniles aged 12 to 25 years old. How to explain this decrease remains unclear. Constructionist theories suggest that changes in police census data are fully explained by changes in the law enforcement system. Normative theories argue that changes in police data can be explained by demographic, social or economic trends. In this paper, we systematically explored the (inter)national literature for macro factors that could explain changes in juvenile crime. Next, in an empirical case study of the city of Amsterdam, we explored which of these macro factors relate to changes over time in the number of juvenile suspects of crime and the types of crime they were suspected of. Due to multicollinearity of the macro factors multivariate analyses were not possible. Our results indicate that the decrease in police registered juvenile crime in Amsterdam should be explained by multiple factors. Some of these factors concern policy investments (such as focus on school drop-out and targeted law enforcement), other factors relate to socialdemographic developments which appeared coincidentally.

Trends in perceptie van criminaliteit

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2015
Trefwoorden fear of crime, risk perception
Auteurs Marnix Eysink Smeets en Dr. Ben Vollaard
SamenvattingAuteursinformatie

Some overestimation of crime risk is likely, but that does not mean that risk perceptions are not adjusted in line with changes in actual crime risk. Based on time series data, we show that crime risk perceptions are strongly related to rates of victimization. The conventional wisdom that the drop in crime since the 1990s did not result in an adjustment in risk perceptions can be easily refuted. The much discussed crime drop goes together with a much less discussed fear drop.

The explosive growth of the Internet has led to countless new possibilities, and it opened the way for societal progress and an extensive globalization and digitization. However, the original ambition of the Internet as a free, open and neutral medium has also led to new possibilities in the field of crime. The current paper illustrates how governments dealt with the development of the Internet and it gives an explanation for why and how unintended side effects have manifested in society. Using the phenomenon of digital child abuse, this paper offers recommendations for an effective government response and for an effective detection of and fight against cybercrime.

Jeugddelinquentie in vergelijkend perspectief

Vertellen micro- en macroanalyses hetzelfde verhaal?

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2015
Trefwoorden cross-national criminology, juvenile delinquency, theoretical integration, self-report survey, theory-testing
Auteurs Chris Marshall PhD en Prof. Ineke Haen Marshall
SamenvattingAuteursinformatie

This article presents a micro- and a macro-level analysis of predictors of delinquency in order to contribute to the discussion about the micro-macro problem in criminology. We use Coleman’s boat (1990) to situate our research question. Individual theories dominate the field of delinquency, there are few theories at macro level. Cross-level theoretical integration primarily takes place between individual (micro) and community (meso) levels, and hardly ever on (national) macro level. Our question is to which extent macro-level theory fruitfully may use concepts drawn from micro-level theory. We test a micro and a macro model using indicators from the domains of family, school, friends/peers and economy, using data collected by the Second International Self-Report Study of Delinquency (ISRD2), a cross-national self-report survey of delinquency and victimization among students between 12 and 16 years in 30 countries (n=71.436). Dependent variable at micro level is versatility (last year), at the macro level (national) we use contacts with the police for youths under 18. Results confirm the importance of including macro context (country clusters) in the analysis of individual delinquency. We further conclude that factors related to family and friends correlate at both micro and macro level with measures of delinquency; the role of school and economic factors is less clear-cut. The article concludes with the recommendation to give the micro-macro problem in delinquency theory a more central and explicit position in research programs.

Agressie in de tram

Het perspectief van trambestuurders

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2015
Trefwoorden Tramdrivers, strategies, aggressive passengers, masculinity
Auteurs Dr. Thaddeus Müller en Roy Zeestraten
SamenvattingAuteursinformatie

In this article we focus on how tram drivers react when confronted with a situation of aggression in the tram. Their role in these situations has hardly been explored in recent Dutch studies on this topic. In our explorative research, which consisted of observation and interviews in The Hague, our aim is to gain the perspective of tram drivers on aggressive passengers. Through their eyes we describe a range of strategies which they use to restore public order. Our research shows that in order to understand the reaction of tram drivers a) this has to be placed in the sequential development of an aggressive interaction and b) this has to be related to the ways they give meaning to the aggression of passengers and their work context. Our research shows that there are two perspectives among tram drivers: a) a ‘business’ perspective, with an emphasis of tram drivers as employees who avoid risk situations and call for support in situations they cannot control and b) a personal perspective, in which tram drivers tend to follow more personal guidelines, in which masculinity plays a central role. Those who use the later perspective become more involved in violent and physical interactions.

SamenvattingAuteursinformatie

In this interview, Lode Walgrave talks to John Braithwaite, one of the most cited white collar crime scholars and best known for his ‘reintegrative shaming’, which added the crucial moral-emotional and ethical dimensions to the body of work on crime and crime control. John Braithwaite tells about his major publications and developments in his intellectual endeavour: the role of shaming and its importance in restorative justice, dominion, responsive regulation, and also his recent project on peacebuilding. Braithwaite’s career and political involvement are discussed throughout the interview, as well as his critical view with regards to the fragmentation of social sciences (including criminology).

Gedragsprofiling: het bepalen van kwade bedoelingen en het meten van effectiviteit

Auteurs Helma van den Berg, Remco Wijn en Dianne van Hemert
SamenvattingAuteursinformatie

Is behavioural profiling a viable alternative to more traditional approaches to profiling, viewed from the perspectives of underlying theoretical assumptions and measures of effectiveness? In this article we describe behaviour profiling in relation to other types of profiling, we review relevant psychological mechanisms that underpin behaviour profiling, and discuss effectiveness of this type of profiling as well as methodological aspects of measuring effectiveness. Behaviour profiling is a method largely used to select potential offenders before the offence is committed by observing and giving meaning to behaviours preceding incidents. Deviant behaviours exhibited by suspects can be either part of a modus operandi related to the offence, the consequence of increased stress, or an atypical response to prodding actions by security officers. Relevant psychological mechanisms to explain ways behaviour profiling works include direct characteristics of deception as well as indirect indicators of deception, such as a criminal being more self-focused and more cognitively engaged. Effectiveness of behaviour profiling is increased by training, including learning more about modi operandi and related behaviours, awareness of biases in general, specific relevant biases, and techniques to correct for these biases.

Vrijwilligheid, vertrouwelijkheid en onpartijdigheid

Opvattingen van deelnemers aan herstelbemiddeling in Vlaanderen

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 2 2015
Trefwoorden Herstelbemiddeling, werkingsprincipes, onpartijdigheid, vrijwilligheid, vertrouwelijkheid
Auteurs Vicky De Mesmaecker
SamenvattingAuteursinformatie

This article considers the fundamental restorative justice principles of voluntary participation, the impartiality of the facilitator and the confidentiality of the restorative process from the point of view of participants to victim-offender mediation in Flanders, Belgium. These principles have remained relatively theoretical; little is known about how they are perceived by the participants to restorative practices. Results of our study show that whereas victims and offenders unequivocally support the principles of voluntariness and impartiality, the principle of confidentiality causes dissatisfaction and frustration when they believe it hinders the judge trying the case in court from establishing the truth about the facts.
