    The External Monitor of Forensic Psychiatric Patients (EMT) aims to increase the knowledge of forensic psychiatric patients and the effectiveness of mandatory forensic treatment. In the EMT, five judicial organizations merged their anonymized digital data on (ex-)patients for research purposes. Data originated from the databases of the NIFP, DJI, AVT, 3RO and WODC. By merging this data, a larger part of the trajectory of a forensic psychiatric patient becomes known. Results show that it is possible to combine data from the digital databases of separate organizations for research and analysis purposes. To illustrate the opportunities of the use of merged data, an explorative study was conducted into a current subject. In this study, 218 ‘tbs-patients’ were included and several characteristics of patients of whom the mandatory forensic treatment has ended were compared with those of patients still under mandatory treatment. Suggestions are made for merging data files and for future research.

    Although the Netherlands criminalised some forms of labour exploitation as human trafficking, many cases remain undetected. This is probably due to low self-identification among victims. Whereas research revealed factors obstructing self-identification among victims, it remains unclear how some victims do arrive at self-identification. Drawing on in-depth interviews and focus group discussions with victims and professionals, this qualitative study identifies two ideal-typical pathways to self-identification. In the first trajectory self-identification is gradually formed through information gathering and deteriorating working conditions. In the second trajectory self-identification is triggered by a sudden vital event.

    On September 21th 2012, a sweet sixteen party in Haren (a Dutch village), announced on Facebook as PROJECT X Haren, turned into a riot in which youngsters clashed with the police. The blame was put on the film Project X (2012) that would have inspired adolescents to become aggressive and violent. However, like other adolescent comedies, this movie offers an insight in the adolescent state of mind, the role of humor and their lack of risk assessments. Much violence is (harmless) slapstick-like, boundaries are exceeded (sex, alcohol, drugs) and transgression is often directed against parents, teachers and the police. What is tested in the adolescent imagination is the public order. Film functions as a symbolic rite of passage, with carnivalesque inversions. Reacting in Haren on this adolescent state of mind with an administrative prohibition (‘there is no party’) confirmed the juvenile joke. Acting as if it is not a party but a huge disaster (by enlarging police forces) contributed to make the riot a reality that the youngsters themselves never imagined. The commission of inquiry recommends taking serious film and other forms of public imagination, because they contribute to our understanding of reality, especially concerning the perceptions of societal actors.

    This paper looks at how Dutch newspapers dealt with mental disorders and gender in their crime reports in 1930. The Psychopath Acts, which allowed special restriction orders (‘TBR’) to be imposed on mentally disturbed delinquents who were a danger to society, had just come into effect then. The newspapers did not present such TBR criminals as dangerous or mentally disturbed. Instead, the papers used ‘madness’ to explain apparently motiveless crimes such as killing one’s own children. Female perpetrators were no more likely to be labelled mentally ill than male perpetrators.

    This contribution focuses on the manner in which between 1880 and 1940 private actors in the port of Antwerp, whether or not in cooperation with the public authorities, interpreted crime and crime control in terms of risk management, loss prevention and situational crime prevention through a strict economic approach, as opposed to the then dominant institutionalized and criminological discourse. Whereas crime control by the major criminal justice institutions put an emphasis on the biological, psychological and sociological characteristics of the offender, measures taken by maritime, industrial and commercial organizations were aimed exclusively at manipulating the temporal and spatial dimensions of the opportunity structures in which criminal activities, which posed a threat to the economic profitability, could develop.

    Intercultural communication is often portrayed as communication between people with a different ethnic or national background. People may interpret differences and misunderstandings arising in communication as especially grand and problematic. Sometimes, people see the reason for a difference in opinion or the conflict to be situated within the other (often national or ethnic) culture. They see themselves and others as a member of a different group, with a different culture and thus claim the differences to be related to the culture and not the individual person (culturalising or culturistic approach). This approach entails certain risks when it is seen as a condition to be able to speak to others and when handled as the sole frame of reference to interpret people’s meaning-making. An alternative approach can be found in a systemic and communication-theory approach, linking it to intersectionality, pluralism, diversity competence and the TOPOI model, as this article explains.

    The Western world seems to be a secular one. Although secularization has long roots, from the sixties onwards the role of religion in public life has diminished. How did that affect the crime and security issue? Criminological literature learns that there is a two-sided relationship: (1) in a religious context there is an inhibiting effect of being religious; and (2) religion can also legitimize or neutralize criminal or violent behavior – for example in the case of Islam-related terrorist acts. Secularization did indeed contribute to the rise of crime; in nowadays secular context religion can – the other way around – legitimize criminal behavior. The author argues that secularization also has facilitated the growth of the security issue as such. Fear of crime was the driving force behind a process in which secularization resulted in securitization of Western society.

    The concept of positive security appears more and more often in academic and public discussions. It presents a normative agenda for a non-repressive approach of security. In the article, it is claimed that the concept and its implications lack fundamental clarity. First of all, it is illustrated that the meaning of positive security primarily develops on the renouncement of negative security. Second, a historical comparison between the discipline of international relations and criminology discloses that different meanings have been assigned to positive security that seem at times at odds with each other. These frictions substantiate the view that it is problematic to accept positive security as an unequivocal recipe for change. Finally, the consequences of the disseminated structure of meaning are discussed in relation to the ambition of reform that positive security represents. For example, advocates of positive security do not seem eager to commit themselves to very clear normative views. This makes it difficult to really pin down what the suggested changes underlying positive security, are truly implying. Moreover, positive security invites us to extend the horizon of security politics to include various kinds of positive needs and values. But doesn’t this take us back to the initial criticism that the reach of the security concept has extended too much, covering virtually every aspect of life?

    This article provides data about qualitative and quantitative research that was executed in juvenile detention centres in The Netherlands in the framework of the EU-funded Restorative Justice in Europe project. The results of a survey amongst 75 staff members are presented. Special attention is paid to the restorative handling of internal conflicts and crimes within the detention centre. Restorative Justice Nederland, executing this research, also developed a self-assessment tool for prisons, the Organisational Maturity Grid Restorative Practices, that can be used to assess how ‘mature’ restorative practices are within an organisation. Based on this maturity grid and the data of the research advice is provided on how restorative practices within juvenile detention centres can be brought to the next level.

    High crime rates among second-generation immigrants are usually attributed to the ethnic group’s social disorganisation and weak socio-economic position in the host society. According to the import theory, the causes of crime can however also be sought in their native countries or regions. Due to a lack of empirical data, this has rarely been tested, with Moroccan immigrants in the Netherlands as exception. Ethnographic research among small groups of delinquent boys in Dutch cities suggests that the rural background or the character of the Rif area of its Moroccan immigrants may explain their high crime rate. In this article we examine whether this holds true when all young Moroccan migrants in the Netherlands are taken into account. Crime data from a Police Identification Service System (HKS) at the individual level are linked with personal data from the Social Statistical Database (SSB) of Statistics Netherlands, including their (parents’) regional descent. Logistic regression analysis shows that the current socio-economic position in the Netherlands is a strong predictor of criminal conduct, while the impact of geographic descent, directly or indirectly via socio-economic position in the Netherlands, is negligible. Based on this study, there is no reason to revise the common explanation of the immigrant-crime nexus.

    Many articles have dealt with the question why restorative justice in cases of intimate partner violence (IPV) may or may not be appropriate. Seeing however as a punitive approach towards IPV is rapidly losing popularity as an effective way of dealing with this complex type of violence, as well as the outcomes of a recent study by the European Agency for Fundamental Rights (2014) – where 25% of the Dutch women that were surveyed indicated they had experienced violence by an intimate partner – restorative justice may be a promising alternative after all.
    Instead of adding to the debate, the current article focuses on how restorative justice can be constructed to be appropriate for IPV cases, and is explorative in nature. In order to do so, the theory behind transformative learning is combined with restorative justice practices, shifting the focus from ‘restoration’ to ‘restorative transformation’. Such a restorative transformative learning approach focuses on transforming violent meaning perspectives that dictate the use or toleration of violence. Instead of trying to restore the individual back to the state they were in before the violence took place – as ‘restoration’ traditionally implies – the goal of restorative transformative learning is to restore the individual back to a state before a violent meaning perspective was acquired. The transformation of violent meaning perspectives is therefore the prerequisite for restoration.
    The method that is introduced in this article offers a practical framework and guidelines to achieve such a transformation. It answers to the complexity of IPV cases by focusing on the entire family system, while leaving room for individual restoration. In doing so, restorative transformative learning may possibly open the way to the acceptance of restorative justice in the field of IPV.

    This article describes a qualitative inquiry into Dutch people going to Syria for participating in Jihad. The inquiry compares theoretical findings with empirical facts, based on a content analysis and a document analysis, completed with ten depth-interviews. The results show that a combination of scientific findings on radicalisation and foreign fighters explains the jihad movement to Syria partly. The results also show that some factors, which have not recently be examined scientificly, are crucial for the character and extent of the movement towards Jihad.

    Since Islam stands for a total way of life, it also includes a vision on crime and punishment. According to several (Muslim)scholars the Sharia contains not so much a message of revenge and retribution but rather one of compassion, forgiveness and mercy. Much depends on which sections of the holy sources of Islam are read and subsequently how these sections are interpreted. However, fact is that – in the context of quite a number of criminal offences – Islamic criminal law gives room for restorative practices. These practices prove to be more beneficial with regard to the realization of remorse, forgiveness and reconciliation than the regular criminal process. Since restorative practices form an intrinsic part of (pre-modern) Islamic criminal law and since more and more initiatives are being developed nowadays to incorporate such practices in (modern) Western criminal law, it is of fundamental importance to take note of Islamic criminal law. Before focusing in this contribution on the role of restorative practices, remorse and forgiveness in Islamic criminal law, first the position of victims in criminal law under influence of Islam and Christianity will be discussed on the basis of the ideas of the Dutch victimologist Jan van Dijk. Furthermore, attention will be paid to the decline of mysticism in Islam and to the possible consequences and risks thereof – also for the role of restorative practices, remorse and forgiveness in Islamic criminal law.

    The aim of the article is to analyse the correlations between social cognitive factors and behaviour that increases resilience by police officers and to assess in which way intention mediates the possible correlations. The study was based on Ajzen's theory of planned behaviour. A cross-sectional survey study was conducted in which 1.799 police officers in the Netherlands completed a questionnaire. Data was also collected by organising qualitative expert meetings with police officers. The data has been analysed using linear regression. The results show that intention had the highest correlation with behaviour that increases resilience and mediates the correlations of the social cognitive factors partially. Perceived behavioural control and attitude also had a direct correlation with behaviour that increases resilience. Subjective norm had a weak correlation with behaviour. This is the first study which tested TPB for behaviour that increases resilience by police officers. Because the design of this study was cross-sectional, more research is needed to better understand the causal relations between social cognitive factors and intention with behaviour that increases resilience by police officers.
