SamenvattingAuteursinformatie

In recent years, measures have been taken to involve victims in the Netherlands more in the criminal proceedings of their offenses. This development, has led the three Dutch probation organizations (together 3RO) to aim for a more victim focused and restorative oriented approach with their clients. Two reports have been written to aid this victim-oriented approach within probation services. This contribution reflects on these reports and provides additions based on scientific literature. Both reports offer a good overview of existing practices and approaches to work in a more victim focused and restorative way, which can help to increase awareness among probation workers. The additions concern research about the positive outcomes of organizing contact between offenders and victims from unrelated crimes and new research findings concerning the role of feelings of guilt and shame. In addition, consciously talking and acknowledging clients’ victimization is presented as an essential mechanism to create willingness among them to consider the experiences of (their) victims, especially for those who are initially unwilling to do so.

Partnerdoding in Nederland

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 4 2018
Trefwoorden Partnerdoding, Epidemiologie, Moord, Nederland
Auteurs Marieke Liem, Inge de Jong en Jade van Maanen
SamenvattingAuteursinformatie

Intimate partner homicide (IPH) constitutes one of the most prevalent types of homicide. This study aims to assess the nature and prevalence of intimate partner homicide in the Netherlands in the period 2009-2014. In doing so, we make use of police data, court data, and media articles. Findings show that IPH occurs 29 times per year, resulting in a victimization rate of 0.20 per 100,000, similar to other Western-European countries. Our results further show a decline in IPH in the last years. IPH in the Netherlands mostly occurs in heterosexual relationships, and involves male perpetrators and female victims. Finally, we reflect on possible causes for the decline of this type of homicide.

Herstelrecht en slachtoffers van bedrijfsgeweld

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 4 2018
Trefwoorden Corporate violence, Health, concepts of participation
Auteurs Ivo Aertsen
SamenvattingAuteursinformatie

Whether and under which conditions restorative justice can be applied to cases of corporate violence is explored starting from the phenomenon of corporate violence, defined as acts committed by corporations in the course of their regular activities but with harmful consequences for people’s health. Specific characteristics of different types of corporate violence are presented, as well as victims’ needs, experiences and expectations. The applicability of restorative justice, but also the need of its rethinking, is discussed through an analysis of the role of its key actors and the concepts of participation and restoration.

Over non-speciesisme in de criminologie

Tijdschrift Tijdschrift voor Criminologie, Aflevering 2 2018
Trefwoorden speciesism, animal rights, animal cruelty
Auteurs Dr. Janine Janssen
SamenvattingAuteursinformatie

Criminology traditionally focuses on the human experience. However, several criminologists have seriously criticized this anthropocentric perspective. In their view from a criminological perspective humans and other than human animals should be given equal attention. Although they advocate a non-speciesist criminology, they are not trying to fundamentally change criminology as we know it. Instead, their appeal is to not consider other than human creatures as passive objects and solely from the perspective of their usefulness for humans. Yet, this objective poses substantial methodological challenges to criminologists.

Persoonlijkheidskenmerken van e-fraudeslachtoffers

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 1-2 2018
Trefwoorden Online fraud, Big Five personality traits, Phishing, online marketplace fraud, cybercrime prevention
Auteurs Jildau Borwell, Jurjen Jansen en Wouter Stol
SamenvattingAuteursinformatie

With the digitization of society, perpetrators gained new tools to commit crimes. Online fraud, also referred to as e-fraud, is one of the most common types of cybercrime. The present study focusses on two types of e-fraud: phishing and online consumer fraud. Although e-fraud always contains a digital component, the human is the weakest link in such crimes. Perpetrators deceive their victims to acquire sensitive data or to conclude a fraudulent sale, which makes victims unwillingly participate in the offence. However, not every person adheres to such fraudulent schemes. This raises the question what makes some people comply with these schemes and thus become a victim of cybercrime, while others do not. In this study, the differences between personality traits of e-fraud victims and the Dutch population were investigated. Personality traits influence the way people process information and react to situations, which also applies when people are confronted with e-fraud. Data were collected through an online survey, in which 224 e-fraud victims participated. The outcomes of the survey were compared with norm groups representative for the Dutch population. E-fraud victims, compared to the Dutch population, scored higher on extraversion, altruism and conscientiousness, and lower on neuroticism. Based on the findings, recommendations have been made for the development of targeted preventive measures against e-fraud.

SamenvattingAuteursinformatie

This study focusses on determinants of willingness to report cybercrime to the police or to other organizations and motivations for (not) reporting victimization. In this study, a questionnaire containing vignettes is used. Vignettes are semi-experimental designs in which hypothetical situations are presented and certain factors can be manipulated between and within respondents. Factors that are measured within the vignettes are the type and seriousness of the offence, the relationship between offender and victim and which possibilities for reporting the offence are available.
It is shown that the type of offence is an important determinant for willingness to report the offence, which is highest for fraud, followed by hacking and malware. Likewise, willingness to report is higher for more serious offences than for less serious offences. These results are comparable to results on willingness to report traditional crimes.
With regard to psychological determinants, results are not in line with previous results on willingness to report traditional crimes. For the relationship between offender and victim, mixed results are found. If the offender is an acquaintance of the victim, willingness to report to the police increases, but willingness to report to another organization decreases, compared to the offender being unfamiliar to the victim. Another surprising result is that no correlation is found between attitudes towards the police and willingness to report offences. Also unexpectedly, it is found that respondents who have previously reported crime and were unsatisfied about this experience, were more willing to report offences than respondents who never reported crimes before.
Regarding motivations for willingness to report, it is found that, in general, motivations for reporting cybercrime are strongly comparable to motivations for reporting traditional crime, however, differences in motivations are found between the different types of cybercrime.

Over de grenzen van de criminologie

Internationale betrekkingen en de criminologie van internationale misdrijven

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2018
Trefwoorden international criminology, international relations, international crimes
Auteurs dr. Maartje Weerdesteijn
SamenvattingAuteursinformatie

Criminologists decided over the last few decades that it is important to study international crimes, meaning genocide, crimes against humanity and war crimes, from a criminological perspective. With the international community taking up the responsibility to protect populations from these crimes and the prominence of international criminal justice on the world stage, it is argued that international criminology should embrace international relations more as an important sub-discipline.

Het ‘cyborg crime’-perspectief

Theoretische vernieuwing in het digitale tijdperk

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 1 2018
Trefwoorden cybercrime, cyborg, cyborg crime, Actor-Netwerk theory, Latour
Auteurs Wytske van der Wagen MsC
SamenvattingAuteursinformatie

This study departs from the notion that current high-tech crime developments bring various new challenges for the rather anthropocentric, instrumental and dualistic theoretical repertoire of criminology. The article reflects on these challenges and proposes the alternative ‘cyborg crime’ perspective. This concept is the result of an explorative research on the theoretical potential of the actor-network theory (ANT) for cybercrime. The study concludes that ANT and the ensuing cyborg crime perspective enables to grasp certain dimensions of cybercrime more profoundly. ANT can move us (criminologists) beyond the classical novelty debate surrounding cybercrime and stimulate theoretical innovation.

Mijn excuses! – Wat jongeren kunnen leren van het excuusgesprek in de Halt-afdoening

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 1 2018
Trefwoorden Young offenders, Halt, extra-judicial intervention, efficacy of offering an apology, moral norms
Auteurs Wendy Buysse en Manja Abraham
SamenvattingAuteursinformatie

The Halt-intervention is an extra-judicial intervention for young people who have committed a minor offense. This article zooms in on the results of a literature review concerning the efficacy of offering an apology, one of the core elements of the Halt-intervention. Offering an apology leads to more insight into the consequences of their behavior and it increases the sense of moral norms. Shame and guilt play a crucial role in this process. The effect of the excuse can be increased by good mediation between perpetrator and victim, good preparation of the conversation, and the drafting of a contract. These instructions can also be applied when offering an apology in other interventions.

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 1 2018
Trefwoorden apology ritual, The victim perspective, Sincerity, Physical aspect of apology, symbolic meaning of apology
Auteurs Inge Vanfraechem, Daniela Bolívar en Ivo Aertsen
SamenvattingAuteursinformatie

Empirical research on restorative justice shows that offenders can apologise to victims. Because of the ritual component of restorative justice and the possible influence on the justice system, certain questions arise: how do victims perceive these apologies? Is it important for victims that these apologies are sincere? The aim of the article is to discuss these questions through three topics, namely the physical aspect of the ritual, the symbolic meaning for victims and the relation between the offender’s apologies and the victim’s reaction.

Selectieve ‘culturalisering’ in de praktijk van de jeugdbescherming in België

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 3 2017
Trefwoorden youth justice, Roma, Caucasian migrants, refugees, selectivity, deviance
Auteurs dr. Olga Petintseva
SamenvattingAuteursinformatie

This paper focuses on the practice of youth justice (termed ‘youth protection’ in Belgium) in which professional actors ascribe deviant behaviour of youngsters to different cultural and migration backgrounds. Intra-European Roma migrants and refugees from the Northern Caucasus in Belgium are chosen as case studies. Discourse analysis of 55 youth court files and 41 expert interviews with professional actors show that deviant behaviour of these young people is explained in different manners. Two discourses are identified: ‘criminal vagabonds’ and ‘war torn children’. These discourses and their effects in practice differ tremendously for both groups. The broader discussion this article touches upon is the selective inclusion and exclusion in the institutions of formal social control, through social practices of culturalisation.

Auteurs Drs. Nik Smits en Prof. dr. Stijn Goeminne
SamenvattingAuteursinformatie

This paper empirically investigates whether the Flemish local income tax base yield in 306 Flemish municipalities is sensitive to changes in the local crime level between 2000 and 2014. There are two underlying assumptions. First, in a Tiebout world, rational voters holding the local government accountable for the safety of its citizens move when the local level of security becomes too greatly alienated from what they want it to be (first assumption). If migration is due to crime, the wealthier citizens are expected to move first. Consequently, the average income per capita and thus the income distribution will be affected, which in turn will influence the local income tax base yield (second assumption). By confirming both assumptions, evidence is presented for a relation between changes in local crime rates and the income tax base yield of Flemish municipalities, occurring through household mobility.

Verstoorde veiligheidsbeleving

In gesprek met buurtbewoners over de ‘onveiligheid’ in hun buurt naar aanleiding van gestegen ‘gevoelens van onveiligheid’

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 4 2017
Trefwoorden fear of crime, qualitative analysis, evidence based policy
Auteurs Remco Spithoven
SamenvattingAuteursinformatie

The ‘fear of crime’ is a buzzword among citizens, media, politicians and professionals by now. But the phenomenon seems to be as intangible as it is important. The struggle of professionals with this concept is the result of a too wide and self-evident problem definition. This article contains an alternative approach. The focus is on disturbed fear of crime: a negatively changed and problematically experienced fear of crime on the level of the neighborhood.
Through a review of the literature and previous research, we work towards this concept and apply it to the neighborhood of Kerckebosch in the municipality of Zeist in the Netherlands. As during 2014 the local quantitative indicators for ‘the fear of crime’ rose from 7% of the local population indicating to ‘sometimes feel unsafe’ to 22%, while the rest of the municipality remained quite stable. Additionally, several local professionals received complaints of multiple local inhabitants claiming to ‘feel unsafe’ in the neighborhood. Our research question was: What explanations for their ‘disturbed fear of crime’ do local inhabitants of the neighborhood Kerckebosch give?
It was highly plausible that this local rise of the fear in Kerckebosch was connected to the social re-engineering of the neighborhood, but the exact nature of the quantitative rise was unclear. Therefore, we have interviewed 25 local inhabitants. Qualitative analyses showed the local rise of ‘the fear of crime’ to be the result of: (I) physical characteristics of the neighborhood; (II) events of burglary and intimidation from the past; (III) the presence of loitering youths and – primarily – (VI) a backlash of social integration as a side effect of the social re-engineering of the neighborhood. These qualitative explanations to the observed quantitative discontinuity led to several policy advises, which were based on international effect studies.

‘Troostmeisjes’: Over de structurele ontkenning van seksuele slavernij en voortschrijdende victimisatie

Tijdschrift Tijdschrift over Cultuur & Criminaliteit, Aflevering 2 2017
Trefwoorden comfort women, denial, sexual slavery, discourse analysis
Auteurs dr. mr. Roland Moerland
Samenvatting

In 2015, South-Korea and Japan came to a ‘final’ agreement concerning the ‘comfort women’ issue. This contribution reveals that this deal signals the next stage in a process of denial through which Japanese authorities have structurally denied the women’s’ victimhood. Taking a discourse analytical approach, the contribution investigates this historical process of denial and its implications. The analysis shows that denial takes several forms and performs different functions throughout the process. It demonstrates that denial is an interactional phenomenon, has different psychologies underlying it, and that it operates on different levels. Denial ultimately contributes to a state of continued victimization.

Effecten van informatieverstrekking op agressie van UWV-cliënten

Een experimentele scenariostudie

Tijdschrift Tijdschrift voor Criminologie, Aflevering 1-2 2017
Trefwoorden experimental scenario study, frustration aggression, informational justice, workplace violence, negative affect
Auteurs Natascha Sprado MSc, Dr. Tamar Fischer en Lisa van Reemst MSc
SamenvattingAuteursinformatie

This study investigates the effect of providing information about decision making on aggression of clients of the Dutch Employee Insurance Agency (UWV). The expectation is that providing adequate information leads to a decrease in aggression, because it influences feelings of informational justice and frustration. UWV-clients (N=1.415) participated in an experimental scenario study (adequate vs. limited information providing). Next to aggression, psychological, UWV and social demographic characteristics were measured. Compared to limited information, receiving adequate information results in lower aggression. Clients with more negative affect show more aggression, but receiving adequate information especially reduces aggression in these clients.

Internetbankieren: veiligheidspercepties van gebruikers

Tijdschrift Tijdschrift voor Veiligheid, Aflevering 1 2017
Trefwoorden Risicoperceptie, Online bankfraude, Slachtofferschap, Informatiebeveiliging
Auteurs Jurjen Jansen, Nicolien Kop en Wouter Stol
SamenvattingAuteursinformatie

In today’s society, full use is made of online banking. This makes safety and security of online banking an important issue. Two significant threats to users of online banking in The Netherlands are phishing and malware attacks. In this study, an end-user perspective is adopted to study customers’ perceptions regarding safety and security of online banking. A unique feature to this study is that we explore – besides other predictor variables – the relationship between online banking fraud victimization and risk perception. We have made a distinction between three types of victimization: 1) self-experienced victimization, 2) victimization of acquaintances, such as family and friends, and 3) having heard of stories in the media about online banking fraud victimization. Based on a secondary analysis of data from 1200 Dutch users of online banking, collected through an online survey, we conclude that participants perceive their risk of online banking fraud to be small. In general, participants have little experience with victimization, both themselves (2.3%) and in social settings (29.6%). Three quarters of the respondents (75.6%) are aware of victimization of online banking fraud by means of media coverage. Direct and indirect victimization, however, have almost no influence on risk perception regarding online banking fraud. Risk perception is mainly determined by perceived vulnerability, that is, the estimated probability of becoming a victim of online banking fraud. Furthermore, perceived severity or impact of online banking fraud and the degree of trust in online banking contribute to some extent to risk perception. In total, 64.0% of variance in risk perception was explained by the predictors perceived vulnerability, perceived severity, locus of control, trust in online banking, (in)direct experiences with victimization (self, acquaintances and media) and demographic variables (gender, age, educational level and work status). The results of this study may help to improve communication about risks regarding online banking.

Voor wie is herstelrecht?

Een studie naar slachtoffers en (niet-)participatie

Tijdschrift Tijdschrift voor Herstelrecht, Aflevering 1 2017
Trefwoorden restorative justice, victim participation, victim-offender, mediation, victims’ motivations
Auteurs Daniela Bolívar
SamenvattingAuteursinformatie

The phenomenon of victim participation in restorative justice (RJ) has been studied from two main angles: describing victims’ motivations to take part in RJ and studying the benefits that different groups of victims may obtain when participating in RJ. However, methodological limitations of former studies have impeded to offer conclusive answers to the question ‘for whom is RJ’. This article offers insights into these issues, focusing on the descriptive findings of a mixed-method study carried out in the context of victim-offender mediation (in Spain and Belgium) and assessed before the encounter (if any) took place. Findings suggest that, before mediation, victims’ personal characteristics tend to differ. The factor ‘victim-offender relationship’ also appeared as an important variable. Implications of these findings are discussed.
